第十七条 归侨、侨着有权出境定居。 Article 17 Returned overseas Chinese and the family members of overseas Chinese shall have the right to leave the country and settle down abroad.
第十七条父母或者其他监护人必须履行保障适龄女性儿童少年接受义务教育的义务。 Article 17. Parents or other guardians must perform their duty of ensuring that female school-age children or adolescents receive the compulsory education.
第十八条高等教育由高等学校和其他高等教育机构实施。 Article 18 Higher education shall be imparted by institutions of higher learning and other institutions of higher education.
第十八条各级人民政府和有关部门应当办好师范教育，并采取措施，鼓励优秀青年进入各级师范学校学习。各级教师进修学校承担培训中小学教师的任务。 Article 18 People's governments at various levels and the departments concerned shall make a success of normal school education and adopt measures to encourage outstanding youth to study at normal schools at various levels. Schools for teachers' advanced studies at different levels shall undertake the task of training teachers for primary and secondary schools.第十八条 归侨、侨眷申请自费出国学习，按照国家有关规定给予照顾。 Article 18 Returned overseas Chinese and the family members of overseas Chinese who apply to go abroad for the purpose of study at their own expense shall be given preferential treatment in accordance with the relevant state regulations.
第十八条 国家实行九年制义务教育制度。 Article 18 The State applies a system of nine-year compulsory education.
第十八条国家保障残疾人受教育的权利。 Article 18 [Responsibilities] The state shall guarantee the right of disabled persons to education.
第十九条（解释部门）本办法具体的应用问题，由市教育行政部门负责解释。 Article 19 (Department Responsible for Interpretation in Application) The municipal educational administrative departments shall be responsible for the interpretation of the present Procedures in the specific application.
第十九条 国家实行职业教育制度和成人教育制度。 Article 19 The State applies a system of vocational education and a system of adult education.
第十九条残疾人教育，根据残疾人的身心特性和需要，按照下列要求实施： Article 19 [Education According to Different Characteristics] The education of disabled persons shall be carried out according to their physical and psychological features and needs and shall meet the following requirements:
第十九条 本条例的实施办法，由国务院学位委员会制定，报国务院批准。 Article 19. Measures for the implementation of these Regulations shall be formulated by the Academic Degrees Committee of the State Council and submitted to the State Council for approval.
第十九条各级人民政府和有关部门应当采取措施，组织妇女接受职业教育和技术培训。 Article 19. People's governments at various levels and departments concerned shall take measures to organize women in receiving vocational education and technological training.
第二条 本法所称未成年人是指未满十八周岁的公民。 Article 2 Minors as used in this Law refer to citizens under the age of eighteen.
第二条 外国教育机构同中国教育机构（以下简称中外合作办学者）在中国境内合作举办以中国公民为主要招生对象的教育机构（以下简称中外合作办学机构）的活动，适用本条例。 Article 2 These Regulations apply to the activities of the cooperation between foreign educational institutions and Chinese educational institutions (hereinafter referred to as Chinese and foreign cooperators in running schools) in establishing educational institutions (hereinafter referred to as Chinese-foreign cooperatively-run schools) within the territory of China to provide education service mainly to Chinese citizens.
第二条 本法适用于各级各类职业学校教育和各种形式的职业培训。国家机关实施的对国家机关工作人员的专门培训由法律、行政法规另行规定。 Article 2 This Law applies to vocational schools of all types and levels and to all forms of vocational training. Specialized training provided by State organs for their functionaries shall be governed by separate laws and administrative rules and regulations.
第二条本法适用于在各级各类学校和其他教育机构中专门从事教育教学工作的教师。 Article 2 This Law shall apply to teachers specially engaged in education and teaching at schools of various levels and categories or other institutions of education.
第二条 在中华人民共和国境内的各级各类教育，适用本法。 Article 2 This Law shall be applicable to education of all types and at all levels offered within the territory of the People's Republic of China.
第二条在中华人民共和国境内从事高等教育活动，适用本法。 Article 2 This Law shall be applicable to engagement in activities of higher education within the territory of the People's Republic of China.
第二条 凡是拥护中国*的领导、拥护社会主义制度，具有一定学术水平的公民，都可以按照本条例的规定申请相应的学位。 Article 2. Any citizen who supports the leadership of the Communist Party of China and the socialist system and has attained certain academic standards may apply for an appropriate academic degree in accordance with the provisions of these Regulations.
