（一） 因特许人违法经营，被主管登记机关吊销营业执照。    1, a franchiser's business license is cancelled by the competent registration organ because of illegal operation.

（一）出售的各类食品，必须清洁卫生，无毒无害，符合国家和本市有关食品卫生的规定；    1. All food items sold on the fairs must be clean, hygiene, nonpoisonous and unharmful, and conform to the provisions of the State and the Municipality on food hygiene;

（一）未按照规定取得《食品卫生许可证》在集市中生产经营食品的，责令限期改正，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以五百元以上三万元以下的罚款；    1. Anyone who fails to obtain the Food Hygiene License for producing and selling food items on the fairs shall be ordered to correct his mistakes within the specified time limit, have his/her illegal earnings confiscated and pay a fine between one and five times his/her illegal earnings. If he/she has no illegal earnings, he/she shall be ordered to pay a fine of between 500 and 30,000 yuan;

（一）违反本规定第五条第（一）项、第（二）项、第（四）项的，责令限期改正，给予警告，并处以五千元以下的罚款；    1. Anyone who has violated the provisions of Items 1, 2 and 4 of Article 5 of the present Provisions shall be ordered to correct his/her mistakes within the specified time limit, given a disciplinary warning and pay a fine of less than 5,000 yuan;

一、 从2007年5月20日起，对部分钢材产品出口按照《货物出口许可证管理办法》（商务部公告2004年第28号）的有关规定实行出口许可证管理（海关商品编号详见附件）。    1. As from May 20, 2007, export license administration (please refer to appendix for commodity code of the customs) shall be carried out on a part of steels in line with Administrative Measures on Commodity Export License (Announcement No.28, 2004 of Ministry of Commerce).

一、 关于保险价值，目前在立法上没有明确定义。根据全国保险业标准化技术委员会制定的《保险术语》的解释，保险价值是经保险合同当事人约定并记载于保险合同中的保险标的的价值，或保险事故发生时保险标的的实际价值。    1. As regards the term ""insurance value"", at present, there is not any clear definition in any legislation. In accordance with the interpretations on the Insurance Terms formulated by China Insurance Standardization Technical Committee, insurance value means the value of insurance object as stipulated by both parties and indicated in the insurance contract or the actual value of insurance subject matter at the time when the insurance accident occurs.

（二）生产经营禁止生产经营的食品的，责令停止生产经营并销毁该食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款；    2. Anyone who produces and sells the food items that are prohibited from production and selling shall be ordered to stop the production and selling of such food items and to destroy them, have his/her illegal earnings confiscated and pay a fine between one and five times his/her illegal earnings. If he/she has no illegal earnings, he/she shall be ordered to pay a fine of between 1,000 and 50,000 yuan; or

（三） 特许人的法定经营场所地址与联系方式、法定代表人姓名。    3, address and contact of a franchiser's legal business site, the name of the legal representative, and

三、 以估价方式确定保险金额投保的，发生保险事故后，保险价值应当按照发生保险事故时保险标的的实际价值确定。    3. As regards an insurance, the insurance amount of which is determined by way of price appraisement, after an insurance accident occurs, the insurance value shall be decided in accordance with the actual value of insurance object at the time when the insurance accident occurs.

四、 外商独资银行、中外合资银行发行银行卡应当符合中国人民银行制定的银行卡业务、技术标准，满足银行卡联网通用要求。    4. A wholly foreign-funded bank or Chinese-foreign equity joint bank which plans to issue bank cards shall abide by the bank card business and technical standards as formulated by the People's Bank of China and meet the general requirements for the network of bank cards.

五、 外商独资银行、中外合资银行经营银行卡业务，应当参照《银行卡业务管理办法》规定的申请资料向其总行所在地银监局提出申请。    5. A wholly foreign-funded bank or Chinese-foreign equity joint bank which plans to conduct the bank card business shall apply to the branch of the CBRC of the place where its headquarters is located by analogy to the application materials as stipulated in the Measures for the Administration of Bank Card Business.

八、 外商独资银行、中外合资银行获准经营银行卡业务后，应就拟经营的银行卡品种，向所在地中国银监会派出机构报告。    8. A wholly foreign-funded bank or Chinese-foreign equity joint bank shall, after getting the approval to conduct the bank card business, report to the local institution dispatched by the CBRC the types of bank cards which it plans to conduct.

八、 自本公告发布之日起，商务部、海关总署和环保总局2005年第105号公告、2006年第63号公告、第82号公告所列商品目录停止执行，以本公告为准，其它规定继续有效。    8. As from the release of this announcement, Announcement No.105, 2005 of Ministry of Commerce, General Administration of Customs and State Environmental Protection Administration, and Catalogue Prohibited for Processing Trade of Announcement No.63, 2066 and No.82, 2006 are terminated at the same time. Other regulations shall continue to take effect.

（九） 国家法律法规规定经批准方可开展特许经营的产品和服务，须提交相关主管部门的批准文件。    9, As regards the products and services that may not be franchised without approval under the laws and regulations, the franchiser must submit approval documents issued by the competent departments; and

（九） 最近2年的经会计师事务所或审计事务所审计的特许人财务会计报告摘要和审计报告摘要。    9. Abstracts of the franchiser's financial and accounting reports and of the audit reports in the last two years audited by the accounting firms or auditing firms.

实施强制免疫的动物疫病病种名录由国务院畜牧兽医行政管理部门规定并公布。    A catalogue of animal epidemics subjected to compulsory immunization shall be formulated and published by the animal husbandry and veterinary administrative department under the State Council.

凡在境外居住1年以上的中国籍人员，入境时必须向卫生检疫机关申报健康情况，并在入境后1个月内到就近的卫生检疫机关或者县级以上的医院进行健康检查。公安机关凭健康证明办理有关手续，健康证明的副本应当寄送到原入境口岸的卫生检疫机关备案。    A Chinese citizen who has stayed abroad for over one year is, upon reentry, required to fill out health declaration form required by the health and quarantine organ and go to the local health and quarantine organ or to the hospital at or above the county level for physical check-up within one month. The public security organ shall allow him to go through related procedures on the strength of the health certificate. A copy of his health certificate must be sent to the port health and quarantine organ for the record.

承运人明知是烟草专卖品而为无准运证的单位、个人运输的，由烟草专卖行政主管部门没收违法所得，并处罚款。    A consignee who, knowing that the goods to be transported are tobacco monopoly commodities, undertakes the transportation thereof for units or individuals that do not hold transportation permits, shall be confiscated of the illegal income derived therefrom by the department of tobacco monopoly administration, with the concurrent punishment of a fine.

入境、出境的尸体、骸骨的托运人或者其代理人，必须向国境卫生检疫机关申报，经卫生检查合格后发给入境、出境许可证，方准运进或者运出。    A consignor or an agent for the transportation of a corpse or human remains into or out of the country must declare the matter to a frontier health and quarantine office; transport thereof, in either direction across the border, shall not be allowed until sanitary inspection proves satisfactory and an entry or exit permit is given.

烟叶、复烤烟叶的调拨必须签订合同。    A contract must be concluded for any allocation of leaf tobacco or redried leaf tobacco.

前款三类疫病的具体病种名录由国务院畜牧兽医行政管理部门规定并公布。    A detailed catalogue of epidemics of the three classes mentioned in the preceding paragraph shall be fixed and published by the animal husbandry and veterinary administrative department under the State Council.

加工贸易企业应按规定在当地劳动保障部门办理劳动用工备案手续，注重工人福利，遵守当地关于最低工资标准和缴纳社会保险的有关规定。    A processing trade enterprise shall go through employment registration formalities as required at the local labor security department, care for workers' welfare and respect the related local provisions on minimum wage level and social insurances payment.

加工贸易企业的二氧化硫（SO2）、化学需氧量（cod）等主要排放指标应达到环保部门要求，单位生产总值综合能耗应不高于当地平均水平。    A processing trade enterprise's major discharge indices such as sulfur dioxide (SO2) index, chemical oxygen demand (COD) index, etc., shall reach the requirements of the environmental protection departments, and its comprehensive energy consumption for gross unit output value may not be higher than the local average level.

生产者能够证明有下列情形之一的，不承担赔偿责任：    A producer shall not be liable for compensation if he can prove the existence of any of the following circumstances:商业特许经营备案管理办法    Administrative Measures for Archiving Commercial Franchises

销售者依照前款规定负责修理、更换、退货、赔偿损失后，属于生产者的责任或者属于向销售者提供产品的其他销售者（以下简称供货者）的责任的，销售者有权向生产者、供货者追偿。    After repair, change, refund or compensation has been made according to the provisions of the preceding paragraph, if the liability is attributed to the producer or to another seller who has supplied the product (hereinafter referred to as supplier), the seller shall have the right to recover his losses from the producer or the supplier.

各银监局：    All branches of China Banking Regulatory Commission,

请各有关银监局速将本通知转发至辖内银监分局以及外资银行营业性机构。    All related branches of the CBRC should promptly transmit the present Circular to your sub-branches and the foreign-funded institutions of foreign-funded banks under your respective jurisdiction.

生产出口危险货物的企业，必须申请商检机构进行包装容器的使用鉴定。使用未经鉴定合格的包装容器的危险货物，不准出口。    An enterprise producing dangerous export goods must apply to the same authorities for a test of the use of packagings. No permission shall be granted for the export of dangerous goods kept in packagings which have not passed a test.

烟草制品生产企业可以根据市场销售情况，在该企业的年度总产量计划的范围内，对分等级、分种类的卷烟产量指标适当调整。    An enterprise producing tobacco products may, in light of the marketing conditions, make appropriate adjustments to the cigarette output targets with grading and classification specifications, within the scope of the total annual production plans of the enterprise.

（四）监督和检查垃圾、废物、污水、粪便、压舱水的处理。    and (4) supervise and inspect the disposal of garbage, waste matter, sewage,excrement and ballast water.

中华人民共和国动物防疫法    Animal Epidemic Prevention Law of the People’s Republic of China

乡、民族乡、镇的动物防疫组织应当在动物防疫监督机构的指导下，组织做好动物疫病预防工作。    Animal epidemic prevention organs in townships, nationality townships and towns shall, under the guidance of the supervising agencies for animal epidemic prevention, organize the prevention of animal epidemics.

动物产品凭检疫证明、验讫标志出售和运输。    Animal products can be sold or transported on the strength of the quarantine certificate and the inspection mark.

染疫动物及其排泄物、染疫动物的产品、病死或者死因不明的动物尸体，必须按照国务院畜牧兽医行政管理部门的有关规定处理，不得随意处置。    Animals infected with epidemic diseases and their excrement, products made from animals infected with epidemic diseases, and carcasses of animals which died of illness or died due to an unidentified cause must be disposed of according to the relevant provisions of the animal husbandry and veterinary administrative department under the State Council and shall not be dealt with at will.

对未售出的动物、动物产品，依法补检，并依照本法第三十八条的规定办理。    Animals or animal products having not yet been sold shall undergo quarantine inspection retrospectively according to law and be dealt with according to the provisions of Article 38 of this Law.

承运人必须凭检疫证明方可承运。    Any consignee must undertake the shipment on the strength of the quarantine certificate.

入境、出境的交通工具有下列情形之一的，应当由卫生检疫机关实施消毒、除鼠、除虫或者其他卫生处理。    Any conveyance waiting for entry or exit is subject to disinfectization, deratization, deinsectization and other necessary sanitization when found to be in any one of the following conditions:

买卖本法规定的烟草专卖生产企业许可证、烟草专卖经营许可证等许可证件和准运证的，比照刑法第一百一十七条的规定追究刑事责任。    Any enterprise or individual that purchases or sells the licenses prescribed in this Law such as those for tobacco monopoly production enterprises, tobacco monopoly business, as well as transportation permits, shall be investigated for criminal responsibility by applying mutatis mutandis the provisions of Article 117 of the Criminal Law.

持有特种烟草专卖经营企业许可证的企业，必须按照国务院烟草专卖行政主管部门的规定，向国务院烟草专卖行政主管部门报送进货、销售、库存的计划和报表。    Any enterprise with a special license for the tobacco monopoly operation enterprise must, in accordance with the relevant regulations of the department of tobacco monopoly administration under the State Council, submit to the department the plans and statements about its purchases, sales and stock.

烟叶收购合同应当约定烟叶种植面积。    Any leaf tobacco purchasing contract shall specify the agreed area for leaf tobacco plantation.

对违反本法的行为，任何人都有权检举和控告。    Any person shall have the right to inform the authorities and lodge a complaint about any violation of this Law.

从事动物疫病科学研究的单位应当按照国家有关规定，对实验动物严格管理，防止动物疫病传播。    Any unit engaging in scientific research on animal epidemics shall, according to the relevant state provisions, conduct strict management of experimental animals in order to prevent the spread of animal epidemics.

伪造检疫证明的，并处一万元以上三万元以下的罚款，违法所得超过三万元的，并处违法所得一倍以上三倍以下的罚款；构成犯罪的，依法追究刑事责任。    Anyone who forges the quarantine certificate shall be fined not less than RMB 10,000 yuan and not more than RMB 30,000 yuan; if the illegal gains exceed RMB 30,000 yuan, the offender shall be concurrently fined not less than the amount of the illegal gains and not more than three times of that amount. If a crime has been constituted, the offender shall be investigated for criminal responsibility according to law.

违反本法第十七条的规定，对经商检机构抽查检验不合格的出口商品擅自出口的，依照前款的规定处罚。    Anyone who, in violation of the provisions of Article 17 of this Law, purposely exports export commodities which have been found? substandard during a random inspection by the commodity inspection authorities, shall be punished in accordance with the provisions of the preceding paragraph.

违反本规定行为给他人造成损害的，应当依法承担民事赔偿责任。    Anyone whose doing has violated the provisions of these provisions and has cause damage to other people shall be held liable for civil damages.

如果外国交通工具的负责人拒绝接受卫生处理，除有特殊情况外，准许该交通工具在国境卫生检疫机关的监督下，立即离开中华人民共和国国境。    Apart from exceptional cases, when the person in charge of the foreign conveyance refuses to allow sanitation measures to be taken, the conveyance shall be allowed to leave the frontier of the People's Republic of China without delay under the supervision of the frontier health and quarantine office.附件：加工贸易禁止进出口商品目录    Appendix: Catalogue Prohibited for Processing Trade

农药、化肥等农用化学物质的安全性评价，必须经国务院卫生行政部门审查同意。    Appraisals on the safety for use of agricultural chemicals, such as pesticides and chemical fertilizers, shall be examined and approved by the administrative department of public health under the State Council.

第一条 为规范食品流通秩序，加强食品流通的行业管理，规范食品经营行为，保障食品消费安全，根据国家有关法律、法规，制定本办法。    Article 1 For purposes of regulating food safety in circulating field, enhancing industrial administration on food circulation, ruling food operation and safeguarding security of food consumption, these Measures are formulated in accordance with relevant state laws and regulations.

第一条 为加强对商业特许经营活动的管理，规范特许经营市场秩序，根据《商业特许经营管理条例》（以下简称《条例》）的有关规定，制定本办法。    Article 1 For the purpose of intensifying administration on commercial franchises, regulating market order of franchises, these Measures are formulated according to the relevant provisions in Regulations on Administering Commercial Franchises (hereinafter referred to as the Regulations).

第一条 为维护特许人与被特许人双方的合法权益，根据《商业特许经营管理条例》（以下简称《条例》）的有关规定，制定本办法。    Article 1 For the purpose of safeguarding the legitimate rights and interests of franchisers and franchisees, these Measure are formulated under the Regulations for the Administration of Commercial Franchises (hereinafter referred to as the Regulations)

第一条 为了加强本市城乡集市贸易的食品卫生管理，保证食品卫生，保障人民身体健康，根据《中华人民共和国食品卫生法》和国务院发布的《城乡集市贸易管理办法》，结合本市具体情况，制定本规定。    Article 1 The present Provisions are formulated in accordance with the ""Food Hygiene Law of the people's Republic of China"" and the ""Procedures on the Administration of Urban and Rural Fairs"" promulgated by the State Council, and in the light of the actual situation in Shanghai with a view to strengthening the control of hygiene of the food sold on the urban and rural fairs in this municipality, ensuring food hygiene, and protecting the health of the people.

第一条 根据《中华人民共和国国境卫生检疫法》(以下称《国境卫生检疫法》)的规定，制定本细则。    Article 1 These Implementation Rules are formulated in accordance with the Frontier Health and Quarantine Law of the People's Republic of China (hereinafter referred to as ""the Frontier Health and Quarantine Law).

第一条 为保证食品卫生，防止食品污染和有害因素对人体的危害，保障人民身体健康，增强人民体制，制定本法。    Article 1 This Law is enacted for the purpose of ensuring food hygiene, preventing food contamination and harmful substances from injuring human health, safeguarding the health of the people and improving their physical fitness.

第一条为了加强对动物防疫工作的管理，预防、控制和扑灭动物疫病，促进养殖业发展，保护人体健康，制定本法。    Article 1 This Law is enacted for the purpose of intensifying the administration of animal epidemic prevention, preventing, bringing under control and exterminating animal epidemics, promoting the development of livestock, fish breeding and poultry raising and protecting human health.

第一条 为了加强对产品质量的监督管理，明确产品质量责任，保护用户、消费者的合法权益，维护社会经济秩序，制定本法。    Article 1 This Law is enacted to strengthen the supervision and control over product quality, to define the liability for product quality, to protect the legitimate rights and interests of users and consumers and to safeguard the socio-economic order.

第一条 为实行烟草专卖管理，有计划地组织烟草专卖品的生产和经营，提高烟草制品质量，维护消费者利益，保证国家财政收入制定本法。    Article 1 This Law is enacted with a view to exercising tobacco monopoly administration, organizing the production and management of tobacco monopoly commodities in a planned way, improving the quality of tobacco products, safeguarding consumers' interests and ensuring the national revenue.

第一条 为了加强进出口商品检验工作，保证进出口商品的质量，维护对外贸易有关各方的合法权益，促进对外经济贸易关系的顺利发展，制定本法。    Article 1 This Law is enacted with a view to strengthening the inspection of import and export commodities, ensuring the quality of import and export commodities, protecting the lawful rights and interests of the parties involved in foreign trade, and promoting the smooth development of China's economic and trade relations with foreign countries.

第一条为防止动物传染病、寄生虫病和植物危险性病、虫、杂草以及其他有害生物(以下简称病虫害)传入、传出国境，保护农、林、牧，渔业生产和人体健康，促进对外经济贸易的发展，制定本法。    Article 1 This Law is formulated for the purpose of preventing infectious or parasitic diseases of animals, diseases, insect pests and weeds dangerous to plants, and other harmful organisms (hereinafter referred to, for short, as diseases, insect pests and harmful organisms) from spreading into or out of the country, protecting the production of agriculture, forestry, animal husbandry and fishery as well as human health, and promoting the development of foreign economic relations and trade.

第一条 为了防止传染病由国外传入或者由国内传出，实施国境卫生检疫，保护人体健康，制定本法。    Article 1 This Law is formulated in order to prevent infectious diseases from spreading into or out of the country, to carry out frontier health and quarantine inspection and to protect human health.

第十条 烟叶由烟草公司或者其委托单位按照国家规定的收购标准、价格统一收购，其他单位和个人不得收购。    Article 10 A unified purchase of leaf tobacco shall be effected by tobacco companies or their authorized agencies in accordance with the standards and prices set by the State. No other organizations or individuals may effect any leaf tobacco purchase.

第十条 备案机关应当自收到特许人提交的符合本办法第五条规定的文件、资料之日起10日内予以备案，并在商务部网站予以公告。    Article 10 An archiving organ shall archive the files and materials complying with the provision in Article 5 within 10 days from the date a franchiser submit them, and shall issue an announcement on the website of the Ministry of Commerce.

第十条 商务主管部门应当建立市场巡查制度，对市场食品安全管理制度的建立和实施情况进行监督检查。    Article 10 Departments of commercial administration shall establish market inspection system, inspecting and supervising establishment of food safety management system and implementing status.

第十条 食品不得加入药物，但是按照传统既是食品又是药品的以及作为原料、调料或者营养强化剂加入的除外。    Article 10 Food must not contain medicinal substances, with the exception of those materials that have traditionally served as both food and medicaments and are used as raw materials, condiments or nutrition fortifiers.

第十条 本法规定必须经商检机构检验的进口商品的收货人，应当在商检机构规定的地点和期限内，向商检机构报验。    Article 10 For import commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignee shall apply to the same authorities for inspection in places and within the time limit specified by them.

第十条 特许人违反本办法规定的，被特许人有权向商务主管部门举报，经查实的，由商务主管部门责令改正，处1万元以上5万元以下的罚款；情节严重的，处5万元以上10万元以下的罚款，并予以公告。    Article 10 If the franchiser violates these Measures, the franchisee has the right to report to the commerce authority, if the case is confirmed after investigation, the commerce authority shall order the franchiser to make rectification, and impose a fine no less than RMB 10, 000 but no more than RMB 50,000; if the circumstances are serious, the fine shall be no less than RMB 50, 000 but no more than RMB 10, 000, and a public announcement shall be made.

第十条根据动物疫病对养殖业生产和人体健康的危害程度，本法规定管理的动物疫病分为下列三类：    Article 10 In the light of seriousness of damage caused by animal epidemics to the breeding production and human health, animal epidemics under the control by this Law are composed of three classes:?

第十条 有下列行为的，由卫生行政部门按照下列规定处罚：    Article 10 The public health administrative departments shall punish the following acts according to the following stipulations:

第十条 国家对产品质量实行以抽查为主要方式的监督检查制度，对可能危及人体健康和人身、财产安全的产品，影响国计民生的重要工业产品以及用户、消费者、有关组织反映有质量问题的产品进行抽查。监督抽查工作由国务院产品质量监督管理部门规划和组织。    Article 10 The State shall, with respect to product quality, enforce a upervision and inspection system with random checking as its main form. Products constituting possible threats to the health or safety of human life and property, important industrial products which have a bearing on the national economy and the people's livelihood, and products with quality problems as reported by users, consumers or relevant organizations shall be subjected to random checking. such supervision and random checking shall be planned and organized by the department in charge of supervision and control over product quality under the State Council.

第十条 入境、出境的集装箱，货物，废旧物等物品在到达口岸的时候，承运人、代理人或者货主，必须向卫生检疫机关申报并接受卫生检疫；    Article 10 Upon the arrival of containers, goods, or discarded used materials at the port ready for shipping in or out, the shipper, the carrier's agent or the consignor is required to report to the health and quarantine organ for inspection.第十条 在国境口岸发现检疫传染病、疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明的，国境口岸有关单位和交通工具的负责人，应当立即向国境卫生检疫机关报告，并申请临时检疫。    Article 10 When a quarantinable infectious disease, a disease suspected to be quarantinable or a death due to an unidentified cause other than accidental harm is discovered at a frontier port, the relevant department at the frontier port and the person in charge of the conveyance must report immediately to the frontier health and quarantine office and apply for provisional quarantine inspection.

第十条输入动物、动物产品、植物种子、种苗等其他繁殖材料的，必须事先提出申请，办理检疫审批手续。    Article 10 Whoever imports animals, animal products, plant seeds, seedlings or other propagating materials must submit an application in advance and go through the formalities for examination and approval of quarantine inspection.

第一百条 受入境、出境检疫的人员，必须根据检疫医师的要求，如实填报健康申明卡，出示某种有效的传染病预防接种证书、健康证明或者其他有关证件。    Article 100 The people subject to entry or exit quarantine inspection are required to fill out health card as required by the quarantine physician, to present a valid certificate of inoculation against epidemic diseases, bill of health or other related certificate.

第一百零一条 卫生检疫机关对国境口岸的涉外宾馆、饭店内居住的入境、出境人员及工作人员实施传染病监测，并区别情况采取必要的预防，控制措施。    Article 101 The health and quarantine organ shall exercise quarantine monitoring among the incoming or outcoming passengers staying at the hotels at the frontier port as well as the hotel workers and will either take precautionary measures or control measures according to circumstances.

第一百零二条 凡申请出境居住1年以上的中国籍人员，必须持有卫生检疫机关签发的健康证明。中国公民出境、入境管理机关凭卫生检疫机关签发的健康证明办理出境手续。    Article 102 Chinese citizens who apply to stay abroad for over one year are required to carry health certificates issued by the health and quarantine organ. The exit and entry organ for Chinese citizens shall process such an application only if it includes a health certificate issued by the health and quarantine organ.

第一百零三条 卫生检疫机关在国境口岸内设立传染病监测点时，有关单位应当给予协助并提供方便。    Article 103 When the health and quarantine organ sets up a monitoring post for epidemic diseases at the border port, the units concerned are required to offer conveniences.

第一百零四条 卫生检疫机关依照《国境卫生检疫法》第十八条、第十九条规定的内容，对国境口岸和交通工具实施卫生监督。    Article 104 The health and quarantine organ shall exercise health supervision over the sanitary conditions at frontier ports and the sanitary conditions of conveyances according to the requirements stipulated in Articles 18 and 19 of the Frontier Health and Quarantine Law.

第一百零九条 《国境卫生检疫法》和本细则所规定的应当受行政处罚的行为是指：    Article 109 Acts that are subject to administrative sanction as defined in the ""Frontier Health and Quarantine Law"" and these Implementation Rules refer to the following:

第十一条 国境卫生检疫机关依据检疫医师提供的检疫结果，对未染有检疫传染病或者已实施卫生处理的交通工具，签发入境检疫证或者出境检疫证。    Article 11 According to the results of an inspection made by quarantine doctors, the frontier health and quarantine office shall sign and issue a quarantine certificate for entry or exit to a conveyance either uncontaminated by any quarantinable infectious disease or already given decontamination treatment.

第十一条 商务主管部门应当加强流通领域食品安全信用档案管理，完善食品安全的市场信用监督和失信惩戒机制。    Article 11 Departments of commercial administration shall enhance management on credit files of food safety in circulating field, and improve market credit supervision and penalty mechanism of loosing credit.

第十一条 已完成备案的特许人有下列行为之一的，备案机关可以撤销备案，并在商务部网站予以公告：    Article 11 If a franchiser who has finished archival filing has one of the following practices, the archiving organ may cancel the archival filing, and issue an announcement on the website of the Ministry of Commerce:

第十一条 本法规定必须经商检机构检验的进口商品以外的进口商品的收货人，发现进口商品质量不合格或者残损短缺，需要由商检机构出证索赔的，应当向商检机构申请检验出证。    Article 11 If import commodities other than those which are subject to inspection by the commodity inspection authorities in accordance with this Law are found to be not up to the quality standard, damaged or short on weight or quantity, the consignee shall apply to the commodity inspection authorities for inspection and the issuance of an inspection certificate if such a certificate is necessary for claiming compensation.

第十一条 工商行政管理部门和卫生行政部门作出行政处罚，应当出具行政处罚决定书。    Article 11 On imposing an administrative punishment, the industrial and commercial administrative departments and the public health administrative department shall issue a decision notice of an administrative punishment.

第十一条 产品质量检验机构必须具备相应的检测条件和能力，经省级以上人民政府产品质量监督管理部门或者其授权的部门考核合格后，方可承担产品质量的检验工作。法律、行政法规对产品质量检验机构另有规定的，依照有关的法律、行政法规的规定执行。    Article 11 Product quality inspection institutions must have appropriate testing facilities and capabilities, and shall undertake the work of inspection of product quality only after being examined and verified by a department in charge of supervisions and control over product quality under the people’s government at or above the provincial level or an organization authorized by the department. Where the laws, administrative rules and regulations provide otherwise with respect to the product quality inspection institutions, the provisions of such laws, rules and regulations shall apply.

第十一条 入境、出境的微生物、人体组织、生物制品、血液及其制品等特殊物品的携带人、托运人或者邮递人，必须向卫生检疫机关申报并接受卫生检疫，未经卫生检疫机关许可，不准入境、出境。    Article 11 Special articles which enter or leave the country such as microzoaria, human tissue, biological, blood and hemoproducts shall be subject to health and quarantine inspection. The carrier, the shipper or the parcel sender of the above mentioned articles is required to declare at the health and quarantine organ for inspection. Without permission by the health and quarantine organ, there shall be no entry or exit of such articles.

第十一条国务院畜牧兽医行政管理部门应当制定国家动物疫病预防规划。    Article 11 The animal husbandry and veterinary administrative department under the State Council shall formulate the national plan for animal epidemic prevention.

第十一条 省、自治区、直辖市之间的烟叶、复烤烟叶的调拨计划由国务院计划部门下达，省、自治区、直辖市辖区内的烟叶、复烤烟叶的调拨计划由省、自治区、直辖市计划部门下达，其他单位和个人不得变更。    Article 11 The plans for allocating leaf tobacco and redried leaf tobacco among the provinces, autonomous regions and municipalities directly under the Central Government shall be assigned by the planning department under the State Council; the plans for allocating leaf tobacco and redried leaf tobacco within areas under the jurisdiction of each province, autonomous region or municipality directly under the Central Government shall be assigned by the planning department of the relevant province, autonomous region or municipality directly under the Central Government. No other organizations or individuals may make any modifications thereto.

第十一条 本办法由中华人民共和国商务部负责解释。    Article 11 The power to interpret these Measures shall remain with the Ministry of Commerce.

第十一条 生产经营和使用食品添加剂、必须符合食品添加剂使用卫生标准和卫生管理办法的规定；不符合卫生标准和卫生管理办法的食品添加剂，不得经营、使用。    Article 11 The production, marketing and use of food additives must conform to the hygiene standards for use of food additives and the hygiene control regulations; the food additives that do not conform to the hygiene standards and the hygiene control regulations may not be marketed and used.

第十一条通过贸易、科技合作、交换、赠送、援助等方式输入动植物、动植物产品和其他检疫物的，应当在合同或者协议中订明中国法定的检疫要求，并订明必须附有输出国家或者地区政府动植物检疫机关出具的检疫证书。    Article 11 Whoever imports animals and plants, their products or other quarantine objects through trade, scientific and technological cooperation, exchanges, donations or aid shall specify in the contracts or agreements the requirements for quarantine inspection prescribed by China's law and the necessity of quarantine certificates issued by the animal and plant quarantine department under the government of the exporting country or region being appended therewith.

第一百一十条 具有本细则第一百零九条所列第(一)至第(五)项行为的，处以警告或者100元以上5000元以下的罚款；    Article 110 Those who violate any one of Items 1 to 5 listed in Article 109 shall get a warning or a fine ranging from RMB 100 yuan to RMB 5,000 yuan;第一百一十一条 卫生检疫机关在收取罚款时，应当出具正式的罚款收据。罚款全部上交国库。    Article 111 When imposing penalties, the health and quarantine organ must write out an official fine receipt. All fines thus collected shall be turned over to the state treasure.

第一百一十二条 国境卫生检疫机关实施卫生检疫的收费标准，由国务院卫生行政部门会同国务院财政、物价部门共同制定。    Article 112 The standard fee for health and quarantine inspection charged by the frontier health and quarantine organ shall be set jointly by the health administrative department, the financial department and the administration for commodity prices under the State Council of the People's Republic of China.

第一百一十三条 本细则由国务院卫生行政部门负责解释。    Article 113 The right to interpret these Implementation Rules resides in the health administrative department under the State Council of the People's Republic of China.

第一百一十四条 本细则自发布之日起施行。    Article 114 These Implementation Rules shall go into effect as of the date of promulgation.

第十二条 国境卫生检疫机关对检疫传染病染疫人必须立即将其隔离，隔离期限根据医学检查结果确定；对检疫传染病染疫嫌疑人应当将其留验，留验期限根据该传染病的潜伏期确定。    Article 12 A person having a quarantinable infectious disease shall be placed in isolation by the frontier health and quarantine office for a period determined by the results of the medical examination, while a person suspected of having a quarantinable infectious disease shall be kept for inspection for a period determined by the incubation period of such disease.

第十二条 各省、自治区、直辖市人民政府商务主管部门应当将备案及撤销备案的情况在10日内反馈商务部。    Article 12 All competent commercial departments at provincial, autonomous region, municipality directly under the Central Government levels shall provide feedback on archival filing and cancellation of archival filing to the Ministry of Commerce within 10 days.

第十二条 食品容器、包装材料和食品用工具、设备必须符合卫生卫生标准和管理办法的规定。    Article 12 Containers, packagings, utensils and equipment used for food must conform to the hygiene standards and the hygiene control regulations.

第十二条 商务主管部门应当与食品流通行业中介组织建立沟通协作机制，充分发挥行业组织的自律作用。    Article 12 Departments of commercial administration shall set up coordination and cooperation mechanism with intermediary agent organizations of food circulating industries, and let the industrial organizations play role of self discipline.

第十二条 对重要的进口商品和大型的成套设备，收货人应当依据对外贸易合同约定在出口国装运前进行预检验、监造或者监装，主官部门应当加强监督；    Article 12 For important import commodities and a complete set of equipment in large size, the consignee shall, in accordance with the terms agreed upon in a foreign trade contract, conduct initial inspection or initial supervision over manufacturing or loading in the exporting country before shipment, while the relevant competent departments shall strengthen their supervision.

第十二条 入境、出境的旅客、员工个人携带或者托运可能传播传染病的行李和物品，应当接受卫生检查。卫生检疫机关对来自疫区或者被传染病污染的各种食品、饮料、水产品等应当实施卫生处理或者销毁，并签发卫生处理证明。    Article 12 Luggage and other articles carried along by incoming or outgoing passengers or staff members or by means of registered shipment that may spread quarantinable epidemic diseases, are required to undergo hygienic examination. The health and quarantine organ shall exercise sanitization or destruction of the foods, drinks and aquatic products that come from the pestilence area or have been contaminated with epidemic diseases and issue a sanitization certificate.

第十二条 开办烟草制品生产企业，必须经国务院烟草专卖主管部门批准，取得烟草专卖生产企业许可证，并经工商行政管理部门核准登记；其分立、合并、撤销，必须经国务院烟草专行政主管部门批准，并向工商行政管理部门办理变更、注销登记手续。    Article 12 The establishment of an enterprise producing tobacco products shall be subject to the approval of the department of tobacco monopoly administration under the State Council and the acquisition of a license for the tobacco monopoly production enterprise, and then to the registration upon its examination and approval by the administrative department for industry and commerce; the split-up, merger or dissolution of an enterprise producing tobacco products shall be subject to the approval of the department of tobacco monopoly administration under the State Council and go through formalities for the change and cancellation of the registration with the administrative department for industry and commerce.

第十二条货主或者其代理人应当在动植物、动植物产品和其他检疫物进境前或者进境时持输出国家或者地区的检疫证书、贸易合同等单证，向进境口岸动植物检疫机关报检。    Article 12 The owner or his or her agent shall apply to the port animal and plant quarantine office at the port of entry for quarantine inspection of the animals and plants, their products or other quarantine objects, before or on their entry, on the strength of documents such as the quarantine certificates issued by the exporting country or region and the trade contracts.

第十二条国家应当采取措施预防和扑灭严重危害养殖业生产和人体健康的动物疫病。    Article 12 The state should take measures to prevent and exterminate animal epidemics which cause serious damage to the breeding production and human health.

第十二条 在集市生产经营食品的单位或者个人，应当接受工商行政管理人员和食品卫生监督员的管理。    Article 12 The units or individual persons that produce and sell food items on the fairs shall accept the supervision of the industrial and commercial administrative personnel and the food hygiene supervisors.

第十二条 本办法自2007年5月1日起实施。    Article 12 These Measures shall come into effect as of May 1 2007.

第十二条 用户、消费者有权就产品质量问题，向产品的生产者、销售者查询；向产品质量监督管理部门、工商行政管理部门及有关部门申诉，有关部门应当负责处理。    Article 12 Users and consumers shall have the right to make inquiries to the producers and sellers about the quality of their products. Where a complaint is made to a department in charge of supervision and control over product quality or to an administrative department for industry and commerce or to any other department concerned, such department shall be responsible for the handling thereof.

第十三条 接受入境检疫的交通工具有下列情形之一的，应当实施消毒、除鼠、除虫或者其他卫生处理：    Article 13 Any conveyance subject to entry quarantine inspection shall be disinfected, deratted, treated with insecticides or given other sanitation measures when found to be in any of the following conditions:

第十三条 烟草制品生产企业为扩大生产能力进行基本建设或者技术改造，必须经国务院烟草专卖行政主管部门批准。    Article 13 Capital construction or technological innovation to be conducted by an enterprise producing tobacco products for expanding production capacity shall be subject to the approval by the department of tobacco monopoly administration under the State Council.

第十三条 本法规定必须经商检机构检验的出口商品的发货人，应当在商检机构规定的地点和期限内，向商检机构报验。商检机构应当在不延误装运的期限内检验完毕，并出具证明。    Article 13 For export commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignor shall apply to the same authorities for inspection in the places and within the time limit specified by them. The commodity inspection authorities shall accomplish the procedures for inspection and issue a certificate without delaying the prescribed time for shipment.

第十三条 鼓励新闻媒体对违反本办法规定的行为进行舆论监督。    Article 13 News agencies are encouraged to carry out supervision of public opinion on those against these Measures.

第十三条装载动物的运输工具抵达口岸时，口岸动植物检疫机关应当采取现场预防措施，对上下运输工具或者接近动物的人员、装载动物的运输工具和被污染的场地作防疫消毒处理。    Article 13 On arrival at a port of a means of transport for carrying animals, the port animal and plant quarantine office shall for the prevention of epidemics adopt on-the-spot preventive measures and conduct disinfection of persons embarking on or disembarking from the means of transport or having contracts with the animals, the means of transport for carrying the animals and the contaminated fields.

第十三条 保护消费者权益的社会组织可以就消费者反映的产品质量问题建议有关部门负责处理，支持消费者对因产品质量造成的损害向人民法院起诉。    Article 13 Social organizations responsible for the protection of the rights and interests of consumers may, with respect to matters concerning product quality as reported by consumers, suggest to the departments concerned that they handle the matters, and may support consumers in bringing a suit to a people's court for the damage caused by quality problems of products.

第十三条 工商行政管理人员和食品卫生监督员执行任务时，应当向当事人出示执法身分证件。    Article 13 The industrial and commercial administrative personnel and the food hygiene supervisors shall produce their law enforcement identification cards during the performance of official duties.

第十三条食品容器、包装材料和食品用工具、设备的生产必须采用符合卫生要求的原材料。产品应当便于清洗和消毒。    Article 13 The raw materials for making containers, packagings, utensils and equipment used for food must meet hygiene requirements. The finished products should be easy to clean and disinfect.

第十三条动物防疫监督机构应当加强对动物疫病预防的宣传教育和技术指导、技术培训、咨询服务，并组织实施动物疫病免疫计划。    Article 13 The supervising agencies for animal epidemic prevention shall strengthen animal epidemic prevention by conducting popularization and education, technical advice, technical training and consultancy services and shall organize the implementation of plans for immunization against animal epidemics.第十三条 卫生检疫机关对应当实施卫生检疫的邮包进行卫生检查和必要的卫生处理时，邮政部门应予配合。未经卫生检疫机关许可，邮政部门不得运递。    Article 13 When the health and quarantine organ conducts health examination and sanitization of the registered parcels, the postal unit is required to offer cooperation. Without permission by the health and quarantine organ, the postal unit may not ship the parcels.

第十三条 备案机关在完成备案手续的同时，应当完整准确地记录和保存特许人的备案信息材料，依法为特许人保守商业秘密。    Article 13 While the archiving organ finishes the archival procedures, it shall archive file and keep the documents on a franchiser's archival filing, and keep commercial secrets for the franchiser according to law.

第十四条 国境卫生检疫机关对来自疫区的、被检疫传染病污染的或者可能成为检疫传染病传播媒介的行李、货物、邮包等物品，应当进行卫生检查，实施消毒、除鼠、除虫或者其他卫生处理。    Article 14 A frontier health and quarantine office shall conduct sanitation inspections and disinfect, derate, treat with insecticides or apply other sanitation measures to articles such as baggage, goods and postal parcels that come from an epidemic area and are contaminated by a quarantinable infectious disease or may act as a vehicle of a quarantinable infectious disease.

第十四条 经商检机构检验合格发给检验证书或者放行单的出口商品，应当在商检机构规定的期限内报运出口；超过期限的，应当重新报验。    Article 14 Export commodities which have been inspected and passed by the commodity inspection authorities and for which an inspection certificate or a paper for release has been issued by the same authorities shall be declared for export and shipped out of the country within the time limit specified by the same authorities. Failing to meet the time limit shall entail reapplication for inspection.

第十四条输入动植物、动植物产品和其他检疫物，应当在进境口岸实施检疫。    Article 14 Import animals and plants, their products and other quarantine objects shall be quarantined at the port of entry;

第十四条 生产者应当对其生产的产品质量负责。产品质量应当符合下列要求：    Article 14 Producers shall be liable for the quality of the products they produce.The products shall meet the following quality requirements:

第十四条 食品，食品添加剂，食品容器，包装材料，食品用工具、设备，用于清洗食品和食品用工具、设备的洗涤剂、消毒剂以及食品中污染物质、放射性物质容许量的国家卫生标准、卫生管理办法和检验规程，由国务院卫生行政部门制定或者批准颁发。    Article 14 The administrative department of public health under the State Council shall formulate or approve and promulgate the national hygiene standards, hygiene control regulations and inspection procedures for food, food additives, the containers, packagings, utensils and equipment used for food, the detergents and disinfectants used for washing food or utensils and equipment used for food, and the tolerances for contaminants and radioactive substances in food.

第十四条 食品卫生监督员可以按照规定无偿采取适量的食品样品用于检验。采取食品样品时，应当开具收据。    Article 14 The food hygiene supervisors may take an appropriate amount of sample food items free of charge for inspection and testing according to law. A receipt shall be issued when a sample food item is taken.

第十四条 卫生检疫单、证的种类、式样和签发办法，由国务院卫生行政部门规定。    Article 14 The health administrative department under the State Council is the organ of authority for making the various kinds of health and quarantine forms, certificates as well as for their issuance.

第十四条 省、自治区、直辖市的卷烟、雪茄烟年度总产量计划由国务院计划部门下达。烟草制品生产企业的卷 烟、雪茄烟年度总产量计划，由省级烟草专卖行政主管部门根据国务院计划部门下达的计划，结合市场销售情况下达，地方人民政府不得向烟草制品生产企业下达超产任务。烟草制品生产企业根据市场销售情况，需要超过年度总产量计划生产卷烟、雪茄烟，必须经国务院烟草专卖行政主管部门批准。    Article 14 The total annual production plans for cigarettes and cigars of the provinces, autonomous regions and municipalities directly under the Central Government shall be assigned by the planning department under the State Council. The total annual production plans for cigarettes and cigars of an enterprise producing tobacco products shall be assigned by the department of tobacco monopoly administration at the provincial level on the basis of the plans assigned by the planning department under the State Council and in light of the marketing conditions. Local people's governments shall not assign additional production quotas to an enterprise producing tobacco products. If an enterprise producing tobacco products, in light of the marketing conditions, finds it necessary to manufacture cigarettes and cigars exceeding the total annual production plans, it must obtain the approval of the department of tobacco monopoly administration under the State Council.

第十四条饲养、经营动物和生产、经营动物产品的单位和个人，应当依照本法和国家有关规定做好动物疫病的计划免疫、预防工作，并接受动物防疫监督机构的监测、监督。    Article 14 Units and individuals that engage in raising or marketing of animals, or production or marketing of animal products shall, pursuant to this Law and the relevant state provisions, complete planned immunization against and prevention of animal epidemics, and shall accept the monitoring and supervision from the supervising agencies for animal epidemic prevention.

第十四条 市场违反本办法第六条、第七条、第八条第二款规定的，由商务主管部门予以警告，责令限期改正。逾期不改正的，可处1000元以上5000元以下罚款；情节严重的，可处5000元以上3万元以下罚款，并可向社会公告。    Article 14 Where markets are in violation of Articles 6 and 7 and Item (2) of Article 8 of these Measures, departments of commercial administration shall warn and order them to correct in time limit. Those fail to do so shall be fined 1000 to 5000 yuan; where the circumstance is serious, they shall be fined 5000 to 30, 000 yuan and announced to the public.

第十五条 产品或者其包装上的标识应当符合下列要求：    Article 15 All marks on the products or the packages thereof shall meet the following requirements:

第十五条 为出口危险货物生产包装容器的企业，必须申请商检机构进行包装容器的性能鉴定。    Article 15 An enterprise manufacturing packagings for dangerous export goods must apply to the commodity inspection authorities for a test of the performance of such packagings.

第十五条动物饲养场应当及时扑灭动物疫病。种畜、种禽应当达到国家规定的健康合格标准。    Article 15 Any animal farm should exterminate animal epidemics in time. Stud stock and breeding poultry shall be kept healthy up to the standards set by the state.

第十五条 经营烟草制品批发业务的企业，必须经国务院烟草专卖行政主管部门或者省级烟草专行政主管部门批准，取得烟草专卖批发企业许可证，并经工商行政管理部门核准登记。    Article 15 Any enterprise which is to engage in the wholesale trade of tobacco products shall be subject to the approval of the department of tobacco monopoly administration under the State Council or the department of tobacco monopoly administration at the provincial level, and the acquisition of a license for the tobacco monopoly wholesale enterprise, and then to the approval and registration by the administrative department for industry and commerce.

第十五条 国境卫生检疫机关对入境、出境的人员实施传染病监测，并且采取必要的预防、控制措施。    Article 15 Frontier health and quarantine offices shall monitor persons on entry or exit for quarantinable infectious diseases and shall take necessary preventive and control measures.

第十五条 国家未制定卫生标准的食品，省、自治区、直辖市人民政府可以制定地方卫生标准，报国务院卫生行政部门和国务院标准化行政主管部门备案。    Article 15 If the State has not formulated hygiene standards for a certain food, the people's governments of the provinces, autonomous regions, or municipalities directly under the Central Government may establish local hygiene standards for that food and report them to the administrative department of public health under the State Council and the competent standardization administration department under the State Council for the record.

第十五条 在国境口岸以及停留在国境口岸的交通工具上，发现检疫传染病、疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明时，国境口岸有关单位以及交通工具的负责人，应当立即向卫生检疫机关报告。    Article 15 On discovering at, or on a conveyance at a frontier port a quarantinable infectious disease, a disease suspected to be quarantinable or a death due to an unidentified cause other than accidental harm, the relevant departmentat the frontier port and the person in charge of the conveyance must report immediately to the health and quarantine office.

第十五条 商务主管部门工作人员不依本办法规定履行职责，或者滥用职权的，依法给予行政处分。    Article 15 Staff of departments of commercial administration committing an act of dereliction of duty or misuse of powers shall be imposed administrative disciplinary measures.

第十五条输入动植物、动植物产品和其他检疫物，经检疫合格的，准予进境；    Article 15 The import animals and plants, their products or other quarantine objects that pass the quarantine inspection are allowed to enter the country;

第十五条 本市城乡农副产品交易点和在本市穿街走巷的食品商贩适用本规定。    Article 15 The present Provisions also apply to the urban and rural trading spots of farm and side-line products and the street vendors of food items in this municipality.

第十五条 特许人未按照《条例》和本办法的规定办理备案的，由国务院商务主管部门及特许人所在地省、自治区、直辖市人民政府商务主管部门责令限期备案，处1万元以上5万元以下罚款；逾期仍不备案的，处5万元以上10万元以下罚款，并予以公告。    Article 15 Where a franchiser fails to archive file based on the Regulation and the provisions in these Measures, the competent commercial department under the State Council and the competent commercial departments of a province, autonomous region or municipality directly under the Central Government where the franchiser is located shall order him/her to archive the documents within a prescribed time limit, and impose a fine of no less than 10 000yuan but no more than 50 000yuan; if the franchiser still fails to archive the documents within the prescribed time limit, a fines of no less than 50 000yuan and no more than 100 000yuan shall be imposed, and an announcement shall be made.

第十六条 经营烟草制品零售业务的企业或者个人，由县级人民政府工商行政管理部门根据上一级烟草专卖行政主管部门的委托，审查批准发给烟草零售许可证。    Article 16 Any enterprise or individual that is to engage in the retail trade of tobacco products shall be subject to the examination and approval of, before the issuance of a license for tobacco monopoly retail trade by, the administrative department for industry and commerce under the people's government at the county level on the commission of the department of tobacco monopoly administration at the next higher level.第十六条 对装运出口易腐烂变质食品的船舱和集装箱，承运人或者装箱单位必须在装货前申请检验。未经检验合格的，不准装运。    Article 16 For vessel holds or containers used for carrying perishable foods, the carrier or the organization using the containers shall apply for inspection before loading. No permission shall be granted for loading and shipment until the relevant conditions are passed by the inspectors.

第十六条 国境卫生检疫机关有权要求入境、出境的人员填写健康申明卡，出示某种传染病的预防接种证书、健康证明或者其他有关证件。    Article 16 Frontier health and quarantine offices shall be authorized to require persons on entry or exit to complete a health declaration form and produce certificates of vaccination against certain infectious diseases, a health certificate or other relevant documents.