第二十条（施行日期）本办法自发布之日起施行。 Article 20 (Date of Implementation) The present Procedures shall become effective on the date of promulgation.
第二十条接受高等学历教育的学生，由所在高等学校或者经批准承担研究生教育任务的科学研究机构根据其修业年限、学业成绩等，按照国家有关规定，发给相应的学历证书或者其他学业证书。 Article 20 Students receiving higher curricula education shall be issued corresponding certificates of educational background or other certificates of studies by the institutions of higher learning or scientific research institutes approved to undertake the task of post graduate education they have been in on the basis of the length of schooling and achievements in studies in accordance with the relevant provisions of the state.
第二十条 国家实行国家教育考试制度。 Article 20 The State applies a national education examination system.
第二十一条各级人民政府应当采取措施，为少数民族地区和边远贫困地区培养、培训教师。 Article 21 People's governments at various levels shall adopt measures to cultivate and train teachers for regions inhabited by national minorities and for outlying and poverty-stricken areas.
第二十一条 各级人民政府应当创造条件，建立和改善适合未成年人文化生活需要的活动场所和设施。 Article 21 People's governments at various levels shall create conditions to establish and improve places and facilities suited to the needs of minors for cultural life.
第二十一条 国家实行学业证书制度。 Article 21 The State applies a system of education certificates.
第二十一条国家实行高等教育自学考试制度，经考试合格的，发给相应的学历证书或者其他学业证书。 Article 21 The state practices self-taught higher education examination system. Students having passed the examination shall be issued corresponding certificates of educational background or other certificates of studies.
第二十一条国家举办残疾人教育机构，并鼓励社会力量办学、捐资助学。 Article 21 [Channels of Education] The state shall set up educational institutions for disabled persons and encour age social forces to run schools and donate funds for schools.
第二十二条 国家实行学位制度。 Article 22 The State applies a system of academic degree.
第二十二条普通教育机构对具有接受普通教育能力的残疾人实施教育。 Article 22 [Methods of Ordinary Education] Ordinary educational institutions shall provide education for disabled persons who are able to receive ordinary education.第二十三条实行男女同工同酬。 Article 23. Equal pay for equal work shall be applied to men and women alike.
第二十四条教师考核结果是受聘任教、晋升工资、实施奖惩的依据。 Article 24 The assessment results shall be the basis for teachers' appointment and pay rise as well as rewards and punishments.
第二十四条 国家实行教育督导制度和学校及其他教育机构教育评估制度。 Article 24 The State applies an educational supervision system and an educational evaluation system for schools and other institutions of education.
第二十五条 接受职业学校教育的学生，经学校考核合格，按照国家有关规定，发给学历证书。 Article 25 A student who has received education at a vocational school and passed the examinations administered by the school shall be issued a certificate of schooling in accordance with relevant State regulations.
第二十五条设立高等学校，应当具备教育法规定的基本条件。 Article 25 The basic conditions prescribed by the Education Law should be met for the establishment of an institution of higher learning.
第二十五条 国家制定教育发展规划，并举办学校及其他教育机构。 Article 25 The State formulates plans for the development of education and establishes and runs schools and other institutions of education.
第二十五条国家有计划地举办各级各类特殊教育师范院校、专业，在普通师范院校附设特殊教育班（部），培养、培训特殊教育师资。 Article 25 [Teaching Staff] The state shall systematically set up various forms of normal schools and specialities for special education at different levels and special education classes (departments) attached to ordinary normal schools to educate and train teaching staff for special education.
第二十六条 中外合作办学机构的校长或者主要行政负责人行使下列职权： Article 26 The president or the principal administrator of a Chinese-foreign cooperatively-run school shall exercise the following powers:
第二十六条 国家鼓励通过多种渠道依法筹集发展职业教育的资金。 Article 26 The State encourages efforts to raise funds in accordance with law and through multiple avenues for developing vocational education.
第二十七条 中外合作办学机构依法对教师、学生进行管理。 Article 27 A Chinese-foreign cooperatively-run school shall administer its teachers and students in accordance with law.
第二十七条地方各级人民政府对教师以及具有中专以上学历的毕业生到少数民族地区和边远贫困地区从事教育教学工作的，应当予以补贴。 Article 27 Local people's governments at various levels shall grant subsidies to teachers and graduates from secondary vocational schools or from schools at higher levels who engage themselves in education and teaching in regions inhabited by national minorities or in outlying and poverty-stricken areas.