第十六条输入动物，经检疫不合格的，由口岸动植物检疫机关签发《检疫处理通知单》，通知货主或者其代理人作如下处理：    Article 16 In respect of the import animals that fail in the quarantine inspection, the port animal and plant quarantine office shall issue the Quarantine Treatment Notice notifying the owner or his or her agent to deal with the said animals in either of the following manners:

第十六条动物、动物产品的运载工具、垫料、包装物应当符合国务院畜牧兽医行政管理部门规定的动物防疫条件。    Article 16 Means of transport, padding materials and packing materials for animals or animal products shall meet the requirements for animal epidemic prevention set by the animal husbandry and veterinary administrative department under the State Council.

第十六条 食品添加剂的国家产品质量标准中有卫生学意义的指标，必须经国务院卫生行政部门审查同意。    Article 16 Norms of significance to the science of health to be included in the national quality standards for food additives must be examined and approved by the administrative department of public health under the State Council.

第十六条 剧毒、危险、易碎、储运中不能倒置以及有其他特殊要求的产品，其包装必须符合相应要求，有警示标志或者中文警示说明标明储运注意事项。    Article 16 The packages of poisonous, dangerous or fragile products, or products that should be kept upright during storage and transportation, or other products with special requirements must meet the corresponding requirements and carry warning marks or warning statements in Chinese indicating directions for storage and transportation.

第十六条 本规定经上海市人民代表大会常务委员会批准，由上海市人民政府颁布，自1985年8月1日起施行。    Article 16 The present Provisions shall be promulgated by the Shanghai Municipal people's Government after being adopted by the Standing Committee of Shanghai Municipal people's Congress, and shall become effective on August 1, 1985.

第十六条 本办法由商务部负责解释。    Article 16 These Measures shall be subject to the interpretation of the Ministry of Commerce.

第十六条 卫生检疫机关发现检疫传染病、监测传染病、疑似检疫传染病时，应当向当地卫生行政部门和卫生防疫机构通报；发现检疫传染病时，还应当用最快的办法向国务院卫生行政部门报告。    Article 16 When the health and quarantine organ has discovered any quarantinable epidemic cases or monitored epidemic diseases or any disease suspected to be quarantinable, it must inform the local health administrative unit and the epidemic prevention unit. When a quarantinable disease is discovered, it must be promptly reported to the health administrative department under the State Council.

第十六条 特许人违反本办法第八条规定的，由备案机关责令改正，可以处1万元以下的罚款；情节严重的，处1万元以上5万元以下的罚款，并予以公告。    Article 16 Where a franchiser violates the provision in Article Eight, the archiving organ shall order him/her to make an correction, and may impose a fine of no more than 10 000 yuan thereupon; if the circumstances are serious, a fine of no less than 10 000 yuan and no more than 50 000 yuan shall be imposed thereupon, and an announcement shall be issued.

第十七条 境外特许人在中国境内从事特许经营活动，按照本办法执行。香港、澳门特别行政区及台湾地区特许人参照本办法执行。    Article 17 An overseas franchiser shall follow these Measures to conduct franchise activities within the territory of China. A franchiser from Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan region shall follow these Measures.

第十七条 在国内或者国外某一地区发生检疫传染病流行时，国务院卫生行政部门可以宣布该地区为疫区。    Article 17 At the time when any quarantinable epidemic disease is prevalent in certain regions at home or abroad, the health administrative department under the State Council may declare the regions as pestilence areas.

第十七条 对患有监测传染病的人、来自国外监测传染病流行区的人或者与监测传染病人密切接触的人，国境卫生检疫机关应当区别情况，发给就诊方便卡，实施留验或者采取其他预防、控制措施，并及时通知当地卫生行政部门。各地医疗单位对持有就诊方便卡的人员，应当优先诊治。    Article 17 For persons who suffer from infectious diseases to be monitored, who come from areas in foreign countries where infectious diseases to be monitored are epidemic or who have close contact with patients suffering from infectious diseases to be monitored, the frontier health and quarantine offices shall, according to each case, issue them medical convenience cards, keep them for inspection or take other preventive or control measures, while promptly notifying the local health administration department about such cases. Medical services at all places shall give priority in consultation and treatment to persons possessing medical convenience cards.

第十七条 生产者不得生产国家明令淘汰的产品。    Article 17 No producer may produce any product that has been officially eliminated by the State.

第十七条输入植物、植物产品和其他检疫物，经检疫发现有植物危险性病、虫、杂草的，由口岸动植物检疫机关签发《检疫处理通知单》，通知货主或者其代理人作除害、退回或者销毁处理。    Article 17 On discovering through quarantine inspection that import plants, plant products or other quarantine objects are contaminated with diseases, pests or weeds dangerous to plants, the port animal and plant quarantine office shall issue the Quarantine Treatment Notice notifying the owner or his or her agent to conduct such treatments as disinfection and disinfestation, returning or destruction.

第十七条 商检机构对本法规定必须经商检机构检验的进出口商品以外的进出口商品，可以抽查检验。    Article 17 The commodity inspection authorities may make a random inspection of import and export commodities beyond those subject to inspection by the commodity inspection authorities in accordance with this Law.

第十七条 国务院烟草专卖行政主管部门会同国务院物价主管部门按卷 烟等级选定部分牌号的卷烟作为代表品。    Article 17 The department of tobacco monopoly administration under the State Council shall, together with the pricing authorities under the State Council, select on a grading basis cigarettes of certain brands as indicators.

第十七条 各级人民政府的食品生产经营管理部门应当加强食品卫生管理工作，并对执行本法情况进行检查。    Article 17 The departments in charge of control of food production or marketing of the people's governments at various levels shall strengthen control of food hygiene and oversee the implementation of this Law.

第十七条保存、使用、运输动物源性致病微生物的，应当遵守国家规定的管理制度和操作规程。    Article 17 The storage, use and transportation of animal-borne pathogenic microorganisms shall conform to the management systems and operational rules set by the state.

第十七条 本办法自2007年5月1日起施行。    Article 17 These Measures shall enter into force as of May 1, 2007.

第十八条 食品生产经营企业应当健全本单位的食品卫生管理制度，配备专职或者兼职食品卫生管理人员，加强对所生产经营食品的检验工作。    Article 18 Enterprises engaged in food production or marketing shall improve their own system for food hygiene control, appoint full-time or part-time workers to control food hygiene and strengthen inspection of the foods they produce or market.

第十八条 国境卫生检疫机关根据国家规定的卫生标准，对国境口岸的卫生状况和停留在国境口岸的入境、出境的交通工具的卫生状况实施卫生监督：    Article 18 Frontier health and quarantine offices shall, in accordance with state health standards, exercise health supervision over the sanitary conditions at frontier ports and the sanitary conditions of conveyances on entry or exit at frontier ports. They shall:

第十八条禁止经营下列动物、动物产品：    Article 18 Marketing of any animal or animal product in the following categories shall be prohibited:?

第十八条 国家行业协会应协助政府主管部门做好企业备案工作，充分发挥行业协会的协调作用，加强行业自律。    Article 18 National Industrial Association shall assist competent department of the government on archival filing, give full play to the coordinating role of the industrial association, and strengthen industrial self-discipline.

第十八条 生产者不得伪造产地，不得伪造或者冒用他人的厂名、厂址。    Article 18 No producer may forge the origin of a product, nor forge or falsely use another producer name and address.第十八条本法第十六条第一款第一项、第二项所称一类、二类动物传染病、寄生虫病的名录和本法第十七条所称植物危险性病、虫、杂草的名录，由国务院农业行政主管部门制定本公布。    Article 18 The catalogues of the Class A and Class B infectious or parasitic diseases of animals specified in Article 16, paragraph 1, Items 1 and 2 of this Law and the catalogues of the diseases, pests or weeds dangerous to plants specified in Article 17 of this Law shall be worked out and announced by the department of agriculture administration under the State Council.

第十八条 商检机构根据检验工作的需要，可以向列入《种类表》的出口商品的生产企业派出检验人员，参与监督出口商品出厂前的质量检验工作。    Article 18 The commodity inspection authorities may, when necessary, assign inspection personnel to manufacturers of export commodities which are included in the List of Commodities to take part in supervision over the quality inspection of export commodities before they leave the factory.

第十八条 卫生检疫机关根据工作需要，可以设立派出机构。卫生检疫机关的设立、合并或者撤销，由国务院卫生行政部门决定。    Article 18 The health and quarantine organ may set up its agent organ if necessary. The setting up, amalgamation or dissolution of any health and quarantine organ shall be decided by the health administrative department under the State Council.

第十八条 国家制定卷烟、雪茄烟的焦油含量级标准。卷烟、雪茄烟应当在包装上标明焦油含量级和“吸烟有害健康”。    Article 18 The State shall lay down the tar content grading standards for cigarettes and cigars. The packages of cigarettes and cigars shall indicate the grade of tar content and that smoking is hazardous to your health.

第十九条 禁止在广播电台、电视台、报刊播放、刊登烟草制品广告。    Article 19 Advertising for tobacco products shall be banned on broadcasting stations, television stations, or in newspapers or periodicals.

第十九条 国境卫生检疫机关设立国境口岸卫生监督员，执行国境卫生检疫机关交给的任务。    Article 19 Frontier health and quarantine offices shall have frontier port health supervisors, who shall carry out the tasks assigned by the frontier health and quarantine offices.

第十九条 生产者不得伪造或者冒用认证标志、名优标志等质量标志。    Article 19 No producer may forge or falsely use another producer authentication marks, famous-and-excellent-product marks or other product quality marks.

第十九条输入动植物、动植物产品和其他检疫物，经检疫发现有本法第十八条规定的名录之外，对农、林、牧、渔业有严重危险的其他病虫害的，由口岸动植物检疫机关依照国务院农业行政主管部门的规定，通知货主或者其代理人作除害、退回或者销毁处理。    Article 19 On discovering through quarantine inspection that import animals and plants, their products or other quarantine objects are contaminated with diseases, insect pests or harmful organisms which are not covered by the catalogues specified in Article 18 of this Law but are extremely harmful to agriculture, forestry, animal husbandry and fishery, the port animal and plant quarantine office shall, in accordance with relevant regulations of the department of agriculture administration under the State Council, notify the owner or his or her agent to conduct such treatments as disinfection and disinfestation, returning or destruction.

第十九条国务院畜牧兽医行政管理部门统一管理并公布全国动物疫情，也可以根据需要授权省、自治区、直辖市人民政府畜牧兽医行政管理部门公布本行政区域内的动物疫情。    Article 19 The animal husbandry and veterinary administrative department under the State Council shall exercise unified control over and publish animal epidemic information nationwide, or may, when necessary, authorize the animal husbandry and veterinary administrative departments under people’s governments of provinces, autonomous regions and municipalities directly under the Central Government to publish animal epidemic information within their own administrative regions.

第十九条 商检机构可以根据国家商检部门同外国有关机构签订的协议或者接受外国有关机构的委托进行进出口商品质量认证工作，准许在认证合格的进出口商品上使用质量认证标志。    Article 19 The commodity inspection authorities may undertake the quality certification of import and export commodities on the basis of agreements signed between the State Administration for Commodity Inspection and the foreign bodies concerned or upon entrustment by the foreign bodies concerned. They may permit the use of quality certification marks on import and export commodities which have been given quality certification.

第十九条 本办法由中华人民共和国商务部负责解释。    Article 19 The Ministry of Commerce of the People's Republic of China is responsible for the interpretation of these Measures.

第十九条 食品生产经营企业的新建、扩建、改建工程的选址和设计应当符合卫生要求。其设计审查和工程验收必须有卫生行政部门参加。    Article 19 The selection of sites and the designs for construction, extension or renovation projects of enterprises engaged in food production or marketing shall meet hygiene requirements, and the administrative department of public health must participate in the examination of those designs and in the inspection and acceptance of finished projects.

第十九条 卫生检疫机关的职责：    Article 19 The studies of the health and quarantine organ are as follows:

第二条 凡在本市城乡集市从事食品生产、经营的单位和个人，必须遵守本规定。    Article 2 All the units and individual persons who are engaged in food production and trading on the urban and rural fairs in this municipality shall abide by the Present Provisions.

第二条进出境的动植物、动植物产品和其他检疫物，装载动植物、动植物产品和其他检疫物的装载容器、包装物，以及来自动植物疫区的运输工具，依照本法规定实施检疫。    Article 2 Animals and plants, their products and other quarantine objects, containers and packaging materials used for carrying animals and plants, their products or other quarantine objects, as well as means of transport from animal or plant epidemic areas shall, on entry or exit, be subject to quarantine inspection in accordance with this Law.

第二条 在中华人民共和国境内从事产品生产、销售活动，必须遵守本法。本法所称产品是指经过加工、制作，用于销售的产品。建设工程不适用本法规定。    Article 2 Anyone who conducts activities of production and sale of any product within the territory of the People’s Republic of China must abide by this Law. Product referred to in this law means a product which is processed or manufactured for the purpose of sale. This Law shall not apply to construction projects.

第二条 本法所称烟草专卖品是指卷烟、雪茄烟、烟丝、复烤烟叶、烟叶、卷烟纸、滤嘴棒、烟用丝束、烟草专用机械。    Article 2 As used in this Law, ""tobacco monopoly commodities"" refer to cigarettes, cigars, cut tobacco, redried leaf tobacco, leaf tobacco, cigarette paper, filter rods, cigarette tow and cigarette manufacturing equipment.

第二条 《国境卫生检疫法》和本细则所称：    Article 2 For the purpose of the Frontier Health and Quarantine Law and these Implementation Rules, the definitions of the following terms are:

第二条 在中华人民共和国国际通航的港口、机场以及陆地边境和国界江河的口岸（以下简称国境口岸），设立国境卫生检疫机关，依照本法规定实施传染病检疫、监测和卫生监督。    Article 2 Frontier health and quarantine offices shall be set up at international seaports, airports and ports of entry at land frontiers and boundary rivers (hereinafter referred to as ""frontier ports"") of the People's Republic of China. These offices shall carry out the quarantining and monitoring of infectious diseases, and health inspection in accordance with the provisions of this Law.

第二条 国务院设立进出口商品检验部门（以下简称国家商检部门），主管全国进出口商品检验工作。    Article 2 The State Council shall establish an Administration for Import and Export Commodity Inspection (hereinafter referred to as the State Administration? for Commodity Inspection), which shall be in charge of the inspection of import and export commodities throughout the country.

第二条 国家实行食品卫生监督制度。    Article 2 The State institutes a system of food hygiene supervision.

第二条 本办法所称市场，是指从事食品交易活动的批发市场、零售市场（包括集贸市场、超市、百货店、仓储式会员店、便利店、食杂店等）。    Article 2 The term ""markets"" as mentioned herein refers to wholesale markets and retail markets (including fairs, supermarkets, department stores, warehouse-type member shops, convenient stores, grocery stores, etc) that are engaged in food trade activity.

第二条 在中华人民共和国境内（以下简称中国境内）从事商业特许经营活动，适用本办法。    Article 2 These Measures apply to commercial franchise activities within the territory of the People's Republic of China (hereinafter referred to as within the territory of China).

第二条 在中华人民共和国境内开展商业特许经营活动适用本办法。    Article 2 These Measures apply to commercial franchise activities within the territory of the People's Republic of China.

第二条本法适用于在中华人民共和国领域内的动物防疫活动。    Article 2 This Law is applicable to animal epidemic prevention activities within the territory of the People’s Republic of China.

 页第二十条 对违反本法规定，有下列行为之一的单位或者个人，国境卫生检疫机关可以根据情节轻重，给予警告或者罚款：    Article 20 A frontier health and quarantine office may warn or fine, according to the circumstances, any unit or individual that has violated the provisions of this Law by committing any of the following acts:

第二十条任何单位或者个人发现患有疫病或者疑似疫病的动物，都应当及时向当地动物防疫监督机构报告。    Article 20 Any unit or individual that finds an animal(s) having an epidemic disease or suspect of having an epidemic disease shall in time report to the local supervising agency for animal epidemic prevention.

第二十条 卷烟、雪茄烟和有包装的烟丝必须申请商标注册，未经核准注册的，不得生产、销售。    Article 20 Applications must be made for the registration of trade marks of cigarettes, cigars and packed cut tobacco, which shall not be manufactured and marketed before the trade mark is registered upon approval.

第二十条 利用新资源生产的食品、食品添加剂的新品种，生产经营企在造投入生产前，必须提出该产品卫生评价和营养评价所需的资料，利用新的原材料生产的食品容器、包装材料和食品用工具、设备的新品种，生产经营企业在投入生产前，必须提出该产品卫生评价所需的资料。上述新品种在投入生产前还需提供样品，并按照规定的食品卫生标准审批程序报请审批。    Article 20 Before starting production of new varieties of food or food additives with new resources, the enterprises engaged in their production or marketing must submit the data required for evaluation of the hygiene and nutrition of such products; before starting production of new varieties of containers, packagings, utensils or equipment used for foods, with new raw or processed materials, the enterprises engaged in their production or marketing must submit the data required for evaluation of the hygiene of such products. Before the new varieties mentioned above are put into production, it shall also be necessary to provide samples of the varieties and the matter shall be reported for examination and approval in accordance with the specified procedures for examining and approving food hygiene standards.

第二十条 国境口岸卫生监督员的职责：    Article 20 Duties of the frontier health supervisor:

第二十条 生产者生产产品，不得掺杂、掺假，不得以假充真、以次充好，不得以不合格产品冒充合格产品。    Article 20 In producing products, producers may not mix impurities or imitations into the products, nor substitute a fake product for a genuine one, a defective product for a high-quality one, nor pass a substandard product off as a good-quality one.

第二十条货主或者其代理人在动植物、动植物产品和其他检疫物出境前，向口岸动植物检疫机关报检。    Article 20 The owner, or his or her agent, of exit animals and plants, their products or other quarantine objects shall, before their exit, submit an application for quarantine inspection to the port animal and plant quarantine office.

第二十条 国家商检部门和商检机构根据检验工作的需要，通过考核，认可符合条件的国内外检验机构承担委托的进出口商品检验工作。    Article 20 The State Administration for Commodity Inspection and the commodity inspection authorities shall, on the basis of the requirements in their inspection, entrust competent inspection organizations at home and abroad with the inspection of import and export commodities after examining their qualifications.

第二十条 本办法自2007年5月1日起实施。    Article 20 These Measures shall enter into force as of May 1 2007.

第二十一条 销售者应当执行进货检查验收制度，验明产品合格证明和其他标识。    Article 21 A seller shall practise a check-for-acceptance system while replenishing his stock, and examine the quality certificates and other marks.

第二十一条 定型包装食品和食品添加剂，必须在包装标识或者产品说明书上根据不同产品分别按规定标出品名、产地、厂名、生产日期、批号或者代号、规格、配方或者主要成分、保存期限、食用或者使用方法等。食品、食品添加剂的产品说明书，不得有夸大或者虚假的宣传内容。    Article 21 Any standardized packaged food or food additive must, according to the requirements for different products, have the name of the product, the place of manufacture, the name of the factory, the date of manufacture, the batch number (or code number), the specifications, the formula or principal ingredients, the date of expiration for guaranteed quality, the method of consumption or use, and other such information indicated in the label of the package or the product description. The product description for any food or food additive shall not contain exaggerated or false advertising.

第二十一条输出动植物、动植物产品和其他检疫物，由口岸动植物检疫机关实施检疫，经检疫合格或者经除害处理合格的，准予出境；    Article 21 Export animals and plants, their products or other quarantine objects shall be quarantined by the port animal and plant quarantine office, and those that pass the quarantine inspection or conform to the standards after a treatment of disinfection and disinfestation are allowed to leave the country.

第二十一条 当事人对国境卫生检疫机关给予的罚款决定不服的，可以在接到通知之日起十五日内，向当地人民法院起诉。    Article 21 If a concerned party refuses to obey a decision on a fine made by a frontier health and quarantine office, he may, within 15 days after receiving notice of the fine, file a lawsuit in a local people's court.

第二十一条发生一类动物疫病时，当地县级以上地方人民政府畜牧兽医行政管理部门应当立即派人到现场，划定疫点、疫区、受威胁区，采集病料，调查疫源，及时报请同级人民政府决定对疫区实行封锁，将疫情等情况逐级上报国务院畜牧兽医行政管理部门。    Article 21 In the case of an animal epidemic of Class I, the animal husbandry and veterinary administrative department under the local people’s government at or above the county level shall dispatch its personnel to the scene forthwith to delimit the epidemic point, the epidemic area and the threatened area, collect epidemic materials, investigate into the epidemic source, report in time to the people’s government at the same level for a decision of cordoning off the epidemic area, and report the epidemic situation and the related information level by level to the animal husbandry and veterinary administrative department under the State Council.

第二十一条 国家商检部门和商检机构对其指定或者认可的检验机构的进出口商品检验工作进行监督，可以对其检验的商品抽查检验。    Article 21 The State Administration for Commodity Inspection and the Commodity inspection authorities shall exercise supervision over the import and export commodity inspection conducted by the inspection organizations designated or approved by them and may make a random inspection of the commodities which have been inspected by such organization.

第二十一条 烟草制品商标标识必须由省级工商行政管理部门指定的企业印制；非指定的企业不得印制烟草制品商标标识 。    Article 21 Trade mark labels for tobacco products must be printed by enterprises designated by the administrative department for industry and commerce at the provincial level. Non-designated enterprises may not print trade mark labels for tobacco products.

第二十一条 卫生检疫机关工作人员、国境口岸卫生监督员在执行任务时，应当穿着检疫制服，佩戴检疫标志；卫生检疫机关的交通工具在执行任务期间，应当悬挂检疫旗帜。    Article 21 When performing its duties, the health and quarantine inspector and border health supervisor are required to wear their quarantine uniform and their quarantine budges. Their conveyances at work are required to bear quarantine flags.

第二十二条 销售者应当采取措施，保持销售产品的质量。    Article 22 A seller shall adopt measures to keep the products for sale in good quality.

第二十二条 违反本法规定，引起检疫传染病传播或者有引起检疫传染病传播严重危险的，依照《中华人民共和国刑法》第一百七十八条的规定追究刑事责任。    Article 22 If a quarantinable infectious disease is caused to spread or is in great danger of being spread as a result of a violation of the provisions of this Law, criminal responsibility shall be investigated in accordance with Article 178 of the Criminal Law of the People's Republic of China.

第二十二条发生二类动物疫病时，当地县级以上地方人民政府畜牧兽医行政管理部门应当划定疫点、疫区、受威胁区。    Article 22 In the case of an animal epidemic of Class II, the animal husbandry and veterinary administrative department under the local people’s government at or above the county level shall delimit the epidemic point, the epidemic area and the threatened area.

第二十二条 国家根据需要，对重要的进出口商品及其生产企业实行质量许可制度，具体办法由国家商检部门会同国务院有关主管部门制定。    Article 22 The State shall, when necessary, institute a quality licence system for important import and export commodities and their manufacturers. The specific measures thereof shall be drawn up by the State Administration for Commodity Inspection in conjunction with the relevant competent departments under the State Council.

第二十二条经检疫合格的动植物、动植物产品和其他检疫物，有下列情形之一的，货主或者其代理人应当重新报检：    Article 22 Where the animals and plants, their products or other quarantine objects that pass the quarantine inspection are involved in any of the following circumstances, the owner or his or her agent shall re-apply for quarantine inspection:

第二十二条 托运或者自运烟草专卖品必须持有烟草专卖行政主管部门或者烟草专卖行政主管部门授权的机构签发的准运证；无准运证的，承运人不得承运。    Article 22 Whoever consigns the transportation of tobacco monopoly commodities to others or undertakes the transportation thereof by himself must hold a transportation permit signed and issued by the department of tobacco monopoly administration or its authorized agency; consignees may not undertake the transportation for any consignor who does not hold a transportation permit.

第二十二条 表明具有特定保健功能的食品，其产品及说明书必须报国务院卫生行政部门审查批准，其卫生标准和生产经营管理办法，由国务院卫生行政部门制定。    Article 22 With regard to the food indicated to have specific health functions, the products and its description must be submitted to the administrative department of public health under the State Council for examination and approval; its hygiene standards and the measures for control of its production and marketing shall be formulated by the administrative department of public health under the State Council.第二十三条 销售者不得销售失效、变质的产品。    Article 23 A seller may not sell invalid or deteriorated products.

第二十三条 船舶代理应当在受入境检疫的船舶到达以前，尽早向卫生检疫机关通知下列事项：    Article 23 Prior to the arrival of the vessel subject to entry quarantine inspection, the shipping agent is required to inform the health and quarantine organ at the earliest possible time of the following matters:

第二十三条 商检机构根据需要，对检验合格的进出口商品，可以加施商检标志或者封识。    Article 23 The commodity inspection authorities may, when necessary, place commodity inspection marks or sealings on import and export commodities proved to be up to standard through inspection.

第二十三条疫点、疫区、受威胁区和疫区封锁的解除，由原决定机关宣布。    Article 23 The disestablishment of the epidemic point, the epidemic area and the threatened area and the lifting of the cordon of the epidemic area shall be announced by the organ that made the original decision.

第二十三条 表明具有特定保健功能的食品，不得有害于人体健康，其产品说明书内容必须真实，该产品的功能和成份必须与说明书一致，不得有虚报。    Article 23 The food indicated to have specific health functions may not be harmful for human health; the content of the product description shall be true, and the functions and ingredients of the product shall be identical with the information given in the product description and there shall be no false information.

第二十三条 国境卫生检疫机关工作人员，应当秉公执法，忠于职守，对入境、出境的交通工具和人员，及时进行检疫；    Article 23 The personnel of frontier health and quarantine offices must enforce this Law impartially, perform duties faithfully and promptly conduct quarantine inspection on conveyances and persons upon entry or exit.

第二十三条要求运输动物过境的，必须事先商得中国国家动植物检疫机关同意，并按照指定的口岸和路线过境。    Article 23 Whoever requests a transit of animals through the Chinese territory must obtain in advance and through consultation the consent of China's State animal and plant quarantine department and the transit must be conducted through the designated port and route.

第二十三条 邮寄、异地携带烟叶、烟草制品的， 不得超过国务院有关主管部门规定的限量。    Article 23 Whoever sends by post or brings from another place leaf tobacco or tobacco products shall not exceed the quantity limits prescribed by the competent department under the State Council.

第二十四条 个人进入中国境内携带烟草制品的，不得超过国务院有关主管部门规定的限量。    Article 24 Any individual who enters the territory of China shall not carry tobacco products more than the quantity limits prescribed by the competent department under the State Council.

第二十四条 食品、食品添加剂和专用于食品的容器、包装材料及其他用具，其生产者必须按照卫生标准和卫生管理办法实施检验合格后，方可出厂或者销售。    Article 24 Food, food additives and containers, packagings and other utensils used specially for food may be dispatched from factory or sold only after their producers have carried out inspection and found them to be up to the standards according to the hygiene standards and the hygiene control regulations.

第二十四条 进出口商品的报验人对商检机构作出的检验结果有异议的，可以向原商检机构或者其上级商检机构以至国家商检部门申请复验，由受理复验的商检机构或者国家商检部门作出复验结论。    Article 24 In case an applicant for the inspection of import and export commodities disagrees with the results of inspection presented by the commodityinspection authorities, he may apply for reinspection to the same authorities, to those at the next higher level or to the State Administration for Commodity Inspection. The conclusion on reinspection shall be made by the commodity inspection authorities or the State Administration for Commodity Inspection which has accepted the application for reinspection.

第二十四条发生三类动物疫病时，县级、乡级人民政府应当按照动物疫病预防计划和国务院畜牧兽医行政管理部门的有关规定，组织防治和净化。    Article 24 In the case of an animal epidemic of Class III, the people’s government at the county or township level shall organize the prevention and purification of the epidemic according to the plans for animal epidemic prevention and the provisions of the animal husbandry and veterinary administrative department under the State Council.

第二十四条 受入境检疫的船舶，在航行中，发现检疫传染病、疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明的，船长必须立即向实施检疫港口的卫生检疫机关报告下列事项：    Article 24 In the course of navigation, if a quarantinable epidemic disease, a disease suspected to be quarantinable, or a death due to an unidentified cause other than accidental harm is discovered, the captain must make a prompt report to the health and quarantine organ about the following matters:

第二十四条 销售者销售的产品的标识应当符合本法第十五条的规定。    Article 24 The marks of seller products shall conform to the provisions of Article 15 of this Law.

第二十四条运输动植物、动植物产品和其他检疫物过境的，由承运人或者押运人持货运单和输出国家或者地区政府动植物检疫机关出具的检疫证书，在进境时向口岸动植物检疫机关报检，出境口岸不再检疫。    Article 24 The transit of animals and plants, their products or other quarantine objects requires the consignor or the escort to submit at the port of entry the bills of lading and the quarantine certificates issued by the animal and plant quarantine department under the government of the exporting country or region to the port animal and plant quarantine office for quarantine inspection. No further quarantine inspection is needed at the port of exit.

第二十四条 中华人民共和国缔结或者参加的有关卫生检疫的国际条约同本法有不同规定的，适用该国际条约的规定。但是，中华人民共和国声明保留的条款除外。    Article 24 Where the provisions of this Law differ from those of international treaties on health and quarantine that China has concluded or joined, the provisions of such international treaties shall prevail, with the exception of the treaty clauses on which the People's Republic of China has declared reservations.

第二十五条 销售者不得伪造产地，不得伪造或者冒用他人的厂名、厂址。    Article 25 A seller may not forge the origin of a product, nor forge or falsely use another producer name and address.

第二十五条 受入境检疫的船舶，必须按照下列规定悬挂检疫信号等候查验，在卫生检疫机关发给入境检疫证前，不得降下检疫信号。    Article 25 All vessels subject to entry quarantine inspection are required to hoist quarantine signals ready for inspection. Without getting an Entry Quarantine Permit issued by the health and quarantine organ, the quarantine signals shall not be lowered.

第二十五条 生产卷烟纸、滤嘴棒、烟用丝束、烟草专用机械的企业，必须报国务院烟草专卖行政主管部门批准，取得烟草专卖生产企业许可证。    Article 25 Any enterprise which is to engage in the production of cigarette paper, filter rods, cigarette tow or cigarette manufacturing equipment must apply to the department of tobacco monopoly administration under the State Council for approval and obtain a license for the tobacco monopoly production enterprise.

第二十五条 中华人民共和国边防机关与邻国边防机关之间在边境地区的往来，居住在?两国边境接壤地区的居民在边境指定地区的临时往来，双方的交通工具和人员的入境、出境检疫，依照双方协议办理，没有协议的，依照中国政府的有关规定办理。    Article 25 In cases of temporary contact between frontier defence units of the People's Republic of China and those of a neighbouring country, of a temporary visit at a designated place on the frontier by residents of the border areas of the two countries and of entry or exit of conveyances and persons of the two sides, quarantine inspection shall be conducted in line with the agreements between China and the other country or, in the absence of such an agreement, in accordance with the relevant regulations of the Chinese Government.

第二十五条 商检机构和其指定的检验机构以及经国家商检部门批准的其他检验机构，可以接受对外贸易关系人或者外国检验机构的委托，办理进出口商品鉴定业务。进出口商品鉴定业务的范围包括：    Article 25 The commodity inspection authorities, the inspection organizations designated by them and other inspection organizations approved by the State Administration for Commodity Inspection may handle the business of superintending and surveying import and export commodities as entrusted by parties involved in foreign trade or by foreign inspection bodies.The scope of business of superintending and surveying import and export commodities shall cover:

第二十五条二类、三类动物疫病呈暴发性流行时，依照本法第二十一条的规定办理。    Article 25 The provisions of Article 21 in this Law shall apply if an animal epidemic of Class II or Class III spreads violently.

第二十五条过境的动物经检疫合格的，准予过境；发现有本法第十八条规定的名录所列的动物传染病、寄生虫病的，全群动物不准过境。    Article 25 The transit animals that pass the quarantine inspection are allowed to pass through the country; and in case any infectious or parasitic disease of animals specified in the catalogues as stipulated in Article 18 of this Law is discovered, the entire flock of the animals shall not be allowed to transit.

第二十五条 食品生产经营者采购食品及其原料，应当按照国家有关规定索取检验合格证或者化验单，销售者应当保证提供。需要索证的范围和种类由省、自治区、直辖市人民政府卫生行政部门规定。    Article 25 Whenever producers or marketers of food procure supplies, they shall, in accordance with the relevant State regulations, request inspection certificates or laboratory test reports and the supplier must provide these. The scopes and types of food that requires certificates shall be specified by the administrative department of public health of the people's governments of the provinces, autonomous regions, or municipalities directly under the Central Government.

第二十六条 销售者不得伪造或者冒用认证标志、名优标志等质量标志。    Article 26 A seller may not forge or falsely use another producer authentication marks, famous-and-excellent-product marks or other product quality marks.第二十六条 食品生产经营人员每年必须进行健康检查；新参加工作和临时参加工作的食品工作经营人员必须进行健康检查，取得健康证明后方可参加工作。    Article 26 All persons engaged in food production or marketing must undergo an annual medical examination; persons newly employed or serving temporarily in this field must also undergo a medical examination and may not start work until they have obtained health certificates.

第二十六条 生产卷烟纸、滤 嘴棒、烟用丝束、烟草专用机械的企业，应当按照国务院烟草专卖行政主管部门的计划以及与烟草制品生产企业签订的订货合同组织生产。    Article 26 Any enterprise engaged in the production of cigarette paper, filter rods, cigarette tow or cigarette manufacturing equipment shall organize production in accordance with the plans assigned by the department of tobacco monopoly administration under the State Council and the order contracts concluded with the enterprises producing tobacco products.

第二十六条 违反本法规定，对列入《种类表》的和其他法律、行政法规规定必须经商检机构检验的进口商品未报经检验而擅自销售或者使用的，对列入《种类表》的和其他法律、行政法规规定必须经商检机构检验的出口商品未报经检验合格而擅自出口的，由商检机构处以罚款；    Article 26 Anyone who, in violation of the relevant provisions of this Law, purposely markets or uses import commodities which are included in the List of Commodities or subject to inspection by the commodity inspection authorities in accordance with other laws or administrative rules and regulations without having such commodities inspected, or purposely exports export commodities which are included in the List of Commodities or subject to inspection by the commodity inspection authorities in accordance with other laws or administrative rules and regulations without having such commodities inspected and proved up to standard shall be fined by the commodity inspection authorities.

第二十六条为控制、扑灭重大动物疫情，动物防疫监督机构可以派人参加当地依法设立的现有检查站执行监督检查任务；    Article 26 For the purpose of control or extermination of major animal epidemic situations, the supervising agencies for animal epidemic prevention may dispatch their personnel to the inspecting stations having been set up according to law by the locality to undertake supervision and inspection.

第二十六条 国境卫生检疫机关实施卫生检疫，按照国家规定收取费用。    Article 26 Frontier health and quarantine offices shall charge for health and quarantine services according to state regulations.

第二十六条 悬挂检疫信号的船舶，除引航员和经卫生检疫机关许可的人员外，其他人员不准上船，不准装卸行李、货物、邮包等物品，其他船舶不准靠近；船上的人员，除因船舶遇险外，未经卫生检疫机关许可，不准离船；引航员不得将船引离检疫锚地。    Article 26 No persons other than navigation pilot and those approved by the health and quarantine organ shall be allowed to get on board the vessel(s) with quarantine flag or light signal(s); no unloading of luggage, cargo, postal parcels shall be allowed; no other vessel shall be allowed to get close; no crew member shall be allowed to leave the vessel without the approval by the health and quarantine organ, unless the vessel is in distress. The navigation pilot shall not guide the vessel(s) away from the quarantine anchorage.

第二十六条对过境植物、动植物产品和其他检疫物，口岸动植物检疫机关检查运输工具或者包装，经检疫合格的，准予过境；    Article 26 The port animal and plant quarantine office shall examine the means of transport and the packings, in respect of the transit plants, animal and plant products or other quarantine objects, which are allowed to transit through the country if they pass the quarantine inspection;

第二十七条动植物、动植物产品和其他检疫物过境期间，未经动植物检疫机关批准，不得开拆包装或者卸离运输工具。    Article 27 Animals and plants, their products or other quarantine objects, in the course of their transit, may not be unpacked or discharged from the means of transport without the approval of the animal and plant quarantine organ.

第二十七条 生产卷烟纸、滤 嘴棒、烟用丝束、烟草专用机械的企业，只可将产品销售给烟草公司和持有烟草专卖生产企业许可证的烟草制品生产企业。    Article 27 Any enterprise engaged in the production of cigarette paper, filter rods, cigarette tow or cigarette manufacturing equipment may sell its products only to tobacco companies or enterprises producing tobacco products with the license for tobacco monopoly production enterprises.

第二十七条 食品生产经营企业和食品摊贩，必须先取得卫生行政部门发放的卫生许可证方可向工商行政管理部门申请登记。未取得卫生许可证的，不得从事食品生产经营活动。    Article 27 Enterprises engaged in food production or marketing as well as food vendors must obtain a hygiene licence issued by the administrative department of public health before they shall be permitted to apply for registration with the administrative departments of industry and commerce. No person who has not obtained a hygiene licence may engage in food production or marketing.

第二十七条 伪造、变造商检单证、印章、标志、封识、质量认证标志，构成犯罪的，对直接责任人员比照刑法第一百六十七条的规定追究刑事责任；情节轻微的，由商检机构处以罚款。    Article 27 If the falsifying or remaking of the certificates or documents, seals or stamps, marks, sealings or quality certification marks for commodity inspection constitutes a crime, the criminal responsibility of the personnel directly responsible shall be investigated by applying mutatis mutandis the provisions of Article 167 of the Criminal Law; if the circumstances are minor, the offender shall be fined by the commodity inspection authorities.

第二十七条发生人畜共患疫病时，有关畜牧兽医行政管理部门应当与卫生行政部门及有关单位互相通报疫情。畜牧兽医行政管理部门、卫生行政部门及有关单位应当及时采取控制、扑灭措施。    Article 27 In the case of an epidemic disease contracted commonly by both human beings and livestock, the animal husbandry and veterinary administrative department, the public health administrative department and other units concerned shall exchange information on the epidemic situation and shall take control and extermination measures in time.

第二十七条 国务院卫生行政部门根据本法制定实施细则，报国务院批准后施行。    Article 27 The health administration department under the State Council shall, in accordance with this Law, formulate rules for its implementation, which shall go into effect after being submitted to and approved by the State Council.

第二十七条 申请电讯检疫的船舶，首先向卫生检疫机关申请卫生检查，合格者发给卫生证书，该证书自签发之日起12个月内可以申请电讯检疫。    Article 27 Vessel(s) applying for quarantine inspection by telecommunication must first submit an application to the health and quarantine organ. A sanitary certificate shall be issued to the qualified vessel(s) which may apply for telecommunicated quarantine inspection within 12 months as of the issuance of the certificate.

第二十七条 销售者销售产品，不得掺杂、掺假，不得以假充真、以次充好，不得以不合格产品冒充合格产品。    Article 27In selling products, sellers, may not mix impurities or imitations into the products, nor substitute a fake product for a genuine one, a defective product for a high-quality one, nor pass a substandard product off as a good-quality one.

第二十八条 售出的产品有下列情形之一的，销售者应当负责修理、更换、退货；给购买产品的用户、消费者造成损失的，销售者应当赔偿损失：    Article 28 A seller shall be responsible for repair, or change, or refund of a product if it is sold under any of the following circumstances, and, where the product has caused any loss on users or consumers, the seller shall compensate for such loss:

第二十八条疫区内有关单位和个人，应当遵守县级以上人民政府及其畜牧兽医行政管理部门依法作出的有关控制、扑灭动物疫病的规定。    Article 28 Any unit or individual within an epidemic area shall observe the stipulations of the people’s government at or above the county level and its animal husbandry and veterinary administrative department for the control and extermination of the animal epidemic.

第二十八条 当事人对商检机构的处罚决定不服的，可以自收到处罚通知之日起三十天内，向作出处罚决定的商检机构或者其上级商检机构或者国家商检部门申请复议；    Article 28 If a party refuses to accept the punishment decision of the commodity inspection authorities, he may, within 30 days of receiving the notice on the punishment, apply for reconsideration to the same authorities which have made the punishment decision, to those at the next higher level or to the State Administration for Commodity Inspection.

第二十八条 各类食品市场的举办者应当负责市场内的食品卫生管理工作，并在市场内设置必要的公关卫生设施，保持良好的环境卫生状况。    Article 28 Persons who run a food market of any type shall be responsible for the food hygiene control of the market, set up necessary public sanitary facilities in the market and maintain a good sanitary environment.

第二十八条 国务院烟草专卖行政主管部门根据国务院规定，管理烟草行业的进出口贸易和对外经济技术合作。    Article 28 The department of tobacco monopoly administration under the State Council shall, in accordance with the relevant regulations of the State Council, exercise control over tobacco industry's import and export trade and its foreign economic and technological co-operation.

第二十八条 持有效卫生证书的船舶在入境前24小时，应当向卫生检疫机关报告下列事项：    Article 28 The vessel with valid sanitary certificate must make a report, twenty-four hours prior to its arrival, to the health and quarantine organ about the following matters:

第二十八条 本法自一九八七年五月一日起施行。一九五七年十二月二十三日公布的《中华人民共和国国境卫生检疫条例》同时废止。    Article 28 This Law shall go into effect on May 1, 1987. On the same day, the Frontier Health and Quarantine Regulations of the People's Republic of China promulgated on December 23, 1957, shall be invalidated.

第二十八条携带、邮寄植物种子、种苗以及其繁殖材料进境的，必须事先提出申请，办理检疫审批手续。    Article 28 Whoever intends to carry or post plant seeds, seedlings or other propagating materials into the country must submit an application in advance and go through the formalities for examination and approval of quarantine inspection.

第二十九条 因产品存在缺陷造成人身、缺陷产品以外的其他财产（以下简称他人财产）损害的，生产者应当承担赔偿责任。    Article 29 A producer shall be liable for compensation if his defective product causes damage to human life or property other than the defective product itself (hereinafter referred to as another persons property).

第二十九条 经营烟草专卖品进出口业务、经营外国烟草制品寄售业务或者在海关监督区域内经营免税的外国烟草制品购销业务的企业，必须经国务院烟草专卖行政主管部门或者省级烟草专卖行政主管部门批准，取得特种烟草专卖经营企业许可证。    Article 29 Any enterprise engaged in the import and export of tobacco monopoly commodities, the consignment for sale of foreign tobacco products or the purchase and sale of duty-free foreign tobacco products within a customs surveillance zone shall be subject to the approval of the department of tobacco monopoly administration under the State Council or the department of tobacco monopoly administration at the provincial level and must obtain a special license for the tobacco monopoly operation enterprise.第二十九条 国家商检部门、商检机构的工作人员和国家商检部门、商检机构指定的检验机构的检验人员，滥用职权，徇私舞弊，伪造检验结果的，或者玩忽职守，延误检验出证的，根据情节轻重，给予行政处分或者依法追究刑事责任。    Article 29 Any functionary of the State Administration for Commodity Inspection or of the commodity inspection authorities or any of the inspection personnel of the inspection organizations designated by the State Administration for Commodity Inspection and the commodity inspection authorities who abuses his power, commits irregularities for the benefit of his relatives or friends, falsifies inspection results or fails to conduct inspection and issue a certificate within the time limit through dereliction shall, depending on the seriousness of the circumstances, be given administrative sanction, or his criminal responsibility shall be investigated according to law.

第二十九条 对船舶的入境检疫，在日出后到日落前的时间内实施；凡具备船舶夜航条件，夜间可靠离码头和装卸作业的港口口岸，应实行24 小时检疫。对来自疫区的船舶，不实行夜间检疫。    Article 29 Entry quarantine inspection of vessel(s) shall be conducted between sunrise and sunset. Round-the-clock quarantine inspection shall be conducted on vessel(s) at the port which have night navigation conditions for docking and unloading of cargo. No night-time quarantine inspection shall be conducted on vessel(s) from pestilence areas.

第二十九条发生动物疫情时，航空、铁路、公路、水路等运输部门应当优先运送控制、扑灭疫情的人员和有关物资，电信部门应当及时传递动物疫情报告。    Article 29 In the case of an animal epidemic, transportation departments such as civil aviation, railways, highways and waterways shall give priority to the transportation of personnel and related materials for control and extermination of the epidemic situation, and post and telecommunications departments shall deliver and transmit reports on the epidemic situation in time.

第二十九条 城乡集市贸易的食品卫生管理工作由工商行政管理部门负责，食品卫生监督检验工作由卫生行政部门负责。    Article 29 The administrative departments of industry and commerce shall be responsible for the control of food hygiene on urban and rural markets; the administrative departments of public health shall be responsible for the supervision and inspection of food hygiene.

第二十九条禁止携带、邮寄进境的动植物、动植物产品和其他检疫物的名录，由国务院农业行政主管部门制定并公布。    Article 29 The catalogues of the animals and plants, their products and other quarantine objects that are not allowed to be carried or posted into the country shall be worked out and announced by the department of agriculture administration under the State Council.

第三条本法所称动物，是指家畜家禽和人工饲养、合法捕获的其他动物。    Article 3 ""Animal"" referred to in this Law means livestock, poultry and other animals raised by man or caught legally.

第三条 在中华人民共和国境内从事食品流通活动，适用本办法。    Article 3 All food circulation activities within the territory of the People's Republic of China shall be governed in accordance with these Measures.

第三条国务院设立动植物检疫机关(以下简称国家动植物检疫机关)，统一管理全国进出境动植物检疫工作。    Article 3 An animal and plant quarantine department shall be instituted under the State Council (hereinafter referred to, for short, as the State animal and plant quarantine department), which shall conduct a unified administration of the entry and exit animal and plant quarantine in the whole country.

第三条 卫生检疫机关在国境口岸工作的范围，是指为国境口岸服务的涉外宾馆、饭店、俱乐部，为入境、出境交通工具提供饮食、服务的单位和对入境、出境人员、交通工具、集装箱和货物实施检疫、监测、卫生监督的场所。    Article 3 Duty range for health and quarantine organs on the frontier shall cover those hotels, restaurants and clubs on the frontier and those units that provide food or services for the incoming or outgoing conveyance and those places where quarantine inspection, sanitary monitoring and health supervision on the incoming or outgoing persons, conveyance, containers and goods are carried out.

第三条 本法规定的传染病是指检疫传染病和监测传染病。检疫传染病，是指鼠疫、霍乱、黄热病以及国务院确定和公布的其他传染病。    Article 3 Infectious diseases specified in this Law shall include quarantinable infectious diseases and infectious diseases to be monitored.

第三条 生产者、销售者依照本法规定承担产品质量责任。    Article 3 Producers and sellers shall be liable for product quality in accordance with this Law.

第三条 国务院卫生行政部门主管全国食品卫生监督管理工作。    Article 3 The administrative department of public health under the State Council shall be in charge of supervision and control of food hygiene throughout the country.

第三条 本办法所称关联公司，是指特许人的母公司、特许人直接或间接拥有全部或多数股权的子公司、与特许人直接或间接地由同一所有人拥有全部或多数股权的公司。    Article 3 The associated company herein refers to the parent company of the franchiser, subsidiary company which the franchiser owns directly or indirectly all or the controlling interest thereof, company which the same owner owns all or the controlling interest with the franchiser directly or indirectly.

第三条 商检机构和国家商检部门、商检机构指定的检验机构，依法对进出口商品实施检验。    Article 3 The commodity inspection authorities and other inspection organizations designated by the State Administration for Commodity Inspection and the commodity inspection authorities shall, in accordance with the law, perform the inspection of import and export commodities.

第三条 国务院商务主管部门及省、自治区、直辖市人民政府商务主管部门是商业特许经营的备案机关。    Article 3 The competent commercial departments under the State Council and at provincial, autonomous region and municipality directly under the Central Government level are the organs for archiving commercial franchises.

第三条 工商行政管理部门负责集市的食品卫生管理工作，主要职责是：    Article 3 The industrial and commercial administrative departments are in charge of the food hygiene control on the fairs. Their main responsibilities are:

第三条 国家对烟草专卖品的生产、销售、进出口依法实行专卖管理，并实行烟草专卖许可证制度。    Article 3 The State shall, according to law, exercise monopoly administration over the production, sale, import and export of tobacco monopoly commodities, and production sale, import and export of tobacco monopoly commodities, and practice a tobacco monopoly license system.

第三十条 进口的食品、食品添加剂，食品容器、包装材料和食品用工具及设备，必须符合国家卫生标准和卫生管理办法的规定。    Article 30 Imported foods, food additives and containers, packagings, utensils and equipment used for food must comply with the national hygiene standards and the hygiene control regulations.

第三十条动物防疫监督机构按照国家标准和国务院畜牧兽医行政管理部门规定的行业标准、检疫管理办法和检疫对象，依法对动物、动物产品实施检疫。    Article 30 Supervising agencies for animal epidemic prevention shall, in accordance with the national standards, the trade standards and quarantine measures set by the animal husbandry and veterinary administrative department under the State Council, and in the light of the objects to be quarantined, carry out the quarantine of animals and animal products.