第二十七条申请设立高等学校的，应当向审批机关提交下列材料： Article 27 Whoever applies for the establishment of an institution of higher learning should present the following materials to the organ of examination and approval:
第二十七条国家保障残疾人劳动的权利。 Article 27 [Responsibilities] The state protects disabled persons the right to work.
第二十八条高等学校的章程应当规定以下事项： Article 28 Articles of association of an institution of higher learning should specify the following particulars:
第二十八条 学校及其他教育机构行使下列权利： Article 28 Schools and other institutions of education shall exercise the following rights:
第二十九条 中外合作办学机构的外籍人员应当遵守外国人在中国就业的有关规定。 Article 29 Foreign employees of a Chinese-foreign cooperatively-run school shall abide by the relevant provisions on employment of foreigners in China.
第二十九条 学校及其他教育机构应当履行下列义务： Article 29 Schools and other institutions of education shall fulfil the following obligations:
第二十九条教师的医疗同当地国家公务员享受同等的待遇；定期对教师进行身体健康检查，并因地制宜安排教师进行休养。 Article 29 Teachers shall enjoy equal treatment in medical care as the State public servants in the localities. They shall be given regular health check-ups and shall enjoy rest and recuperation holidays arranged in the light of local conditions.
第三条 中外合作办学属于公益性事业，是中国教育事业的组成部分。 Article 3 Chinese-foreign cooperation in running schools is an undertaking beneficial to public interests and forms a component of China’s educational cause.
第三条 归侨、侨眷享有宪法和法律规定的公民的权利，并履行宪法和法律规定的公民的义务，任何组织或者个人不得歧视。 Article 3 Returned overseas Chinese and the family members of overseas Chinese shall be entitled to the citizen's rights prescribed by the Constitution and the law and at the same time shall perform the citizen's duties prescribed by the Constitution and the law. No organization or individual may discriminate against them.
第三条 职业教育是国家教育事业的重要组成部分，是促进经济、社会发展和劳动就业的重要途径。 Article 3 Vocational education constitutes an important component of the nation's educational undertakings as well as an important avenue for promoting economic and social development and employment.
第三十条高等学校自批准设立之日起取得法人资格。高等学校的校长为高等学校的法定代表人。 Article 30 An institution of higher learning obtains the qualification of a legal entity as of the date of approval for its establishment. The president of the institution of higher learning shall be the legal representative of the institution of higher learning.
第三十条 任何组织和个人不得披露未成年人的个人隐私。 Article 30 No organization or individual may disclose the personal secrets of minors.
第三十条国家推动各单位吸收残疾人就业，各级人民政府和有关部门应当做好组织、指导工作。 Article 30 [Dispersed Employment] The state shall promote the employment of disabled persons by various units.
第三十一条 学校及其他教育机构具备法人条件的，自批准设立或者登记注册之日起取得法人资格。 Article 31 A school or any other institution of education that meets the requirements for a legal person shall acquire the status of a legal person from the date on which its establishment is approved or it is registered.第三十一条 各级人民政府可以将农村科学技术开发、技术推广的经费，适当用于农村职业培训。 Article 31 People's governments at various levels may allocate an appropriate part of the funds earmarked for developing science and technology and for spreading the use of advanced techniques in rural areas for the use of vocational training there.
第三十一条政府有关部门鼓励、帮助残疾人自愿组织起来从业或者个体开业。 Article 31 [Self-employment] Governmental departments concerned shall encourage and assist disabled persons to obtain employment through voluntary organization or to open individual business.
第三十二条 卫生部门和学校应当为未成年人提供必要的卫生保健条件，做好预防疾病工作。 Article 32 Departments of public health and schools shall provide minors with necessary sanitary and health-care conditions and make efforts to prevent diseases.
第三十二条社会力量所办学校的教师的待遇，由举办者自行确定并予以保障。 Article 32 The material benefits of teachers at schools run by different sectors of the society shall be determined and guaranteed by the sponsors themselves.
第三十三条高等学校依法自主设置和调整学科、专业。 Article 33 Institutions of higher learning independently set up and adjust disciplines and specialties.
第三十三条 职业学校、职业培训机构举办企业和从事社会服务的收入应当主要用于发展职业教育。 Article 33 The earnings derived by vocational schools or vocational training institutions from running enterprises or providing social services shall be mainly used for developing vocational education.