第三十条 受入境检疫船舶的船长，在检疫医师到达船上时，必须提交由船长签字或者有船医附签的航海健康申报书、船员名单、旅客名单、载货申报单，并出示除鼠证书或者免予除鼠证书。    Article 30 The captain of the entry vessel is required to show the quarantine physician on board the vessel health declaration, crew member list, passenger manifest and cargo declaration, signed by the captain or the vessel physician, and a deratization certificate or a deratization laissez-passer.

第三十条 商检机构和其他检验机构依照本法的规定实施检验和办理鉴定业务，依照规定收费。    Article 30 The commodity inspection authorities and other inspection organizations shall collect fees according to relevant provisions for carrying out inspection or performing superintending and surveying services in accordance with the provisions of this Law.

第三十条 由于销售者的过错使产品存在缺陷，造成人身、他人财产损害的，销售者应当承担赔偿责任。    Article 30 Where damage to human life or another person property is due to a products defect caused by the fault of a seller, the seller shall be liable for compensation.

第三十条携带本法第二十九条规定的名录以外的动植物、动植物产品和其他检疫物进境的，在进境时向海关申报并接受口岸动物检疫机关检疫。    Article 30 Whoever enters the country carrying animals or plants, animal or plant products or other quarantine objects which are not included in the catalogues specified in Article 29 of this Law shall declare them to the Customs at the port of entry and accept the quarantine inspection by the port animal and plant quarantine office.

第三十条 违反本规定擅自收购烟叶的，由烟草专卖行政主管部门处以罚款，并按照国家规定的价格收购违法收购的烟叶；    Article 30 Whoever, in violation of this Law, purchases leaf tobacco without authorization shall be fined by the department of tobacco monopoly administration, and the leaf tobacco illegally purchased shall be repurchased by the said department at the price set by the State;

第三十一条 船舶实施入境查验完毕以后，对没有染疫的船舶，检疫医师应当立即签发入境检疫证：如果该船有受卫生处理或者限制的事项，应当在入境检疫证上签注，并按照签注事项办理。对染疫船舶、染疫嫌疑船舶，除通知港务监督机关外，对该船舶还应当发给卫生处理通知书，该船舶上的引航员和经卫生检疫机关许可上船的人员，应当视同员工接受有关卫生处理，在卫生处理完毕以后，再发给入境检疫证。    Article 31 After completion of entry quarantine inspection of the vessel, the quarantine physician is required to sign and issue an Entry Quarantine Permit without delay; if the vessel needs to go through sanitization or is subject to certain restrictions, a footnote and signature must be made on第三十一条 出口食品由国家进出口商品检验部门进行卫生监督检验。    Article 31 Foods for export shall be subject to hygiene supervision and inspection by the national inspection agency for import and export commodities.

第三十一条 国家商检部门根据本法制定实施办法，报国务院批准后施行。    Article 31 Rules for the implementation of this Law shall be formulated by the State Administration for Commodity Inspection and shall come into force after being submitted to and approved by the State Council.

第三十一条动物防疫监督机构设动物检疫员具体实施动物、动物产品检疫。    Article 31 Supervising agencies for animal epidemic prevention shall have quarantine officers responsible for the quarantine of animals and animal products. Quarantine officers shall possess the necessary professional skills.

第三十一条邮寄本法第二十九条规定的名录以外的动植物、动植物产品和其他检疫物进境的，由口岸动植物检疫机关在国际邮件互换局实施检疫，必要时可以取回口岸动植物检疫机关检疫；未经检疫不得运递。    Article 31 The port animal and plant quarantine office shall, in respect of the animals and plants, their products or other quarantine objects not included in the catalogues specified in Article 29 of this Law, carry out quarantine inspection at the International Postage Exchange Bureau, or, when necessary, take the same back to the port animal and plant quarantine office for quarantine inspection; and the same shall not be transported or delivered without undergoing quarantine inspection.

第三十一条 因产品存在缺陷造成人身、他人财产损害的，受害人可以向产品的生产者要求赔偿，也可以向产品的销售者要求赔偿。属于产品的生产者的责任，产品的销售者赔偿的，产品的销售者有权向产品的生产者追偿。属于产品的销售者的责任，产品的生产者赔偿的，产品的生产者有权向产品的销售者追偿。    Article 31 Where a defective product causes damage to human life or another persons property, the victim may claim compensation from the producer and may also claim compensation from the seller of such product. Where the liability falls on the producer, but the seller has made the compensation, the seller shall have the right to recover the loss from the producer. Where the liability falls on the seller, but the producer has made the compensation, the producer shall have the right to recover the loss from the seller.

第三十一条 无准运证或者超过准运证规定的数量托运或者自运烟草专卖品的，由烟草专卖行政主管部门处以罚款，可以按照国家规定的价格收购违法运输的烟草专卖品和违法所得。    Article 31 Whoever transports or consigns to others the transportation of tobacco monopoly commodities without a transportation permit, or in excess of the quantity specified in the transportation permit, shall be fined by the department of tobacco monopoly administration, and the tobacco monopoly commodities thus involved may be purchased by the said department at the price set by the State; if the circumstances are serious, the tobacco monopoly commodities illegally transported and the illegal income derived therefrom shall be confiscated.

第三十二条邮寄进境的动植物、动植物产品和其他检疫物，经检疫或者除害处理合格后放行；    Article 32 Animals or plants, animal or plant products or other quarantine objects that enter the country by post shall be released if they pass the quarantine inspection or conform to the standards after the treatment of disinfection and disinfestation;

第三十二条 船舶代理应当在受出境检疫的船舶启航以前，尽早向卫生检疫机关通知下列事项：    Article 32 Before departure of an exit vessel, the shipping agent is required to inform the health and quarantine organ at the earliest possible time of the following matters:

第三十二条 县级以上地方人民政府卫生行政部门在管辖范围内行使食品卫生监督职责。    Article 32 The administrative departments of public health of the local people's governments at or above the county level shall exercise their functions and duties for food hygiene supervision within the scope of their jurisdiction.

第三十二条国家对生猪等动物实行定点屠宰、集中检疫。    Article 32 The state exercises slaughter at designated points and centralized quarantine of livestock like pigs and other animals.

第三十二条 本法自１９８９年８月１日起施行。１９８４年１月２８日国务院发布的《中华人民共和国进出口商品检验条例》同时废止。    Article 32 This Law shall come into force as of August 1, 1989. The Regulations of the People's Republic of China on the Inspection of Import and Export Commodities promulgated by the State Council on January 28, 1984 shall be invalidated as of the same date.

第三十二条 无烟草专卖生产企业许可证生产烟草制品的，由烟草专卖行政主管部门责令关闭，没收违法所得，并处罚款。    Article 32 Where an enterprise that does not hold a license for the tobacco monopoly production enterprise produces tobacco products, the department of tobacco monopoly administration shall order it to close down, confiscate the illegal income derived therefrom and concurrently impose a fine.

第三十二条 因产品存在缺陷造成受害人人身伤害的，侵害人应当赔偿医疗费、因误工减少的收入、残废者生活补助费等费用；造成受害人死亡的，并应当支付丧葬费、抚恤费、死者生前抚养的人必要的生活费等费用。    Article 32 Where bodily injury is caused by a product due to its defect, the infringer shall compensate for the medical expenses of the infringed, the decreased earning due to the loss of his working time as well as the subsistence allowance if the infringed is disabled; where such defect causes death to the infringed, the infringer shall also pay the funeral expenses, the pension for the family of the deceased and the living expenses necessary for any other person(s) supported by the deceased before his death.

第三十三条农民个人自宰自用生猪等动物的检疫，由省、自治区、直辖市人民政府制定管理办法。    Article 33 For quarantine of livestock like pigs and other animals slaughtered by farmers themselves for their own use, the people’s governments of provinces, autonomous regions and municipalities directly under the Central Government shall formulate control measures.

第三十三条携带、邮寄出境的动植物、动植物产品和其他检疫物，物主有检疫要求的，由口岸动植物检疫机关实施检疫。    Article 33 The animals or plants, animal or plant products or other quarantine objects that are carried or posted out of the country shall be quarantined by the port animal and plant quarantine office, upon request by the owner thereof.

第三十三条 受出境检疫的船舶，船长应当向卫生检疫机关出示除鼠证书或者免于除鼠证书和其他有关检疫证件，检疫医师可以向船长、船医提出有关船员、旅客健康情况和船上卫生情况的询问，船长、船医对上述询问应当如实回答。    Article 33 The captain of the vessel receiving exit quarantine inspection is required to show the deratization certificate or the deratization laissez-passer and other related quarantine documents to the health and quarantine organ. The quarantine physician may ask the captain or the vessel physician for further details about the state of health of the crew members and the passengers as well as the sanitary situation on the vessel; the captain and the vessel physician are required to give true-to-fact answers.

第三十三条 食品卫生监督职责是：    Article 33 The duties for food hygiene supervision shall be as follows:

第三十三条 因产品存在缺陷造成损害要求赔偿的诉讼时效期间为二年，自当事人知道或者应当知道其权益受到损害时起计算。    Article 33 The limitation period for bringing an action for damages arising from the defect of a product is two years, counting from the day when the party concerned knew or should have known the infringement of his rights and interests.

第三十三条 无烟草专卖批发生产许可证经营烟草制品批发业务的，由烟草专卖行政主管部门责令关闭或者停止经营烟草制品批发业务，没收违法所得，并处罚款。    Article 33 Where an enterprise that does not hold a license for the tobacco monopoly wholesale enterprise engages in the wholesale trade of tobacco products, the department of tobacco monopoly administration shall order it to close down or to stop the wholesale trade of tobacco products, confiscate the illegal income derived therefrom and concurrently impose a fine.

第三十四条 本法所称缺陷，是指产品存在危及人身、他人财产安全的不合理的危险；产品有保障人体健康，人身、财产安全的国家标准、行业标准的，是指不符合该标准。    Article 34 Defect referred to in this Law means the unreasonable danger existing in product which endangers the safety of human life or another person property; where there are national or trade standards safeguarding the health or safety of human life and property defect means inconformity to such standards.

第三十四条来自动植物疫区的船舶、飞机、火车抵达口岸时，由口岸动植物检疫机关实施检疫。    Article 34 Ships, airplanes or trains from the animal or plant epidemic areas shall, upon their arrival at the port, be quarantined by the port animal and plant quarantine office.

第三十四条动物防疫监督机构依法进行检疫，按照国务院财政、物价行政管理部门的规定收取检疫费用，不得加收其他费用，也不得重复收费。    Article 34 Supervising agencies for animal epidemic prevention shall collect fees for their legal quarantine inspections according to the provisions of the financial and price control departments under the State Council and shall not collect other additional fees or repeat charging for the same item of quarantine.

第三十四条 县级以上人民政府卫生行政部门设立卫生监督员。食品卫生监督员由合格的专业人员担任，由同级卫生行政部门发给证书。    Article 34 The administrative departments of public health of the people's governments at or above the county level shall be manned with food hygiene supervisors. Such supervisors shall be qualified professionals and issued with such certificates by the administrative departments of public health at the corresponding levels.

第三十四条 对船舶实施出境检疫完毕以后，检疫医师应当按照检疫结果立即签发出境检疫证，如果因卫生处理不能按原定时间启航，应当及时通知港务监督机关。    Article 34 Upon completion of quarantine inspection on an exit vessel, the quarantine physician must sign and issue an Exit Quarantine Permit without delay. If the vessel cannot yet sail at the scheduled time due to sanitization, the health and quarantine organ is required to notify the harbour superintendency administration immediately.

第三十四条 无特种烟草专卖经营企业许可证经营烟草专卖品进出口业务、外国烟草制品寄售业务或者免税的外国烟草制品购销业务的，由烟草专卖行政主管部门责令停止经营上述业务，没收违法所得，并处罚款。    Article 34 Where an enterprise that does not hold a special license for the tobacco monopoly operation enterprise engages in the import and export of tobacco monopoly commodities, the consignment for sale of foreign tobacco products, or the purchase and sale of duty-free foreign tobacco products, the department of tobacco monopoly administration shall order it to stop the aforesaid operations, confiscate the illegal income derived therefrom and concurrently impose a fine.第三十五条 对船舶实施出境检疫完毕以后，除引航员和经卫生检疫机关许可的人员外，其他人员不准上船，不准装卸行李、货物、邮包等物品。如果违反上述规定，该船舶必须重新实施出境检疫。    Article 35 After quarantine inspection on an exit vessel is completed, no persons other than the navigation pilot and those approved by the health and quarantine organ shall be allowed to go on board the vessel, no loading and unloading of luggage, cargo or postal parcels shall be allowed. Any violation of the rules may cause the vessel to undergo quarantine reinspection.

第三十五条 食品卫生监督员执行卫生行政部门交付的任务。    Article 35 Food hygiene supervisors shall carry out the tasks assigned to them by the administrative department of public health.

第三十五条动物防疫监督机构不得从事经营性活动。    Article 35 Supervising agencies for animal epidemic prevention shall not engage in business activities.

第三十五条进境的车辆、由口岸动植物检疫机关作防疫消毒处理。    Article 35 Vehicles entering the country shall be disinfected for epidemic prevention by the port animal and plant quarantine office.

第三十五条 因产品质量发生民事纠纷时，当事人可以通过协商或者调解解决。当事人不愿通过协商、调解解决或者协商、调解不成的，可以根据当事人中方的协议向仲裁机构申请仲裁；当事人各方没有达成仲裁协议的，可以向人民法院起诉。    Article 35 Where a civil dispute concerning product quality arises, the parties concerned may seek a settlement through negotiation or mediation. If the parties are unwilling to resort to negotiation or mediation, or negotiation or mediation proves to be unsuccessful, they may apply to an arbitration organization for arbitration as agreed upon between the parties; if the parties fail to reach an arbitration agreement, they may bring a suit before a people's court.

第三十五条 无烟草专卖零售许可证经营烟草制品零售业务的，由工商行政管理部门责令停止经营烟草制品零售业务，没收违法所得，并处罚款。    Article 35 Where an enterprise or individual that does not hold a tobacco monopoly retail license engages in the retail sale of tobacco products, the administrative department for industry and commerce shall order it or him/her to stop retail business, confiscate the illegal income derived therefrom and concurrently impose a fine.

第三十六条 航空器在飞行中，不得向下投掷或者任其坠下能传播传染病的任何物品。    Article 36 Aircraft shall be prohibited from dumping or be allowed to drop any articles that may spread epidemic diseases while flying.

第三十六条 国务院和省、自治区、直辖市人民政府的卫生行政部门，根据需要可以确定具备条件的单位作为食品卫生检验单位，进行食品卫生检验并出具检疫报告。    Article 36 The administrative department of public health under the State Council and those of the people's governments of the provinces, autonomous regions, or municipalities directly under the Central Government may, if the need arises, assign qualified units as units for food hygiene inspection; these units shall undertake food hygiene inspection and provide inspection reports.

第三十六条 仲裁机构或者人民法院可以委托本法第十一条规定的产品质量检验机构，对有关产品质量进行检验。    Article 36 The arbitration organization or the people’s court may entrust an organization in charge of product quality inspection specified in Article 11 of this Law with product quality inspection.

第三十六条进出境运输工具上的泔水、动植物性废弃物，依照口岸动植物检疫机关的规定处理，不得擅自抛弃。    Article 36 The swills and wastes of animal or plant nature on the means of transport entering or leaving the country shall be disposed of in accordance with the regulations of the port animal and plant quarantine office and may not be cast away without authorization.

第三十六条国内异地引进种用动物及其精液、胚胎、种蛋的，应当先到当地动物防疫监督机构办理检疫审批手续并须检疫合格。    Article 36 Those who intend to introduce breeding animals and their semen, embryos and breeder eggs from another place in the country shall first apply to the supervising agency for animal epidemic prevention of the locality for examination and approval of quarantine and shall be subject to quarantine inspection.

第三十六条 生产、销售没有注册商标的卷烟、雪茄烟、有包装的烟丝的，由工商行政管理部门责令停止生产、销售、并处罚款。    Article 36 Where an enterprise or individual produces or sells cigarettes, cigars or packed cut tobacco without registered trade marks, the administrative department for industry and commerce shall order it or him/her to stop the production and sales thereof and shall concurrently impose a fine.

第三十七条 县级以上地方人民政府卫生行政部门对已造成食物中毒事故或者有证据证明可能导致食物中毒事故的，可以对食品生产经营者采取下列临时控制措施：    Article 37 The administrative department of public health of the local people's governments at or above the county level may adopt the following temporary measures of control over the food producer or marketer when a food poisoning accident has occurred or when there is evidence of a potential food poisoning accident:

第三十七条 实施卫生检疫机场的航空站，应当在受入境检疫的航空器到达以前，尽早向卫生检疫机关通知下列事项：    Article 37 The aviation station that conducts health and quarantine inspection is required to inform the health and quarantine organ at the earliest possible time of the following matters:

第三十七条装载出境的动植物、动植物产品和其他检疫物的运输工具，应当符合动植物检疫和防疫的规定。    Article 37 The means of transport carrying export animals and plants, their products or other quarantine objects shall conform to the regulations on animal and plant quarantine and epidemic prevention.

第三十七条 违反本法第二十一条的规定，非法印制烟草制品商标标识的，由工商行政管理部门销毁印制的商标标识，没收违法所得，并处罚款。    Article 37 Where an enterprise or individual, in violation of the provisions of Article 21 of this Law, illegally prints trade mark labels for tobacco products, the administrative department for industry and commerce shall destroy the printed trade mark labels, confiscate the illegal income derived therefrom and concurrently impose a fine.

第三十七条 生产不符合保障人体健康，人身、财产安全的国家标准、行业标准的产品的，责令停止生产，没收违法生产的产品和违法所得，并处违法所得一倍以上五倍以下的罚款，可以吊销营业执照；构成犯罪的，依法追究刑事责任。    Article 37 Where products produced do not comply with the relevant national or trade standards safeguarding the health or safety of human life and property, the producer shall be ordered to stop the production, the products and earning illegally produced and made shall be confiscated, and, a fine from twice to five times the amount of the unlawful earnings shall be imposed concurrently, and the business licence may be revoked; if the case constitutes a crime, the offender shall be investigated for criminal responsibility according to law.

第三十七条人工捕获的可能传播动物疫病的野生动物，须经捕获地或者接收地的动物防疫监督机构检疫合格，方可出售和运输。    Article 37 Wild animals having been caught by man which are likely to spread animal epidemics shall not be sold and transported before passing quarantine inspection by the supervising agency for animal epidemic prevention in the place where the wild animals are caught or where the wild animals are to be received.

第三十八条经检疫合格的动物、动物产品，由动物防疫监督机构出具检疫证明，动物产品同时加盖或者加封动物防疫监督机构使用的验讫标志。    Article 38 If any animal or animal product has passed quarantine inspection, the supervising agency for animal epidemic prevention shall issue a quarantine certificate and, at the same time for any animal product, affix thereto an inspection mark used by the supervising agency for animal epidemic prevention or seal it with the inspection mark.

第三十八条 受入境检疫的航空器，如果在飞行中发现检疫传染病、疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明时，机长应当立即通知到达机场的航空站，向卫生检疫机关报告下列事项：    Article 38 In the course of flight, if any quarantinable epidemic disease, a disease suspected to be quarantinable, or a death due to an unidentified cause other than accidental harm is discovered, the captain of the aircraft subject to entry quarantine inspection is required to inform the airport of the matter and report to the health and quarantine organ about the following matters:

第三十八条进境供拆船用的废旧船舶，由口岸动植物检疫机关实施检疫，发现有本法第十八条规定的名录所列的病虫害的，作除害处理。    Article 38 The old and disused ships entering the country for disassembling purposes shall be quarantined by the port animal and plant quarantine office. In the event that diseases, insect pests or harmful organisms specified in the catalogues mentioned in Article 18 of this Law are discovered, the said ships shall be subjected to a treatment of disinfection and disinfestation.

第三十八条 发生食物中毒的单位和接收病人进行治疗的单位，除采取抢救措施外，应当根据国家有关规定，及时向所在地卫生行政部门报告。    Article 38 The units where food poisoning accidents have occurred and the units that have admitted the victims for medical treatment shall, in addition to taking rescue measures, submit prompt reports to the local administrative departments of public health in accordance with relevant State regulations.

第三十八条 生产者、销售者在产品中掺杂、掺假，以假充真，以次充好，或者以不合格产品冒充合格产品的，责令停止生产、销售，没收违法所得，并处违法所得一倍以上五倍以下的罚款，可以吊销营业执照；构成犯罪的，依法追究刑事责任。    Article 38 Where a producer or a seller mixes impurities or imitations into a product, or passes a fake product off as a genuine one, or passes a defective product off as a high-quality one, or passes a substandard product off as a good-quality one, the producer or seller shall be ordered to stop production or sale, the unlawful earnings shall be confiscated. And a fine from twice to five times his unlawful earning shall be imposed concurrently, and the business licence may be revoked; if the case constitutes a crime, the offender shall be investigated for criminal responsibility according to law.

第三十八条 倒卖烟草专卖品，构成投机倒把罪的，依法追究刑事责任；情节轻微，不构成犯罪的，由工商行政管理部门没收倒卖的烟草专卖品和违法所得，可以并处罚款。    Article 38 Where an enterprise or individual profiteers in tobacco monopoly commodities and the profiteering constitutes a crime of illicit speculation, such profiteer's criminal responsibility shall be investigated according to law; if the circumstances are not so serious as to constitute a crime, the administrative department for industry and commerce shall confiscate the profiteered tobacco monopoly commodities as well as the illegal income derived therefrom and may concurrently impose a fine.

第三十九条 受入境检疫的航空器到达机场以后，检疫医师首先登机。机长或者其授权的代理人，必须向卫生检疫机关提交总申报单、旅客名单，货物仓单和有效的灭蚊证书，以及其他有关检疫证件；对检疫医师提出的有关航空器上卫生状况的询问，机长或者其授权的代理人应当如实回答。在检疫没有结束之前，除经卫生检疫机关许可外，任何人不得上下航空器，不准装卸行李、货物、邮包等物品。    Article 39 After an aircraft subject to entry quarantine inspection lands at the airport, the quarantine physician shall get on board first. The aircraft captain or his authorized agent is required to submit to the health and quarantine organ the general declaration, passenger manifest, deck cargo declaration and the valid deinsectization certificate and other related quarantine documents; the aircraft captain or his authorized agent is required to give true-to-fact answers to the inquiries from the quarantine physician about the sanitary situation on the aircraft. Before completion of quarantine inspection, no persons other than those approved by the health and quarantine organ are allowed to get on or off the aircraft; no loading and unloading of luggage, cargo and postal parcels shall be permitted.第三十九条动物凭检疫证明出售、运输、参加展览、演出和比赛。    Article 39 Animals can be sold, transported, put on display, shows or contests on the strength of the quarantine certificate.

第三十九条 伪造、变造本法规定的烟草专卖生产企业许可证、烟草专卖经营许可证等许可证件和准运证的，依法追究刑事责任。    Article 39 Any enterprise or individual that forges or alters the licenses prescribed in this Law such as those for tobacco monopoly production enterprises, tobacco monopoly business, as well as transportation permits, shall be investigated for criminal responsibility according to law.

第三十九条 生产国家明令淘汰的产品的，责令停止生产，没收违法生产的产品和违法所得，并处违法所得一倍以上五倍以下的罚款，可以吊销营业执照。    Article 39 Where a product which has been officially eliminated by the State is produced, the producer shall be ordered to stop the production, the products and earnings illegally produced and made shall be confiscated. And a fine from twice to five times the unlawful earnings shall be imposed concurrently, and the business licence may be revoked.

第三十九条违反本法规定，有下列行为之一的，由口岸动植物检疫机关处以罚款：    Article 39 Whoever, in violation of this Law, commits any of the following acts shall be fined by the port animal and plant quarantine office:

第三十九条 违反本法规定，生产经营不符合卫生标准的食品，造成食物中毒事故或者其他食源性疾患的，责令停止生产经营、销毁导致食物中毒或者其他食源性疾患的食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款。    Article 39 Whoever, in violation of this Law, produces or markets food which is not up to the hygiene standards, thus causing an accident of food poisoning or resulting in a disease caused by food-borne bacteria, shall be ordered to stop such production or marketing; the food causing such food poisoning or disease shall be destroyed; the illegal gains shall be confiscated and a penalty of not less than one time and not more than five times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 1,000 yuan and not more than 50,000 yuan shall be imposed.

第四条口岸动植物检疫机关在实施检疫时可以行使下列职权：    Article 4 A port animal and plant quarantine office may exercise the following functions and powers when performing quarantine inspection:

第四条 任何单位或者个人对违反本办法规定的行为，有权向备案机关举报。    Article 4 All organizations or individuals have the right to report to the archiving organs where there are behaviors in violation of these Measures.

第四条 入境、出境的人员、交通工具和集装箱，以及可能传播检疫传染病的行李、货物、邮包等，均应当按照本细则的规定接受检疫，经卫生检疫机关许可，方准入境或者出境。    Article 4 All persons, conveyance and containers, as well as articles such as baggage, goods, postal parcels that may transmit quarantinable diseases are subject to quarantine inspection upon entering or exiting the country in accordance with these Rules, and entry and exit shall be allowed to them only after an approval is issued by the health and quarantine office.

第四条 禁止伪造或者冒用认证标志、名优标志等质量标志；禁止伪造产品的产地，伪造或者冒用他人的厂名、厂址；禁止在生产、销售的产品中掺杂、掺假，以假充真、以次充好。    Article 4 It is prohibited to forge or falsely use authentication marks, famous-and-excellent-product marks or other product quality marks; it is prohibited to forge the origin of a product, to forge or falsely use the name and address of a factory of another producers; and it is prohibited to mix impurities or imitations into products that are produced or sold, or pass a fake product off as a genuine one, or pass a defective product off as a high-quality one.

第四条 入境、出境的人员、交通工具、运输设备以及可能抟播检疫传染病的行李、货物、邮包等物品，都应当接受检疫，经国境卫生检疫机关许可，方准入境或者出境。具体办法由本法实施细则规定。    Article 4 Persons, conveyances and transport equipment, as well as articles such as baggage, goods and postal parcels that may transmit quarantinable infectious diseases, shall undergo quarantine inspection upon entering or exiting the country. No entry or exit shall be allowed without the permission of a frontier health and quarantine office. Specific measures for implementation of this Law shall be stipulated in detailed regulations.

第四条动物屠宰，依照本法对其胴体、头、蹄和内脏实施检疫、监督。经检疫合格作为食品的，其卫生检验、监督，依照《中华人民共和国食品卫生法》的规定办理。    Article 4 Quarantine inspection and supervision shall be conducted pursuant to this Law over trunks, heads and viscera of slaughtered animals. Those up to standards for foods after quarantine inspection shall be subjected to hygienic inspection and supervision in accordance with the provisions of the Food Hygiene Law of the People’s Republic of China.

第四条 国务院烟草专卖行政主管部门主管全国烟草专卖工作。    Article 4 The department of tobacco monopoly administration under the State Council shall be responsible for the nation-wide tobacco monopoly.

第四条 特许人应当按照《条例》的要求，在订立特许经营合同之日前至少30日，以书面形式向被特许人披露本办法第五条规定的信息，并提供特许经营合同文本。    Article 4 The franchiser shall disclose the information as stipulated in Article Five in writing to the franchisee within at least 30 days before the day the franchise contract is signed based on the requirement of the Regulations, and provide the franchise contract.

第四条 集市应当根据食品分类，划行归市，分段设摊，合理布局，设置符合卫生标准的水源及其他公共卫生设施，保持环境整洁，防止交叉污染。    Article 4 The markets shall allocate different zones for different food varieties, rationalize their overall layout, install hygienic water supply and other public health facilities, maintain a clean and tidy environment, and prevent cross contamination.

第四条 商务部负责全国流通领域食品安全的行业管理。    Article 4 The Ministry of Commerce is in charge of industrial administration on food safety in circulating field.

第四条 国家商检部门根据对外贸易发展的需要，制定、调整并公布《商检机构实施检验的进出口商品种类表》（以下简称《种类表》）。    Article 4 The State Administration for Commodity Inspection shall, in the light of the needs in the development of foreign trade, make, adjust and publish a List of Import and Export Commodities Subject to Inspection by the Commodity Inspection Authorities (hereinafter referred to as the List of Commodities).

第四条 凡在中华人民共和国领域内从事食品生产经营的，都必须遵守本法。    Article 4 Whoever engages in food production or marketing within the territory of the People's Republic of China must observe this Law.

第四十条 入境旅客必须在指定的地点接受入境查验，同时用书面或者口头回答检疫医师提出的有关询问。在此期间，入境旅客不得离开查验场所。    Article 40 Entry passengers are required to undergo entry quarantine inspection at the appointed place and answer the quarantine physician's inquiries orally or in written form. During the inspection time entry passengers shall not be allowed to leave the inspection place.

第四十条 违反本法规定，未取得卫生许可证或者伪造卫生许可证从事食品生产经营活动的，予以取缔，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以五佰元以上三万元以下的罚款。涂改，出借卫生许可证的，收缴卫生许可证，没收违法所得，并处以违法所得一倍以上三倍以下的罚款；没有违法所得的，处以五佰元以上一万元以下的罚款。    Article 40 If anyone, in violation of this Law, engages in food production or marketing without obtaining a hygiene licence or with a forged hygiene licence, such production or marketing shall be banned; the illegal gains shall be confiscated and a penalty of not less than one time and not more than five times the illegal income shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 500 yuan and not more than 30,000 yuan shall be imposed. If anyone alters or lends his hygiene licence, his hygiene licence and the illegal gains shall be confiscated; and a penalty of not less than one time and not more than three times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 500 yuan and not more than 10,000 yuan shall be imposed.

第四十条检疫证明不得转让、涂改、伪造。    Article 40 The quarantine certificate shall not be transferred altered or forged.

第四十条 销售失效、变质产品的，责令停止销售，没收违法生产的产品和违法所得，并处违法所得一倍以上五倍以下的罚款，可以吊销营业执照；构成犯罪的，依法追究刑事责任。    Article 40 Where invalid or deteriorated products are sold, the seller shall be ordered to stop the sale, the products for illegal sale and the unlawful earnings shall be confiscated. And a fine from twice to five times the unlawful earnings shall be imposed concurrently, and the business licence may be revoled; if the case constitutes a crime, the offender shall be investigated for criminal responsibility according to law.

第四十条报检的动植物、动植物产品或者其他检疫物与实际不符合的，由口岸动植物检疫机关处以罚款；已取得检疫单证的，予以吊销。    Article 40 Where the animals or plants, animal or plant products or other quarantine objects declared for quarantine inspection do not conform to the actual conditions, the applicant shall be fined by the port animal and plant quarantine office; and the quarantine certificates already obtained shall be revoked.

第四十条 走私烟草专卖品，构成走私罪的，依照关于惩治走私罪的补充规定追究刑事责任；    Article 40 Where the smuggling of tobacco monopoly commodities constitutes the crime of smuggling, the smuggler's criminal responsibility shall be investigated in accordance with the Supplementary Provisions Concerning the Punishment of the Crimes of Smuggling;

第四十一条 违反本法规定，食品生产经营过程不符合卫生要求的，责令改正，给予警告，可以处以五千元以下的罚款；拒不改正或者其有他严重情节的，吊销卫生许可证。    Article 41 If, in violation of this Law, any food producer or marketer does not comply with the hygiene requirements, he shall be ordered to set it right and given a disciplinary warning, and a penalty of not more then 5,000 yuan may be imposed; if he refuses to set it right or other serious circumstances are involved, his hygiene licence shall be revoked.

第四十一条动物防疫监督机构依法对动物防疫工作进行监督。    Article 41 Supervising agencies for animal epidemic prevention shall conduct supervision on the work of animal epidemic prevention according to law.第四十一条 烟草专卖行政主管部门对本法实施情况进行检查。    Article 41 The department of tobacco monopoly administration shall have the right to carry out inspection on the implementation of this Law.

第四十一条 对入境航空器查验完毕以后，根据查验结果，对没有染疫的航空器，检疫医师应当签发入境检疫证；如果该航空器有受卫生处理或者限制的事项，应当在入境检疫证上签注，由机长或者其授权的代理人负责执行；对染疫或者有染疫嫌疑的航空器，除通知航空站外，对该航空器应当发给卫生处理通知单，在规定的卫生处理完毕以后，再发给入境检疫证。    Article 41 Upon completion of entry quarantine inspection of the aircraft, the quarantine physician must sign and issue an Entry Quarantine Permit to the aircraft which is free from contamination. If the aircraft needs to undergo sanitization or is subject to certain restrictions, a footnote and signature must be made on the Permit and the aircraft captain or his authorized agent shall be responsible for taking necessary measures accordingly; if the aircraft is proved to be contaminated, a sanitization notice shall be given to the aircraft and the aircraft shall be notified. After the required sanitization is done, an Entry Quarantine Permit shall be issued to the aircraft.

第四十一条 生产者、销售者伪造产品的产地的，伪造或者冒用他人的厂名、厂址的，伪造或者冒用认证标志、名优标志等质量标志的，责令公开更正，没收违法所得，可以并处罚款。    Article 41 Where a producer or a seller forges the origin of a product or falsely uses another producer name and address, or forges or falsely uses authentication marks, famous-and-excellent-product marks or other product quality marks, the producer or seller shall be ordered to make public rectification, and the unlawful earnings shall be confiscated; a fine may be imposed concurrently.

第四十一条违反本法规定，擅自开拆过境动植物、动植物产品或者其他检疫物的包装的，擅自将过境动植物、动植物产品或者其他检疫物卸离运输工具的，擅自抛弃过境动物的尸体、排泄物、铺垫材料或者其他废弃物的，有动植物检疫机关处以罚款。    Article 41 Whoever, in violation of this Law and without authorization, unpacks the packings of transit animals or plants, animal or plant products or other quarantine objects, discharges transit animals or plants, animal or plant products or other quarantine objects from the means of transport, or casts away transit animals' carcasses, excrements, bedding materials or other wastes, shall be fined by the port animal and plant quarantine office.

第四十二条经铁路、公路、水路、航空运输动物、动物产品的，托运人必须提供检疫证明方可托运；    Article 42 Any consignor of animals or animal products to be transported by railways, highways, waterways or by air must provide the quarantine certificate in consigning for shipment.

第四十二条 违反本法规定，生产经营禁止生产经营的食品的，责令停止生产经营，立即公告收回已售出的食品，并销毁该食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款。情节严重的，吊销卫生许可证。    Article 42 If anyone, in violation of this Law, produces or markets food the production and marketing of which is prohibited, he shall be ordered to stop producing or marketing such food, a public announcement shall be made immediately to recall the sold food and the food shall be destroyed; the illegal gains shall be confiscated and a penalty of not less than one time and not more than five times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 1,000 yuan and not more than 50,000 yuan shall be imposed; if the offence is serious, the offender's hygiene licence shall be revoked.

第四十二条 人民法院和处理违法案件的有关部门的工作人员私分没收的烟草制品，依照关于惩治贪污罪贿赂罪的补充规定第一条、第二条的规定追究刑事责任。    Article 42 Personnel from a people's court or a relevant department dealing with law breaking cases who share out the confiscated tobacco products shall be investigated for criminal responsibility in accordance with the provisions of Article 1 and Article 2 of the Supplementary Provisions Concerning the Punishment of the Crimes of Embezzlement and Bribery.

第四十二条 实施卫生检疫机场的航空站，应当在受出境检疫的航空器起飞以前，尽早向卫生检疫机关提交总申报单、货物仓单和其他有关检疫证件，并通知下列事项：    Article 42 Prior to the departure of the aircraft subject to exit quarantine inspection, the airport is required to submit to the health and quarantine organ the general declaration, deck cargo declaration and other documents related to quarantine and to inform it of the following matters:

第四十二条 以行贿、受贿或者其他非法手段推销、采购本法第三十七条至第四十条所列产品，构成犯罪的，依法追究刑事责任。    Article 42 Where anyone sells or purchases products mentioned in Article 37 to 40 of this Law by offering or accepting bribes or other unlawful means and if the case constitutes a crime, the offender shall be in vestigated for criminal responsibility according to law.

第四十二条违反本法规定，引起重大动植物疫情的，比照刑法第一百七十八条的规定追究刑事责任。    Article 42 Whoever violates the provisions of this Law and causes a serious animal or plant epidemic shall be investigated for criminal responsibility by applying mutatis mutandis the provisions of Article 178 of the Criminal Law.

第四十三条动物防疫监督工作人员执行监督检查任务时，应当出示证件，有关单位和个人应当给予支持、配合。    Article 43 Functionaries of animal epidemic prevention supervision shall produce their certificates in performing duties of supervision and inspection. Any unit or individual concerned shall lend support and cooperation to them.

第四十三条 违反本法规定，生产经营不符合营养、卫生标准的专供婴幼儿的主、辅食品的，责令停止生产经营，立即公告收回已售出的食品，并销毁该食品，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款。情节严重的，吊销卫生许可证。    Article 43 If anyone, in violation of this Law, produces or markets the principal and supplementary foods intended specially for infants and preschool children which do not conform to the nutritive and hygiene standards, he shall be ordered to stop producing and marketing such foods, a public announcement shall be made immediately to recall the sold foods and the foods shall be destroyed; the illegal gains shall be confiscated and a penalty of not less than one time and not more than five times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 1,000 yuan and not more than 50,000 yuan shall be imposed; if the offence is serious, the offender's hygiene licence shall be revoked.

第四十三条 烟草专卖行政主管部门和烟草公司的工作人员滥用职权、徇私舞弊或者玩忽职守的，给予行政处分；情节严重，构成犯罪的，依法追究刑事责任。    Article 43 Personnel from the department of tobacco monopoly administration or from a tobacco company who abuse their power, seek personal interests and commit malpractice or neglect their duties shall be subjected to administrative sanctions; if the circumstances are so serious as to constitute a crime, the offender shall be investigated for criminal responsibility according to law.

第四十三条 对出境航空器查验完毕以后，如果没有染疫，检疫医师应当签发出境检疫证或者在必要的卫生处理完毕以后，再发给出境检疫证；如果该航空器因卫生处理不能按原定时间起飞，应当及时通知航空站。    Article 43 Upon completion of exit quarantine inspection of the aircraft, the quarantine physician must sign and issue an Exit Quarantine Permit to the aircraft which is free from contamination, or, such Permit shall be issued upon completion of the necessary sanitization; if the aircraft cannot take off at the scheduled time due to sanitization; the health and quarantine organ must notify the airport without delay.

第四十三条 产品标识不符合本法第十五条规定的，责令改正；有包装的产品标识不符合本法第十五条第（四）项、第（五）项规定，情节严重的，可以责令停止生产、销售，并可以处以违法所得百分之十五至百分之二十的罚款。    Article 43 Where the marks of a product do not comply with the provisions of Article 15 of this Law, the producer or seller concerned shall be ordered to make rectification; where the marks of the packed products do not comply with the provisions of item (4) or (5) of Article 15 of this Law and if the case is serious, the producer or seller concerned may be ordered to stop production or sale. And a fine from 15% to 20% of the unlawful earnings may be imposed concurrently.

第四十三条伪造、变造检疫单证、印章、标志、封识，依照刑法第一百六十七条的规定追究刑事责任。    Article 43 Whoever forges or alters the quarantine certificates, stamps, marks or seals shall be investigated for criminal responsibility in accordance with the provisions of Article 167 of the Criminal Law.

第四十四条 当事人对烟草专卖行政主管部门和工商行政管理部门作出的行政处罚决定不服的，可以在 接到处罚通知之日起15日内向作出处罚决定的机关的上一级机关申请复议；    Article 44 A party, if not satisfied with the decision on administrative sanctions made by the department of tobacco monopoly administration or the administrative department for industry and commerce, may, within 15 days after receiving the notice about the decision on punishment, apply for reconsideration to the authorities at the next higher level over the authorities that made the decision on punishment;

第四十四条当事人对动植物检疫机关的处罚决定不服的，可以在接到处罚通知之日起十五日内向作出处罚决定的机关的上一级机关申请复议；    Article 44 If a party is not satisfied with the decision on punishment made by an animal and plant quarantine organ, it may, within 15 days after receipt of the notification of the punishment, apply for reconsideration to the organ at the next higher level over the organ that has made the decision on punishment;

第四十四条 违反本法规定，生产经营或者使用不符合卫生标准和卫生管理办法规定的食品添加剂、食品容器、包装材料和食品用工具、设备以及洗涤剂、消毒剂的，责令停止生产或者使用，没收违法所得，并处以违法所得一倍以上三倍以下的罚款；没有违法所得的，处以五千元以下的罚款。    Article 44 If anyone, in violation of this Law, produces, markets or uses the food additives, food containers, packagings, utensils and equipment used for food as well as the detergents and disinfectants which do not conform to the hygiene standards and the hygiene control regulations, he shall be ordered to stop producing and using them; the illegal gains shall be confiscated and a penalty of not less than one time and not more than three times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not more than 5,000 yuan shall be imposed.

第四十四条 实施卫生检疫的车站，应当在受入境检疫的列车到达之前，尽早向卫生检疫机关通知下列事项：    Article 44 Prior to the arrival of the trains subject to entry quarantine inspection, the railway station is required to inform the health and quarantine organ of the following matters:

第四十四条动物饲养场所、贮存场所、屠宰厂、肉类联合加工厂、其他定点屠宰场（点）和动物产品冷藏场所的工程的选址和设计，应当符合国务院畜牧兽医行政管理部门规定的动物防疫条件。    Article 44 Selecting sites and designing for works of animal farms, warehouses, slaughterhouses, joint meat processing factories, other designated slaughterhouses or points and refrigeration sites for animal products shall conform to the requirements of animal epidemic prevention stipulated by the animal husbandry and veterinary administrative department under the State Council.

第四十四条 伪造检验数据或者伪造检验结论的，责令更正，可以处以所收检验费一倍以上三倍以下的罚款；情节严重的，吊销营业执照；构成犯罪的，对直接责任人员比照刑法第一百六十七条的规定追究刑事责任。    Article 44 Whoever forges inspection data or inspection conclusion of a product shall be ordered to make rectification, and a fine from twice to three times the inspection fee may be imposed. If the circumstance is serious, the business licence shall be revoked; where the case constitutes a crime, the person held directly responsible shall be investigated for criminal responsibility by applying mutatis mutandis the provisions of Article 167 of the Criminal Law.

第四十五条 受入境检疫的列车和其他车辆到达车站、关口后，检疫医师首先登车，列车长或者其他车辆负责人，应当口头或者书面向卫生检疫机关申报该列车或者其他车辆上人员的健康情况，对检疫医师提出有关卫生状况和人员健康的询问，应当如实回答。    Article 45 After the train or other motor vehicle subject to entry quarantine inspection arrives at the railway station on the border, the quarantine physician shall get on board the train first. The head of train crew or the person in charge of the vehicle is required to submit a report either orally or in written form to the health and quarantine organ on the state of health of the persons on board and to give true-to-fact answers to the inquiries by the quarantine physician concerning sanitary and health conditions on board.

第四十五条 本法规定的吊销营业执照的行政处罚由工商行政管理部门决定，其他行政处罚由管理产品质量监督工作的部门或者工商行政管理部门按照国务院规定的职权范围决定。法律、行政法规对行使行政处罚权的机关另有规定的，依照有关法律、行政法规的规定执行。    Article 45 An administrative sanction in the form of revocation of business licence provided for in this Law shall be decided by the administrative department for industry and commerce, while other administrative sanctions shall be decided by the department responsible for supervision over product quality or the administrative department for industry and commerce according to the functions and powers prescribed by the State Council. Where the laws or administrative rules and regulations provide otherwise as to the authorities exercising the power of administrative sanctions, the relevant provisions of such laws and administrative rules and regulations shall apply.

第四十五条 违反本法规定，未经国务院卫生行政部门审查批准而生产经营表明具有特定保健功能的食品的，或者该食品的产品说明书内容虚假的，责令停止生产经营，没收违法所得，并处以违法所得一倍以上五倍以下的罚款；没有违法所得的，处以一千元以上五万元以下的罚款。情节严重的吊销卫生许可证。    Article 45 If anyone, in violation of this Law, produces or markets the food indicated to have specific health functions without examination and approval by the administrative department of public health under the State Council, or if the product description of such food provides false information, he shall be ordered to stop producing or marketing such food, the illegal gains shall be confiscated and a penalty of not less than one time and not more than five times the illegal gains shall concurrently be imposed; if there are no illegal gains, a penalty of not less than 1,000 yuan and not more than 50,000 yuan shall be imposed; if the offence is serious, the offender's hygiene licence shall be revoked.第四十五条动物饲养场、屠宰厂、肉类联合加工厂和其他定点屠宰场（点）等单位，从事动物饲养、经营和动物产品生产、经营活动，应当符合国务院畜牧兽医行政管理部门规定的动物防疫条件，并接受动物防疫监督机构的监督检查。    Article 45 Raising and marketing of animals or production and marketing of animal products by animal farms, slaughterhouses, joint meat processing factories and other designated slaughterhouses (or points) shall conform to the requirements for animal epidemic prevention stipulated by the animal husbandry and veterinary administrative department under the State Council, and shall be subject to the supervision and inspection of supervising agencies for animal epidemic prevention.

第四十五条 国务院根据本法制定实施条例。    Article 45 The State Council shall formulate implementing regulations on the basis of this Law.

第四十五条动植物检疫机关检疫人员滥用职权，徇私舞弊，伪造检疫结果，或者玩忽职守，延误检疫出证，构成犯罪的，依法追究刑事责任；不构成犯罪的，给予行政处分。    Article 45 Where a quarantine functionary of an animal and plant quarantine organ who abuses his or her power, practises favouritism or embezzlement, forges a quarantine result, or neglects his or her duty or delays the performance of quarantine inspection and the issuance of certificates, criminal responsibility shall be investigated according to law if the offence constitutes a crime; if the offence does not constitute a crime, the offender shall be subjected to administrative sanctions.

第四十六条违反本法规定，有下列行为之一的，由动物防疫监督机构给予警告；拒不改正的，由动物防疫监督机构依法代作处理，处理所需费用由违法行为人承担：    Article 46 Any violator of the provisions of this Law who commits any of the following acts shall be given a warning by the supervising agency for animal epidemic prevention. In case of refusal by the violator to make corrections, the supervising agency for animal epidemic prevention shall deal with the case according to law on the part of the violator who shall pay the expense therefor.

第四十六条本法下列用语的含义是：    Article 46 As used in this Law, the following terms respectively mean:

第四十六条 受入境检疫的列车和其他车辆到达车站、关口，在实施入境检疫而未取得入境检疫证以前，未经卫生检疫机关许可，任何人不准上下列车或者其他车辆，不准装卸行李、货物、邮包等物品。    Article 46 During quarantine inspection, without permission by the health and quarantine organ, no persons shall be allowed to get on or off the train to other vehicle which is subjected to entry quarantine inspection; no loading or unloading of luggage, cargo or postal parcels shall be permitted.

第四十六条 当事人对行政处罚决定不服的，可以在接到处罚通知之日起十五日内向作出处罚决定的机关的上一级机关申请复议；当事人也可以在接到处罚通知之日起十五日内直接向人民法院起诉。    Article 46 If a party is not satisfied with the decision on administrative sanction, it may, within 15 days of receipt of the sanction notice, apply for reconsideration to the authorities at the next higher level over the authorities that have made the decision on sanction; the party may also bring a suit in a people's court directly within 15 days of receipt of the sanction notice.

第四十六条 违反本法规定，定型包装食品和食品添加剂的包装标识或者产品说明书上不表明或者虚假标注生产日期、保质期限等规定事项的，或者违反规定不标注中文标识的，责令改正，可以处以五佰元以上一万元以下的罚款。    Article 46 If anyone, in violation of this Law, does not indicate or falsely indicates specified matters such as the date of manufacture and the date of expiration for guaranteed quality in the labels of packages of the standardized packaged food or food additives or in the product descriptions, or in violation of the regulations, does not have labels in the Chinese language, he shall be ordered to set it right and a penalty of not less than 500 yuan and not more than 10,000 yuan may concurrently be imposed.

第四十六条 本法自1992年1月1日起施行。1983年月23日国务院发布的《烟草专卖条例》同时废止。    Article 46 This Law shall enter into force on January 1, 1992. The Regulations on Tobacco Monopoly promulgated by the State Council on September 23, 1983 shall be annulled simultaneously.

第四十七条 从事产品质量监督管理的国家工作人员滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；不构成犯罪的，给予行政处分。    Article 47 Any State functionary engaged in the work of supervision and control over product quality, who abuses power, neglects duty, engages in malpractice for private benefit, shall be investigated for criminal responsibility if his act constitutes a crime; if his act does not constitute a crime, he shall be subjected to administrative sanction.