第三十三条 中外合作办学机构的招生简章和广告应当报审批机关备案。 Article 33 The enrollment brochures and advertisements of Chinese-foreign cooperatively-run schools shall be submitted to the examination and approval authorities for the record.
第三十三条国家保障妇女享有与男子平等的人身权利。 Article 33. The state shall guarantee that women enjoy equal rights with men relating to their persons.
第三十四条 中外合作办学机构实施学历教育的，按照国家有关规定颁发学历证书或者其他学业证书； Article 34 Chinese-foreign cooperatively-run schools offering education for academic qualifications shall grant academic qualifications certificates or other education certificates in accordance with the relevant provisions of the State;
第三十四条 国家鼓励金融机构运用信贷手段，扶持发展职业教育。 Article 34 The State encourages financial institutions to support the development of vocational education by providing loans.
第三十四条国家支持和鼓励社会组织或者个人向依法成立的奖励教师的基金组织捐助资金，对教师进行奖励。 Article 34 The State shall encourage and support social organizations and individuals to donate money to foundations established according to law for awarding teachers.
第三十四条妇女的人身自由不受侵犯。禁止非法拘禁和以其他非法手段剥夺或者限制妇女的人身自由；禁止非法搜查妇女的身体。 Article 34. Women's freedom of the person shall be inviolable. Unlawful detention or deprivation or restriction of women's freedom of the person by other illegal means shall be prohibited; and unlawful body search of women shall be prohibited.
第三十五条 学校及其他教育机构中的管理人员，实行教育职员制度。 Article 35 A system of educational administrators shall be applied for administrative personnel of schools and other institutions of education.
第三十五条残疾职工所在单位应当对残疾职工进行岗位技术培训，提高其劳动技能和技术水平。 Article 35 [Training of Employees] Enterprises and institutions where disabled persons work shall provide in-service technical training for disabled employees with a view to upgrading their skills and techniques.
第三十六条 国家依法保护未成年人的智力成果和荣誉权不受侵犯。 Article 36 The State shall protect according to law the intellectual achievements and the right of honour of minors from encroachment.
第三十七条禁止卖淫、嫖猖。 Article 37. Prostitution or whoring shall be prohibited.
第三十八条 中外合作办学机构的收费项目和标准，依照国家有关政府定价的规定确定并公布；未经批准，不得增加项目或者提高标准。 Article 38 The items and standards of charges by Chinese-foreign cooperatively-run schools shall be determined and publicized in accordance with the relevant provisions of the State on price fixing by the government; no additional items or increase in charges shall be allowed without approval.
第三十八条国家和社会采取下列措施，丰富残疾人的精神文化生活： Article 38 [Measures] The state and society shall adopt the following measures to enrich the spiritual and cultural life of disabled persons:
第三十九条 中外合作办学机构收取的费用应当主要用于教育教学活动和改善办学条件。 Article 39 All fees collected by Chinese-foreign cooperatively-run schools shall be mainly used for educational and teaching activities and for improving the conditions of school operation.
第三十九条教师对学校或者其他教育机构侵犯其合法权益的，或者对学校或者其他教育机构作出的处理不服的，可以向教育行政部门提出申诉，教育行政部门应当在接到申诉的三十日内，作出处理。 Article 39 Teachers whose legitimate rights and interests are infringed upon by schools or other institutions of education or who are not satisfied with the settlement made by schools or other institutions of education may appeal to the administrative departments of education. The administrative departments of education shall deal with the matter within 30 days from receipt of the appeal.
第三十九条国家举办的高等学校实行中国*高等学校基层委员会领导下的校长负责制。 Article 39 The state-run institutions of higher learning practice the president responsibility system under the leadership of the grass-roots committees of the Chinese Communist Party in institutions of higher learning.
第三十九条 在职业教育活动中违反教育法规定的，应当依照教育法的有关规定给予处罚。 Article 39 Whoever violates the provisions of the Education Law in vocational education activities shall be punished in accordance with the relevant provisions of the Education Law.
第四条 中外合作办学者、中外合作办学机构的合法权益，受中国法律保护。 Article 4 The legal rights and interests of Chinese and foreign cooperators in running schools and of Chinese-foreign cooperatively-run schools shall be protected by the laws of China.
第四条 保护未成年人的工作，应当遵循下列原则： Article 4 The protection of minors shall follow the following principles:
第四条 国家对回国定居的华侨给予安置。 Article 4 The state shall make arrangements for overseas Chinese who have returned to the country and taken it as their place of permanent residence.