第四十七条违反本法第十七条规定，保存、使用、运输动物源性致病微生物或者运输动物病料的，由动物防疫监督机构给予警告，可以并处二千元以下的罚款。    Article 47 Any violator of the provisions of Article 17 of this Law who stores, uses or transports animal-borne pathogenic microorganisms, or transports animal epidemic materials shall be given a warning and may be concurrently fined not more than RMB 2,000 yuan by the supervising agency for animal epidemic prevention.

第四十七条 违反本法规定，食品生产经营人员未取得健康证明而从事食品生产经营的或者对患有疾病不得接触入口食品的生产经营人员，不按规定调离的，责令改正，可以处以五千元以下的罚款。    Article 47 If a food producer or marketer, in violation of this Law, engages in food production or marketing without obtaining a health certificate, or if the producers or marketers who suffer from diseases and may not contact with ready-to-eat foods are not transferred to other posts according to relevant regulations, they shall be ordered to set it right and a penalty of not more than 5,000 yuan may be imposed.

第四十七条中华人民共和国缔结或者参加的有关动植物检疫的国际条约与本法有不同规定的，适用该国际条约的规定。但是，中华人民共和国声明保留的条款除外。    Article 47 If provisions of this Law contravene those of the international treaties concerning animal and plant quarantine which the People's Republic of China has concluded or to which China is a party, the provisions of the international treaties concerned shall prevail, with the exception of the treaty clauses on which the People's Republic of China has declared reservations.

第四十七条 实施卫生检疫的车站，应当在受出境检疫列车发车以前，尽早向卫生检疫机关通知下列事项：    Article 47 Prior to the departure of the train subject to exit quarantine inspection, the railway station is required to inform the health and quarantine organ at the earliest possible time of the following matters:

第四十八条 国家工作人员利用职务，对明知有违反本法规定构成犯罪的行为的企业事业单位或者个人故意包庇使其不受追诉的，依法追究刑事责任。    Article 48 Any State functionary who clearly knows that an enterprise, institution or individual has committed criminal actions in violation of this Law, and takes advantage of his position to protect the offenders intentionally from prosecution, shall be investigated for criminal responsibility according to law.

第四十八条违反本法规定，经营下列动物、动物产品的，由动物防疫监督机构责令停止经营，立即采取有效措施收回已售出的动物、动物产品，没收违法所得和未售出的动物、动物产品；    Article 48 Any violator of the provisions of this Law who markets any of the following animals or animal products shall be ordered by the supervising agency for animal epidemic prevention to stop the business operations and, with the illegal gains and animals and animal products having not yet been sold confiscated, to take effective measures to withdraw animals and animal products having been sold.

第四十八条 应当受入境、出境检疫的列车和其他车辆，如果在行程中发现检疫传染病、疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明的，列车或者其他车辆到达车站、关口时，列车长或者其他车辆负责人应当向卫生检疫机关报告。    Article 48 During its course of transportation, if a quarantinable infectious disease, a disease suspected to be quarantinable, or death due to an unidentified cause other than accidental harm is discovered on the train or other vehicle subject to entry or exit quarantine inspection, the head of the train crew or the person in charge of the vehicle is required to report to the health and quarantine organ about the matter upon arrival at the border station.

第四十八条 违反本法规定，造成食物中毒事故或者其他食源性疾患的，或者因其他违反本法行为给他人造成损害的，应当依法承担民事赔偿责任。    Article 48 If anyone, in violation of this Law, causes an accident of food poisoning or a disease engendered by food-borne bacteria or causes harm to another person by other acts against this Law, he shall bear the civil liability for compensation according to law.

第四十八条口岸动植物检疫机关实施检疫依照规定收费。收费办法由国务院农业行政主管部门会同国务院物价等有关主管部门制定。    Article 48 Port animal and plant quarantine offices shall collect fees, according to relevant regulations, for performing quarantine inspection. The measures for the collection of fees shall be worked out by the department of agriculture administration under the State Council together with the competent departments such as the pricing department under the State Council.

第四十九条违反本法规定，经营依法应当检疫而没有检疫证明的动物、动物产品的，由动物防疫监督机构责令停止经营，没收违法所得；    Article 49 Any violator of the provisions of this Law who markets animals or animal products subjected to quarantine inspection according to law but without quarantine certificates shall be ordered, with the illegal gains confiscated, to stop the business operations by the supervising agency for animal epidemic prevention.

第四十九条 受入境、出境检疫的列车，在查验中发现检疫传染病或者疑似检疫传染病，或者因受卫生处理不能按原定时间发车，卫生检疫机关应当及时通知车站的站长；如果列车在原停车地点不宜实施卫生处理，站长可以选择站内其他地点实施卫生处理。在处理完毕之前，未经卫生检疫机关许可，任何人不准上下列车，不准装卸行李、货物、邮包等物品。    Article 49 In cases that a quarantine infectious disease or a disease suspected to be quarantinable is discovered on the train subject to entry or exit quarantine inspection, or in case that the train is unable to leave at scheduled time due to sanitization, the health and quarantine organ is required to inform the station master of the case without delay. If the parking place is not suitable for sanitization, the station master can decide on another place within the station for sanitization. Before completion of sanitization, without permission by the health and quarantine organ, no person shall be allowed to get off or on the train, no loading or unloading of luggage, goods or postal parcels shall be permitted.

第四十九条 本法规定的行政处罚由县级以上地方人民政府卫生行政部门决定。    Article 49 The administrative punishment provided in this Law shall be decided by the administrative department of public health of a local people's government at or above the county level.

第四十九条国务院根据本法制定实施条例。    Article 49 The State Council shall, on the basis of this Law, formulate the implementing regulations.

第四十九条 以暴力、威胁方法阻碍从事产品质量监督管理的国家工作人员依法执行职务的，依照刑法第一百五十七条的规定追究刑事责任；拒绝、阻碍从事产品质量监督管理的国家工作人员依法执行职务未使用暴力、威胁方法的，由公安机关依照治安管理处罚条例的规定处罚。    Article 49 Whoever, obstructs, by means of violence or intimidation, State functionaries engaged in the work of supervision and control over product quality from carrying out their duties according to law shall be investigated for criminal resposibility in accordance with the provisions of Article 157 of the Criminal Law; whoever refuses or impedes, without resorting to violence or intimidation, State functionaries engaged in the work of supervision and control over product quality to carry out their duties shall be punished by the public security organs in accordance with the relevant provisions of the Regulations on Administrative Penalties for Public Security.

第五条 申请备案的特许人应当向备案机关提交以下材料：    Article 5 A franchiser applying for archival filing shall submit the following documents to the archiving organ:第五条 列入《种类表》的进出口商品和其他法律、行政法规规定须经商检机构检验的进出口商品，必须经过商检机构或者国家商检部门、商检机构指定的检验机构检验。    Article 5 Import and export commodities which are included in the List of Commodities and import and export commodities subject to inspection by the commodity inspection authorities under other laws or administrative rules and regulations must be inspected by the commodity inspection authorities? or inspection organizations designated by the State Administration for Commodity Inspection or the commodity inspection authorities.

第五条 市场和经销商应当取得营业执照等国家法律法规要求的经营食品的相关证照，其食品经营环境应当符合国家食品安全卫生的相关法律法规和标准。    Article 5 Markets and operators shall obtain relevant certificate of food business such as business license required by laws and regulations. Food business environment shall comply with relevant laws and regulations and standards of national food safety and sanitation.

第五条 国境卫生检疫机关发现检疫传染病或者疑似检疫传染病时，除采取必要措施外，必须立即通知当地卫生行政部门，同时用最快的方法报告国务院卫生行政部门，最迟不得超过二十四小时。邮电部门对疫情报告应当优先传送。    Article 5 On discovering a quarantinable infectious disease or a disease suspected to be quarantinable, a frontier health and quarantine office shall, in addition to taking necessary measures, immediately notify the local health administration department; at the same time, it shall make a report to the health administration department under the State Council by the most expeditious means possible, within 24 hours at the latest. Post and telecommunications departments shall give priority to transmissions of reports of epidemic diseases.

第五条 特许人进行信息披露应当包括以下内容：    Article 5 The information disclosed by the franchiser shall include the following:

第五条 国家鼓励和保护社会团体和个人对食品卫生的社会监督。    Article 5 The State encourages and protects the social supervision exercised by public organizations and individuals over food hygiene.

第五条国家对动物疫病实行预防为主的方针。    Article 5 The state institutes a policy of focusing on prevention of animal epidemics.

第五条 国家鼓励推行科学的质量管理方法，采用先进的科学技术，鼓励企业产品质量达到并且超过行业标准、国家标准和国际标准。对产品质量管理先进和产品质量达到国际先进水平、成绩显著的单位和个人，给予奖励。    Article 5 The State shall encourage the popularization of scientific methods in product quality control and the adoption of advanced science and technology. The State shall encourage enterprises to make their product quality meet and even surpass their respective trade standards, the national and international standards. Units and individuals that have made outstanding achievements in ensuring advanced product quality control and in raising product quality to the advanced international standards shall be awarded.

第五条国家禁止下列各物进境：    Article 5 The State shall prohibit the following objects from entering the country:

第五条 国家加强对烟草专卖品的科学研究和技术开发，提高烟草制品的质量，降低焦油和其他有害成份的含量。    Article 5 The State shall strengthen the scientific research and technical development of tobacco monopoly commodities, so as to improve the quality of tobacco products and reduce the content of tar and other hazardous ingredients in such products.

第五条 在集市经营食品必须遵守以下规定：    Article 5 Those who sell food on the fairs shall abide by the following stipulations:

第五条 卫生检疫机关发现染疫人时，应当立即将其隔离，防止任何人遭受感染，并按照本细则第八章的规定处理。    Article 5 When a quarantinable epidemic victim is discovered by the health and quarantine organ, measures must be taken promptly in accordance with the rules stipulated in Chapter VIII of these Rules to place him in isolation and prevent other persons from being infected.

第五十条 对列车或者其他车辆实施入境、出境检疫完毕后，检疫医师应当根据检疫结果分别签发入境、出境检疫证，或者在必要的卫生处理完毕后，再分别签发入境、出境检疫证。    Article 50 After completion of entry or exit quarantine inspection or necessary sanitization to the train or other vehicle, the quarantine physician is required to sign and issue an exit and entry quarantine certificate according to quarantine inspection results.

第五十条违反本法第四十二条规定，不执行凭检疫证明运输动物、动物产品的规定的，由动物防疫监督机构给予警告，责令改正；情节严重的，可以对托运人和承运人分别处以运输费用三倍以下的罚款。    Article 50 Any violator of the provisions of Article 42 of this Law who fails to implement the provisions for the shipment of animals or animal products on the strength of the quarantine certificate shall be given a warning and ordered to make corrections by the supervising agency for animal epidemic prevention. If the circumstances are serious, the consignor and the consignee may be separately fined less than three times of the freight.

第五十条 当事人对行政处罚决定不服的，可以在接到处罚通知之日起十五日内向作出处罚决定的机关的上一级机关申请复议；当事人也可以在接到处罚通知之日起十五日内直接向人民法院起诉。    Article 50 If a party is not satisfied with the decision on administrative punishment, he may, within 15 days from receipt of the notice of punishment, apply for reconsideration to the organ at the next higher level over the one that has made the decision. The party may also directly bring a suit in a People's Court within 15 days from receipt of the said notice.

第五十条 军工产品质量监督管理办法，由国务院、中央军事委员会另行制定。    Article 50 Measures for supervision and control over quality of military industrial products shall be formulated separately by the State Council and the Central Military Commission.

第五十条本法自1992年4月1日起施行。1982年6月4日国务院发布的《中华人民共和国进出口动植物检疫条例》同时废止。    Article 50 This Law shall come into force as of April 1, 1992. The Regulations of the People's Republic of China on the Import and Export Animal and Plant Quarantine promulgated by the State Council on June 4, 1982 shall be annulled simultaneously.

第五十一条 卫生行政部门违反本法规定，对不符合条件的生产经营者发放卫生许可证的，对直接责任人员给予行政处分；收受贿赂，构成犯罪的，依法追究刑事责任。    Article 51 If an administrative department of public health, in violation of this Law, issues hygiene licences to producers or marketers not meeting the requirements, the persons who are directly responsible for the offence shall be given administrative sanctions; those who accept bribes, if the cases constitutes a crime, shall be investigated for criminal responsibility in accordance with law.

第五十一条转让、涂改、伪造检疫证明的，由动物防疫监督机构没收违法所得，收缴检疫证明；转让、涂改检疫证明的，并处二千元以上五千元以下的罚款，违法所得超过五千元的，并处违法所得一倍以上三倍以下的罚款；    Article 51 If anyone transfers, alters or forges the quarantine certificate, the supervising agency for animal epidemic prevention shall confiscate the illegal gains and withdraw the quarantine certificate. Anyone who transfers or alters the quarantine certificate shall be concurrently fined not less than RMB 2,000 yuan and not more than RMB 5,000 yuan; if the illegal gains exceed RMB 5,000 yuan, the offender shall be concurrently fined not less than the amount of the illegal gains and not more than three times of that amount.

第五十一条 本法自１９９３年９月１日起施行。    Article 51 This Law shall come into force as of September 1, 1993.

第五十一条 徒步入境、出境的人员，必须首先在指定的场所接受入境、出境查验，未经卫生检疫机关许可，不准离开指定的场所。    Article 51 Those who enter or leave the country at the border on foot are required to undergo entry or exit quarantine inspection at a designated place. Without permission by the health and quarantine organ, no one may leave the designated place.

第五十二条 受入境、出境检疫的列车以及其他车辆，载有来自疫区、有染疫或者染疫嫌疑或者夹带能传播传染病的病媒昆虫和啮齿动物的货物，应当接受卫生检查和必要的卫生处理。    Article 52 Any train or vehicle, coming from pestilence area, or having been contaminated or being suspected to have been contaminated with an epidemic disease or being found to have carried goods with rodent or pests that may spread an epidemic disease, shall be required to undergo health inspection and necessary sanitization.

第五十二条 食品卫生监督管理人员，滥用职权、玩忽职守、营私舞弊、造成重大事故，构成犯罪的，依法追究刑事责任，不构成犯罪的，依法给予行政处分。    Article 52 Food hygiene supervisors and administrators who by abusing their power, neglecting their duties or engaging in malpractice for personal gain, cause a major accident, which constitutes a crime, shall be investigated for criminal responsibility in accordance with law; if the offence does not constitute a crime, the offender shall be given administrative sanctions according to law.

第五十二条违反本法第四十五条第一款规定，从事动物饲养、经营和动物产品生产、经营活动的单位的动物防疫条件不符合规定的，由动物防疫监督机构给予警告、责令改正；    Article 52 If a unit engaging in raising or marketing of animals, or production or marketing of animal products, in violation of the provisions of the first paragraph of Article 45 of this Law, fails to conform to the requirements for animal epidemic prevention, the supervising agency for animal epidemic prevention shall give a warning and order it to make corrections.

第五十三条违反本法规定，单位瞒报、谎报或者阻碍他人报告动物疫情的，由动物防疫监督机构给予警告，并处二千元以上五千元以下的罚款；    Article 53 If a unit, in violation of the provisions of this Law, conceals, falsely reports or hinders another person to report animal epidemic information, the supervising agency for animal epidemic prevention shall give a warning and concurrently impose a fine not less than RMB 2,000 yuan and not more than RMB 5,000 yuan.

第五十三条 卫生检疫机关的工作人员在实施卫生处理时，必须注意下列事项：    Article 53 While performing sanitization,the health and quarantine officers are required to see to it that:第五十三条 以暴力、威胁方法阻碍食品卫生监督管理人员依法执行职务的，依法追究刑事责任 ；拒绝、阻碍食品卫生监督管理人员依法执行职务未使用暴力、威胁方法的，由公安机关依照治安管理处罚条例的规定处罚。    Article 53 Whoever prevents, by force or intimidation, food hygiene supervisors or administrators from performing their duties according to law shall be investigated for criminal responsibility in accordance with law; whoever prevents or obstructs, without resorting to force or intimidation, food hygiene supervisors or administrators from performing their duties according to law shall be punished by the public security organs in accordance with the Regulations on Administrative Penalties for Public Security.

第五十四条违反本法规定，逃避检疫，引起重大动物疫情，致使养殖业生产遭受重大损失或者严重危害人体健康的，依法追究刑事责任。    Article 54 Any violator of the provisions of this Law who evades quarantine inspection, resulting in a serious animal epidemic which causes great losses to the breeding production or does serious harm to human health, shall be investigated for criminal responsibility according to law.

第五十四条 本法下列用语的含义：    Article 54 For the purpose of this Law, the definitions of the following terms are:

第五十四条 入境、出境的集装箱、行李、货物、邮包等物品需要卫生处理的，由卫生检疫机关实施。    Article 54 The sanitization that exit or entry containers, luggage, goods or postal parcels are required to undergo shall be conducted by the health and quarantine organ.

第五十五条 由国外起运经中华人民共和国境内的货物，如果不在境内换装，除发生在流行病学上有重要意义的事件，需要实施卫生处理外，在一般情况下不实施卫生处理。    Article 55 Goods that are shipped from abroad and are only passing through the People's Republic of China, shall, if there is no transshipment, be exempted from sanitization except in cases where events of epidemiological significance have taken place.

第五十五条动物检疫员违反本法规定，对未经检疫或者检疫不合格的动物、动物产品出具检疫证明、加盖验讫印章的，由其所在单位或者上级主管机关给予记过或者撤销动物检疫员资格的处分；情节严重的，给予开除的处分。    Article 55 If any animal quarantine officer, in violation of the provisions of this Law, issues the quarantine certificate and affixes the inspection mark on animals or animal products having not undergone quarantine inspection or having not passed quarantine inspection, the unit to which he belongs or the competent authority at the next higher level shall give him a demerit or disqualify him as an animal quarantine officer. If the circumstances are serious, the offender shall be discharged from his office.

第五十五条 出口食品的管理办法，由国家进出口商品检验部门会同国务院卫生行政部门和有关行政部门另行制定。    Article 55 Measures for the administration of food for export shall be formulated separately by the national import and export commodities inspection department in conjunction with the administrative department of public health and other relevant administrative departments under the State Council.

第五十六条 卫生检疫机关对入境、出境的废旧物品和曾行驶于境外港口的废旧交通工具，根据污染程度，分别实施消毒、除鼠、除虫，对污染严重的实施销毁。    Article 56 According to the extent of contamination, the health and quarantine organ shall exercise disinfectization, deratization or insectization respectively to the used materials waiting for entry or exit and to the used transportation vehicles that were in operation at foreign ports. In case of serious contamination, the used materials or vehicles shall be destroyed.

第五十六条动物防疫监督工作人员滥用职权，玩忽职守，徇私舞弊，隐瞒和延误疫情报告，伪造检疫结果，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。    Article 56 Any supervisor of animal epidemic prevention who abuses powers, neglects duties, commits malpractices for selfish gains, conceals or delays the report on epidemic situations, or forges quarantine inspection results, if a crime has been constituted, shall be investigated for criminal responsibility according to law. If a crime has not been constituted, the offender shall be imposed administrative sanctions.

第五十六条 军队专用食品和自供食品的卫生管理办法由中央军事委员会依据本法制定。    Article 56 Hygiene control measures for food specially used or supplied for its own use by the Army shall be formulated by the Central Military Commission in accordance with this Law.

第五十七条 入境、出境的尸体，骸骨托运人或者代理人应当申请卫生检疫，并出示死亡证明或者其他有关证件，对不符合卫生要求的，必须接受卫生检疫机关实施的卫生处理。    Article 57 Prior to the entry or exit of human remains or ashes, the shipper or the agent is required to apply for health and quarantine inspection and to present a certificate of cause of death or other related documents. If it fails to meet the hygiene requirements, it is required to undergo sanitization by the health and quarantine organ.

第五十七条 本法自公布之日施行。《中华人民共和国食品卫生法（试行）》同时废止。    Article 57 This Law shall come into force as of the date of promulgation. The Food Hygiene Law of the People's Republic of China (for tial implementation) shall be unnulled on the same date

第五十七条阻碍动物防疫监督工作人员依法执行职务，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予治安管理处罚。    Article 57 Whoever hinders a supervisor of animal epidemic prevention in the performance of duties according to law shall, if a crime has been constituted, be investigated for criminal responsibility according to law. If a crime has not been constituted, the offender shall be imposed administrative penalty for public security violations according to law.

第五十八条 卫生检疫机关对已在到达本口岸前的其他口岸实施卫生处理的交通工具不再重复实施卫生处理。但有下列情形之一的，仍需实施卫生处理。    Article 58 In the case that a conveyance has previously undergone sanitization at another port, it is not necessary to conduct sanitization again upon its arrival unless any one of the following circumstances applies:

第五十八条本法自１９９８年１月１日起施行。    Article 58 This Law comes into effect as of January 1, 1998.

第五十九条 在国境口岸或者交通工具上发现啮齿动物有反常死亡或者死因不明的，国境口岸有关单位或者交通工具的负责人，必须立即向卫生检疫机关报告，迅速查明原因，实施卫生处理。    Article 59 In the case when any rodent is found to have died of unusual or unknown cause either at the border port or on the conveyance, the border port authorities or the captain of the conveyance is required to the health and quarantine organ about the case without delay so that prompt examination and sanitization can be carried out.

第六条 特许人应当在与中国境内的被特许人首次订立特许经营合同之日起的15天内向备案机关申请备案。    Article 6 A franchiser shall apply for archival filing with an archiving organ within 15 days after having concluded a franchise contract with the franchisee within the territory of China for the first time.

第六条 禁止在集市经营下列食品：    Article 6 Dealing in the following food items on the fairs is prohibited:

第六条 食品应当无毒、无害、符合应当有的营养要求，具有相应的色、香、味等感官性状。    Article 6 Food shall be nontoxic and harmless, conform to proper nutritive requirements and have appropriate sensory properties such as colour, fragrance and taste.

第六条 卫生检疫机关应当阻止染疫人、染疫赚疑人出境，但是对来自国外并且在到达时接受就地诊验的人，本人要求出境的，可以准许出境；如果乘交通工具出境，检疫医师应当将这种情况在出境检疫证上签注，同时通知交通工具负责人采取必要的预防措施。    Article 6 Health and quarantine organs are required to bar any quarantinable epidemic victims or suspects from exit, with the exception of those who come from abroad and have undergone on-site clinical checked up on arrival. These persons can leave the port if they wish to; if they leave in conveyance, quarantine physicians are required to annotate and comment on their Exit Quarantine Certificates and to inform the person in charge of the conveyance to take the necessary precautionary measures.

第六条国外发生重大动植物疫情并可能传入中国时，国务院应当采取紧急预防措施，必要时可以下令禁止来自动植物疫区的运输工具进境或者封锁有关口岸；    Article 6 In the event that a serious animal or plant epidemic occurs abroad and is liable to spread into the country, the State Council shall adopt emergent preventive measures and may, when necessary, issue orders to prohibit means of transport from animal or plant epidemic areas from entering the country or to blockade the relevant ports;

第六条 商检机构实施进出口商品检验的内容，包括商品的质量、规格、数量、重量、包装以及是否符合安全、卫生要求。法律、行政法规规定有强制性标准或者其他必须执行的检验标准的进出口商品，依照法律、行政法规规定的检验标准检验；法律、行政法规未规定有强制性标准或者其他必须执行的检验标准的，依照对外贸易合同约定的检验标准检验。    Article 6 Inspection on import and export commodities performed by the commodity inspection authorities shall cover quality, specifications, quantity, weight, packing and the requirements for safety and hygiene. Import and export commodities governed by compulsory standards or other inspection standards which must be complied with as provided for by laws or administrative rules and regulations shall be inspected in accordance with such inspection standards; in the absence of such stipulations, import and export commodities shall be inspected in accordance with the inspection standards agreed upon in the foreign trade contracts.

第六条 市场应当设立负责食品安全的管理部门或配备食品安全管理人员，监控本市场的食品安全状况。    Article 6 Market shall set up management departments in charge of food safety or have executive personnel of food safety, so as to supervise food safety status of markets.

第六条国务院畜牧兽医行政管理部门主管全国的动物防疫工作。    Article 6 The animal husbandry and veterinary administrative department under the State Council shall be in charge of animal epidemic prevention throughout the country.

第六条 国务院产品质量监督管理部门负责全国产品质量监督管理工作。国务院有关部门在各自的职责范围内负责产品质量监督管理工作。    Article 6 The department in charge of supervision and control over product quality under the State Council shall be responsible for nation-wide supervision and control over product quality. The relevant departments under the State Council shall be responsible for supervision and control over product quality within the scope of their respective functions and responsibilities.第六条 特许人在推广、宣传活动中，不得有欺骗、误导的行为，其发布的广告中不得含有宣传单个被特许人从事特许经营活动收益的内容。    Article 6 The franchiser may not have any cheating and misleading practices in the promotion activities, and the advertisement may not include the content about the individual franchisee's profit from the franchise activities.

第六条 国家在民族自治地方实行烟草专卖管理，应当依照本法和民族区域自治法的有关规定，照顾民族自治地方的利益，对民族自治地方的烟叶种植和烟草制品生产给予照顾。    Article 6 The State shall exercise administration of tobacco monopoly in national autonomous areas, and shall, according to the relevant provisions of this Law and the Law on Regional National Autonomy, take the interests of national autonomous areas into account and give preferential treatment to the plantation of leaf tobacco and the production of tobacco products in such areas.

第六条 在国外或者国内有检疫传染病大流行的时候，国务院可以下令封锁有关的国境或者采取其他紧急措施。    Article 6 When a quarantinable infectious disease is prevalent abroad or within China, the State Council may order relevant sections of the border to be blockaded or adopt other emergency measures.

第六十条 国际航行船舶的船长，必须每隔6个月向卫生检疫机关申请一次鼠患检查，卫生检疫机关根据检查结果实施除鼠或者免予除鼠，并且分别发给除鼠证书或者免予除鼠证书。该证书自签发之日起6个月内有效。    Article 60 The captain of a ship of international voyage is required to apply to the health and quarantine organ for inspection of rat damage every 6 months. The health and quarantine organ shall exercise deratization or dispense with deratization according to the result of the inspection and issue a certificate of deratization or a deratization laissez-passer which shall be valid for 6 months from the day it is issued.

第六十一条 卫生检疫机关只有在下列之一情况下，经检查确认船舶无鼠害的，方可签发免于除鼠证书：    Article 61 Only under any one of the following circumstances shall the health and quarantine organ issue a certificate of exemption of deratization after making sure that the vessel is free of rodents:

第六十二条 对船舶的鼠患检查或者除鼠，应当尽量在船舶空舱的时候进行。如果船舶因故不宜按期进行鼠患检查或者蒸熏除鼠，并且该船又开往便于实施鼠患检查或者蒸熏除鼠的港口，可以准许该船原有的除鼠证书或者免予除鼠证书的有效期延长1个月，并签发延长证明。    Article 62 Normally the inspection of rat-damage or deratization shall be carried out while the hold is bare. If the vessel can not undergo rat-damage inspection or deratization by means of steam sterilization in due time owing to some reason or other, and it is sailing towards a port convenient for inspection or deratization, he term of validity of deratization certificate or the deratization laissez-passers the vessel is holding may be extended for one month, and the extended certificate may be issued.

第六十三条 对国际航行的船舶，按照国家规定的标准，应当用蒸熏的方法除鼠时，如果该船的除鼠证书或者免予除鼠证书尚未失效，除该船染有鼠疫或者鼠疫嫌疑外，卫生检疫机关应当将除鼠理由通知船长。船长应当按照要求执行。    Article 63 In the situation when the deratization certificate or the deratization laissez-passer of a vessel is still valid, but the vessel is found to have caught the plague or is suspected to have caught the plague, the health and quarantine organ must inform the captain that his vessel is required to undergo deratization by means of steam sterilization in accordance with the standard set by the state, and the captain must act as required.

第六十六条 国务院卫生行政部门认为必要时，可以要求来自国外或者国外某些地区的人员负在入境时，向卫生检疫机关出示有效的某种预防接种证书或者健康证明。    Article 66 When necessary, the health administrative department under the State Council shall order the health and quarantine organs to check the valid certificate of certain preventive inoculation or health certificate of the persons upon their arrival at the entry port from abroad or from certain regions.

第六十七条 预防接种的有效期如下：    Article 67 Term of validity of preventive inoculation are as follows:

第六十八条 鼠疫的潜伏期为6日。    Article 68 Incubation period of the plague is 6 days.

第六十九条 船舶、航空器在到达时，有下列情形之一的，为染有鼠疫：    Article 69 Under any one of the following circumstances, a vessel or an aircraft, upon its arrival, shall be considered as having been contaminated with the plague:

第七条 特许人向被特许人披露信息前，有权要求被特许人签署保密协议。    Article 7 Before the franchiser discloses information to the franchisee, the former has the right to require the latter to sign Non-Disclosure Agreement.

第七条 本法所称烟叶是指生产烟草制品所需的烤烟和名晾烟，名晾烟的名录由国务院烟草专卖行政主管部门规定。    Article 7 For the purpose of this Law, the term ""leaf tobacco"" means flue-cured tobacco and selected air- and sun-cured tobacco needed for the production of tobacco products. The catalogue of selected air-and sun-cured tobacco items shall be determined by the department of tobacco monopoly administration under the State Council.

第七条 法律、行政法规规定由其他检验机构实施检验的进出口商品或者检验项目，依照有关法律、行政法规的规定办理。    Article 7 Import and export commodities or items subject to inspection by other inspection organizations under laws or administrative rules and regulations shall be inspected in accordance with the provisions of relevant laws or administrative rules and regulations.

第七条 市场应当建立以下管理制度：    Article 7 Market shall set up the following managerial systems:

第七条各级人民政府应当加强对动物防疫工作的领导。    Article 7 People’s governments at all levels shall strengthen the leadership over animal epidemic prevention.

第七条 入境的交通工具和人员，必须在最先到达的国境口岸的指定地点接受检疫。    Article 7 Persons and conveyances on entering the country shall be subject to quarantine inspection at designated places at the first frontier port of their arrival.

第七条 专供婴幼儿的主、辅食品，必须符合国务院卫生行政部门制定的营养、卫生标准。    Article 7 Principal and supplementary foods intended specially for infants and preschool children shall conform to the nutritive and hygienic standards promulgated by the administrative department of public health under the State Council.

第七条 因不符合新鲜销售卫生要求而不能直接销售的水产、肉类等食品，经食品卫生检查人员或者食品卫生监督员指导加工后，符合卫生要求的可以出售。    Article 7 The food items such as aquatic products, meat and other products which are not allowed to be directly sold because they do not meet the hygiene requirements for being sold fresh may be sold after they have been processed under the guidance of the food hygiene inspectors or food hygiene supervisors and have met the hygiene requirements.

第七条 产品质量应当检验合格，不得以不合格产品冒充合格产品。    Article 7 The quality of a product shall be inspected and proved to be up to the standards. No sub-standard product shall be passed off as a product up to the standards.

第七条国家动植物检疫机关和口岸动植物检疫机关对进出境动植物、动植物产品的生产、加工、存放过程，实行检疫监督制度。    Article 7 The State animal and plant quarantine department and port animal and plant quarantine offices shall practise a quarantine supervision system in relation to the procedures in the production, processing and storage of animals and plants and their products for entry or exit.

第七条 在国境口岸以及停留在该场所的入境、出境交通工具上，所有非因意外伤害而死亡并死因不明的尸体，必须经卫生检疫机关查验，并签发尸体移运许可证后，方准移运。    Article 7 When a death due to an unidentified cause other than accidental harm is discovered at a frontier port, the corpse shall be subject to quarantine inspection and only after an entry or exit permit is granted can the corpse be removed.

第七条 特许人的备案信息有变化的，应当自变化之日起30日内向备案机关申请变更。    Article 7 Where there is any alteration in the archival information of a franchiser, the franchiser shall apply for alteration with the archiving organ within 30 days from the date the alteration occurs.第七十条 船舶在到达时，有下列情形之一的，为染有鼠疫嫌疑：    Article 70 Under any one of the following circumstances, the vessel shall e considered as being suspected to have caught the plague:

第七十二条 对染有鼠疫嫌疑的船帕，应当实施本细则第七十一条第 (二)至第(六)项规定的卫生处理。    Article 72 The vessel that is suspected of having caught the plague shall undergo sanitization as stipulated in Items 2 to 6 of Article 71 of these Implementation Rules.

第七十三条 对没有染疫的船舶、航空器，如果来自鼠疫疫区，卫生检疫机关认为必要时，可以实施下列卫生处理：    Article 73 The health and quarantine organ may, when it deems necessary, take the following sanitization measures to the vessel or aircraft coming from the plague prevalent area but free from contamination:

第七十四条 对到达的时候载有鼠疫病例的列车和其他车辆，应当实施下列卫生处理：    Article 74 Upon arrival, a train or other motor vehicle on which any plague case is found shall undergo sanitization as follows:

第七十五条 霍乱潜伏期为5日。    Article 75 Incubation period of cholera is 5 days.

第七十六条 船舶在到达的时候载有霍乱病例，或者在到达前5日以内，船上曾经有霍乱病例发生，为染有霍乱。船舶在航行中曾经有霍乱病例发生，但是在到达前5日以内，没有发生新病例，为染有霍乱嫌疑。    Article 76 A vessel shall be considered as having been contaminated with cholera when any cholera case is found on board upon its arrival or there were cholera cases on board within 5 days before its arrival. The vessel shall be suspected of having been contaminated with cholera if there were cholera

航空器在航行中曾经有霍乱病例发生，但在到达以前该病员已经离去，为染有霍乱嫌疑。    Article 77 The aircraft shall be considered as having been contaminated with cholera if there is any cholera case on board. The aircraft shall be suspected of having been contaminated with cholera if there were cholera cases on board during the flight but the cases have left the aircraft before arrival.

第七十八条 对染有霍乱的船舶、航空器，应当实施下列卫生处理：    Article 78 The vessel or aircraft contaminated with cholera is required to undergo sanitization as follows:

第七十九条 对染有霍乱嫌疑的船舶、航空器应当实施下列卫生处理。    Article 79 The vessel or aircraft that is suspected of having been contaminated with cholera is required to undergo sanitization as follows:

第八条 特许人应当在每年3月31日前将其上一年度订立、撤销、续签与变更的特许经营合同情况向备案机关报告。    Article 8 A franchiser shall report to the archiving organ the information on the signing, canceling, renewing and altering of franchise contract prior to March 31 every year.

第八条 特许人在向被特许人进行信息披露以后，被特许人应当就所获悉的信息内容向特许人出具回执说明（一式两份），由被特许人签字，一份由被特许人留存，另一份由特许人留存。    Article 8 After the franchiser discloses information to the franchisee, the franchisee shall provide the franchiser with a return receipt in duplicate, after the franchisee signs the receipt, each party retains one copy.

第八条 烟草种植应当因地制宜地培育和推广优良品种。    Article 8 In growing tobacco, good varieties of tobacco shall be cultivated and popularized in line with the local conditions.

第八条食品生产经营过程必须符合下列卫生要求    Article 8 In the process of food production or marketing, the requirements for hygiene stated below shall be conformed to:

第八条 可能危及人体健康和人身、财产安全的工业产品，必须符合保障人体健康、人身、财产安全的国家标准、行业标准；未制定国家标准、行业标准的，必须符合保障人体健康，人身、财产安全的要求。    Article 8 Industrial products constituting possible threats to the health or safety of human life and property must be in compliance with the national standards and trade standards safeguarding the health or safety of human life and property; In the absence of such national standards or trade standards, the product must meet the requirements for safeguarding the health or safety of human life and property.

第八条 鼓励市场申请绿色市场认证，并使用相应的认证标志。    Article 8 Markets are encouraged to apply for green market attestation and use relevant certificate symbols.

第八条 出境的交通工具和人员，必须在最后离开的国境口岸接受检疫。    Article 8 Persons and conveyances exiting the country shall be subject to quarantine inspection at the last frontier port of departure.

第八条 违反本规定第五条、第六条的，由集市举办者制止其出售和转移，并及时报告工商行政管理部门或者卫生行政部门进行处理。    Article 8 The fair organizers must stop those who violate the provisions of Articles 5 and 6 of the present Provisions from selling and moving away the food items involved, and must report the cases without delay to the industrial and commercial administrative departments or the public health administrative departments for disposal.

第八条口岸动植物检疫机关在港口、机场、车站、邮局执行检疫任务时，海关、交通、民航、铁路、邮电等有关部门应当配合。    Article 8 When a port animal and plant quarantine office is carrying out its tasks of quarantine inspection in seaports, airports, railway or coach stations, or post offices, relevant departments such as the Customs, departments of communications, civil aviation, or railways, and postal services shall coordinate therewith.

第八条 来自国内疫区的交通工具，或者在国内航行中发现检疫传染病，疑似检疫传染病，或者有人非因意外伤害而死亡并死因不明的，交通工具负责人应当向到达的国境口岸卫生检疫机关报告，接受临时检疫。    Article 8 When a quarantine infectious disease or a disease suspected to be quarantinable or a death due to an unidentified cause other than accidental harm is discovered on conveyance from a domestic pestilence area or in the course of a domestic voyage, the persons in charge of the conveyance are required to make a report to the health and quarantine organ on arrival at the frontier port and undergo preliminary quarantine inspection.

第八十条 对没有染疫的船舶、航空器，如果来自霍乱疫区，卫生检疫机关认为必要时，可以实施下列卫生处理：    Article 80 The vessel or aircraft coming from a cholera prevalent but free from contamination may undergo sanitization as follows if the health and quarantine organ thinks it necessary:

第八十一条 对到达时载有霍乱病例的列车和其他车辆应当实施下列卫生处理：    Article 81 Upon arrival, the train or other vehicle on which any cholera case is found is required to undergo sanitization as follows:

第八十二条 对来自霍乱疫区的或者染有霍乱嫌疑的交通工具，卫生检疫机关认为必要时，可以实施除虫、消毒；如果交通工具载有水产品、水果、蔬菜、饮料及其他食品，除装在密封容器内没有被污染外，未经卫生检疫机关许可，不准卸下，必要时可以实施卫生处理。    Article 82 The conveyance coming from a cholera prevalent area or suspected of having been contaminated with cholera shall undergo disinsectization and disinfection if the health and quarantine organ thinks it necessary. If the conveyance carries aquatic products, fruit, vegetables, drinks or other food, no unloading shall be allowed without the permission by the health and quarantine organ. When necessary, they have to undergo sanitization, with the exception of those food canned in air-tight containers and free from contamination.第八十三条 对来自霍乱疫区的水产品、水果、蔬菜、饮料以及装有这些制品的邮包，卫生检疫机关在查验时，为了判明是否被污染，可以抽样检验，必要时可以实施卫生处理。    Article 83 During inspection on the aquatic products, fruit, vegetable, drinks or postal parcels containing such food shipped from a cholera prevalent area, the health and quarantine organ shall exercise sample examination in order to determine whether the food has been contaminated, when necessary, sanitization of the food shall be conducted.

第八十四条 黄热病的潜伏期为6日。    Article 84 Incubation period of yellow fever is 6 days.

第八十五条 来自黄热病疫区的人员，在入境时，必须向卫生检疫机关出示有效的黄热病预防接种证书。    Article 85 People coming from a yellow fever prevalent area are required to present valid certificate of inoculation against yellow fever to the health and quarantine organ upon entry.

第八十六条 航空器到达时载有黄热病病例，为染有黄热病。    Article 86 An aircraft shall be considered as having been contaminated with yellow fever when yellow fever cases are found on board upon its arrival.

第八十七条 来自黄热病疫区的航空器，应当出示在疫区起飞前的灭蚊证书；如果在到达时不出示灭蚊证书，或者卫生检疫机关认为出示的灭蚊证书不符合要求，并且在航空器上发现活蚊，为染有黄热病嫌疑。    Article 87 An aircraft coming from a yellow fever prevalent area is required to present disinsectization certificate issued before the flight. If it fails to present the disinfectization certificate, or the health and quarantine organ considers that the certificate is not up to the requirements and live mosquitoes are found inside the aircraft, then the aircraft shall be suspected of having been contaminated with yellow fever.

第八十八条 船舶在到达时载有黄热病病例，或者在航行中曾经有黄热病病例发生，为染有黄热病。    Article 88 A vessel shall be considered as having been contaminated with yellow fever when yellow fever cases are found on board upon arrival or there were yellow fever cases on board during the voyage.

第八十九条 对染有黄热病的船舶、航空器，应当实施下列卫生处理：    Article 89 A vessel or an aircraft contaminated with yellow fever is required to undergo sanitization as follows:

第九条 特许人应认真填写所有备案事项的信息，并确保所填写内容真实、准确和完整。    Article 9 A franchiser shall fill in all the information on archival filing, and ensure the authenticity, accuracy and completeness of the content filled.

第九条动植物检疫机关检疫人员必须忠于职守，秉公执法。    Article 9 Any quarantine functionary of an animal and plant quarantine organ must be devoted to his or her duties and enforce the law impartially.

第九条在动物防疫工作、动物防疫科学研究中做出成绩和贡献的单位和个人，由人民政府或者畜牧兽医行政管理部门给予奖励。    Article 9 Any unit or individual that has made achievements or contributions in animal epidemic prevention or scientific research on animal epidemic prevention shall be rewarded by the people’s government or the animal husbandry and veterinary administrative department.

第九条 本法规定必须经商检机构检验的进口商品的收货人，必须向卸货口岸或者到达站的商检机构办理进口商品登记。    Article 9 For import commodities which are subject to inspection by the commodity inspection authorities in accordance with this Law, the consignee must register them with the commodity inspection authorities located at the port of discharge or the station of arrival.

第九条 特许人隐瞒应当披露而没有披露的信息或者披露虚假信息的，被特许人可以解除特许经营合同。    Article 9 If the franchiser hides the information that shall be disclosed or discloses false information, the franchisee may rescind the franchise contract.

第九条 在国内或者国外检疫传染病大流行的时候，国务院卫生行政部门应当立即报请国务院决定采取下列检疫措施的一部或者全部：    Article 9 In times when quarantinable infectious diseases are prevailing at home or abroad, the administrative department of health under the State Council shall report the situation to the State Council for decisions on taking the following precautionary measures, partially or totally, in quarantine inspection:

第九条 烟叶收购计划由县级以上地方人民政府计划部门根据国务院计划部门下达的计划下达，其他单位和个人不得变更。    Article 9 Leaf tobacco purchasing plans shall be assigned by the planning departments of the local people's governments at or above the county level on the basis of the plans assigned by the planning department under the State Council. No other organizations or individuals shall make any modifications thereto.

第九条 市场现场制作食品、散装食品及生鲜食品销售应当具备保障食品安全的设施设备和条件，远离污染源，并符合国家有关食品安全标准。    Article 9 Relevant food safety facilities and conditions are required for sales of food of field fabrication sales, bulk sales and frozen and fresh food. These foods shall be away form contaminant and comply with national safety standards of relevant foods.

第九条 禁止生产经营下列食品：    Article 9 The production and marketing of foods in the following categories shall be prohibited:

第九条 国家根据国际通用的质量管理标准，推行企业质量体系认证制度。企业根据自愿原则可以向国务院产品质量监督管理部门或者国务院产品质量监督管理部门授权的部门认可的认证机构申请企业质量体系认证。经认证合格的，由认证机构颁发企业质量体系认证证书。    Article 9 The State shall, in compliance with the international quality control standards in general use, practise a rule of authentication for enterprise quality system. an enterprise may on voluntary basis apply to the department in charge of supervision and control over product quality under the State Council or an authentication agency approved by a department authorized by the department in charge of supervision and control over product quality under the State Council for authentication of enterprise quality system. With respect to the enterprise which has passed the authentication, the authentication agency shall issue an authentication certificate of enterprise quality system.

第九条 违反本规定，造成食物中毒事故或者其他食源性疾患的，应当负损害赔偿责任。    Article 9 Those who have caused food poisoning or other food-borne diseases in violation of the stipulations of the present Provisions shall be held liable for damages.

第九条 来自国外的船舶、航空器因故停泊、降落在中国境内非口岸地点的时候，船舶、航空器的负责人应当立即向就近的国境卫生检疫机关或者当地卫生行政部门报告。    Article 9 When foreign ships or airborne vehicles anchor or land at places other than frontier ports in China, the persons in charge of the ships or airborne vehicles must report immediately to the nearest frontier health and quarantine office or to the local health administration department.

第九十条 对染有黄热病嫌疑的船舶、航空器，应当实施本细则第八十九条第(二)至第(四)项规定的卫生处理。    Article 90 The vessels or aircraft suspected of having been contaminated with yellow fever are required to undergo sanitization as stipulated in Items 2, 3 and 4 of Article 89 of these Implementation Rules.

第九十一条 对没有染疫的船舶、航空器，如果来自黄热病疫区，卫生检疫机关认为必要时，可以实施本细则第八十九条第(三)项规定的卫生处理。    Article 91 The vessel or aircraft coming from a yellow fever prevalent area but free from contamination may undergo sanitization as stipulated in Item 3 of Article 89 of these Implementation Rules if the health and quarantine organ considers it necessary.

第九十二条 对到达的时候载有黄热病病例的列车和其他车辆，或者来自黄热病疫区的列车和其他车辆，应当实施本细则第八十九条第(一)、第(四)项规定的卫生处理；对列车、车辆彻底杀灭成蚊及其虫卵、幼虫；对无有效黄热病预防接种证书的员工、旅客，应当实施本细则第八十五条规定的卫生处理。    Article 92 A train or other vehicle on which yellow fever cases are found on board upon arrival, or a train or other vehicle coming from the yellow fever prevalent area must undergo sanitization as stipulated in Items 1 and 4 of Article 89 of these Implementation Rules; adult mosquitoes, their eggs and larvae on board must be annihilated; the crew members and passengers without valid certificate of inoculation against yellow fever are required to undergo sanitization as stipulated in Article 85 of these Implementation Rules.

第九十三条 卫生检疫机关对受就地诊验的人员，应当发给就地诊验记录簿，必要的时候，可以在该人员出具履行就地诊验的保证书以后，再发给其就地诊验记录簿。    Article 93 The health and quarantine organ is required to issue a casebook to the person taking on-site clinical check-up. If necessary, the casebook shall be issued to the person after he/she has presented a guarantee for such check-up.

第九十四条 卫生检疫机关应当将受就地诊验人员的情况，用最快的方法通知受就地诊验人员的旅行停留地的卫生检疫机关或者其他医疗卫生单位。    Article 94 The health and quarantine organ must inform by the quickest means the health and quarantine organ or the medical and health unit in places where the person subject to on-site clinical check-up will stop over on his journey of his condition.

第九十五条 受留验的人员必须在卫生检疫机关指定的场所接受留验；但是有下列情形之一的，经卫生检疫机关同意，可以在船上留验。    Article 95 The person subject to on-site clinical check-up detention is required to have medical examination at the designated place. In any on of the following circumstances, the detention for medical check-up may be carried out on the vessel, with permission by the health and quarantine organ:第九十六条 受留验的人员在留验期间如果出现检疫传染病的症状，卫生检疫机关应当立即对该人员实施隔离。对与其接触的其他受留验的人员，应当实施必要的卫生处理，并且从卫生处理完毕时算起，重新计算留验时间。    Article 96 During his period of detention check-up,if the person has shown symptoms of a quarantinable epidemic disease, he must be isolated by the health and quarantine organ without delay.The other people subject to check-up detention with him are required to undergo necessary sanitization and the term of detention shall be counted from the time the sanitization is carried out.

第九十七条 入境、出境的交通工具、人员、食品、饮用水和其他物品以及病媒昆虫、动物，均为传染病监测的对象。    Article 97 Entry or exit conveyances, people, food, drinking water and other articles as well as causitive pests, animals are all subject to epidemic disease(s)monitoring.

第九十八条 传染病监测内容是：    Article 98 Epidemic disease monitoring shall cover:

第九十九条 卫生检疫机关应当阻止所发现的患有艾滋病、性病、麻风病、精神病、开放性肺结核的外国人入境。    Article 99 The health and quarantine organ should bar foreigners who are victims of AIDS, venereal disease, leprosy, psychosis, open tuberculosis from entry.

在本通知发布前已批准的，要督促其限期改正，到期仍不能改正的，取消其加工贸易生产经营资格。    as for any such enterprise approved prior to the issuance of the present Circular, the competent commerce department shall urge it to correct within a fixed time limit, where it fails to do so, the competent commerce department shall cancel its qualification for engaging in processing trade business.

但对第八章规定以外的其他病种染疫嫌疑人，可以从该人员离开感染环境的时候算起，实施不超过该传染病最长潜伏期的就地诊验或者留验以及其他的卫生处理。    As for those suspects suffering from contagious diseases other than plague, cholera and yellow fever as defined in Chapter VIII of these Rules, they shall be subject to on-site clinical check-up or check-up detention as well as other measures of sanitization for a period of time not exceeding the longest incubation period of that contagious counting from the day they left the infected environment.

本法所称烟草专用机械是指烟草专用机械的整机。    As used in this Law, the term ""cigarette manufacturing equipment"" means a complete set of equipment for cigarette manufacturing.
