（一）机电产品进口申请表（见附件1）；    (1)An application form of import of mechanical and electronic products (see appendix 1);

（二）营业执照复印件    (2)A duplicate of the business license;

（二）申请可通过书面形式或网上申请方式提交。    (2)Applications can be submitted in written forms or online.

（四）以欺骗或者其他不正当手段获取机电产品进口证件；    (4)Acquirement of certificates for import of mechanical and electronic products by cheat or other illegal manners.

（六）未按法定程序申请进口；    (6)Application for import does not go through legal procedures;

（二）、发电厂、变电所外各种专用管道（沟）、水井、泵站、冷却水塔、油库、堤坝、铁路、道路、桥梁、码头、燃料装卸设施、避雷针、消防设施及附属设施；    2. All kinds of special pipes and conduits (ditches), ash storage sites, wells, pumping stations, water cooling towers, oil depots, dikes and dams, railways, roads, bridges, docks, fuel loading and unloading equipment, lightening arresters, fire-fighting equipment and other related ancillary equipment outside power plants and power transformation stations.

1、进口国家实行强制性认证的机电产品的，应提供《中国国家强制性产品认证证书》或《免予办理强制性产品认证证明》；    a.?The China Compulsory Certification or the Certificate of Exemption of China Compulsory Certification shall be provided if the mechanical and electronic products to be imported are subject to state compulsory certification.

1、书面申请程序：申请进口单位可到发证机构领取或从商务部授权网站（http://www.chinabidding.com/）下载（可复印）《机电产品进口申请表》，与其他相关书面材料一并提交到相应的主管机构。    a.?Written application procedures: entities applying for import can obtain the Application Form for Import of Mechanical and Electronic Products (copyable) from issuance agencies or download it from the website authorized by the MOFCOM (http://www.chinabidding.com/), and submit it with other relevant written materials to corresponding competent authorities.

违反本规定，安装空调设备擅自改变房屋承重结构，影响房屋安全的，由规划管理部门依照城市规划管理的有关规定予以处罚。    Acts of altering weight-bearing structure of buildings without authorization when installing air-conditioning equipment in violation of these Provisions and jeopardizing the safety of buildings shall be penalized by the planning administrative departments in accordance with the relevant regulations of the urban planning administration.

各级规划、市政、房地、公安、工商和电力管理部门应当根据各自的职责，协同环境保护部门实施本规定。    Administrative departments at all levels of planning, municipal administration, real estate, public security, industry and commerce, and electric power shall, in accordance with their respective functions, cooperate with the environmental protection departments in the implementation of these Provisions.

在电力设施周围进行爆破及其他可能危及电力设施安全的作业的，应当按照国务院有关电力设施保护的规定，经批准并采取确保电力设施安全的措施后，方可进行作业。    Any explosion operations that are conducted in the vicinity of power facilities, and other work that might endanger the safety of power facilities, shall be in accordance with regulations of the State Council concerning the protection of power facilities, conducted only after approval and definite measures for ensuring the safety of the power facilities are taken.

电力企业职工故意延误电力设施抢修或者抢险救灾供电，造成严重后果的，比照刑法第一百一十四条的规定追究刑事责任。    Any staff member or employee of an electric power enterprise who intentionally delays urgent repair and maintenance on electric power facilities or delays power supply for rescue and relief work and thereby causes serious consequences, shall be prosecuted for criminal liability according to the provisions of Article 114 of the Criminal Law.

附：刑法有关条款    Appendix: Related Articles of the Criminal Law

申请新装用电、临时用电、增加用电容量、变更用电和终止用电，应当依照规定的程序办理手续。    Applications for new electricity utilization, temporary electricity utilization, increases in capacity of electricity utilization, as well as alteration and termination of electricity utilization shall accomplish the procedure as stipulated.

第一条（制定目的和依据）为了保护生活环境，维护城市市容，保障交通畅通、公共安全和人体健康，根据《上海市环境保护条例》和其他有关法律、法规，结合本市实际情况，制定本规定。    Article 1 Purpose and Basis With a view to protecting the living environment, maintaining the city appearance, and ensuring smooth traffic, public security and human health, these Provisions are formulated in accordance with the Regulations of Shanghai Municipality on Environmental Protection and other relevant laws and regulations, and in light of the actual circumstances of this Municipality.

第一条 为了保障和促进电力事业的发展，维护电力投资者、经营者和使用者的合法权益，保障电力安全运行，制定本法。    Article 1 This law is formulated to guarantee and promote the development of the electric power industry, to safeguard the legal rights and interests of investors, operators and users of electric power, and to maintain the safe operation of electric power.

第一条 为保障电力生产和建设的顺利进行，维护公共安全，特制定本条例。    Article 1 This set of regulations is formulated with a view to ensuring the smooth-going of power production and construction and a sure protection to public security.

第一条为促进对外贸易健康发展，贯彻国家产业政策，维护市场秩序，依据《中华人民共和国对外贸易法》、《中华人民共和国海关法》及《中华人民共和国货物进出口管理条例》等相关法律、行政法规，制定本办法。    Article 1 With a view to boost sound development of foreign trade, implement state industrial policies and maintain market order, these measures are formulated in accordance with relevant laws and administrative regulations including the Foreign Trade Law of The People’s Republic of China and the Regulation of the People’s Republic of China on the Administration of the Import and Export of Goods.

第一条　为维护国家安全、社会公共利益，保护人的健康或者安全，保护动物、植物的生命或者健康，保护环境，依据《中华人民共和国对外贸易法》、《中华人民共和国进出口商品检验法》、《中华人民共和国行政许可法》、《中华人民共和国海关法》以及《中华人民共和国货物进出口管理条例》、《中华人民共和国进出口商品检验法实施条例》等相关法律和行政法规，制定本办法。    Article 1 With a view to maintaining state security and public interests, to protect health or safety of human, life or heath of fauna and flora and environment, these measures are formulated in accordance with the Foreign Trade Law of The People’s Republic of China, the Law of the People’s Republic of China on Import and Export Commodity Inspection, the Administrative License Law of the People’s Republic of China, the Customs Law of the People’s Republic of China, the Regulation of the People’s Republic of China on the Administration of the Import and Export of Goods, the Regulation of the People’s Republic of China on the Inspection of the Import and Export Commodities and other relevant laws and administrative regulations.

第一条为了对部分自由进口的机电产品的进口情况进行监测和统计，根据《中华人民共和国对外贸易法》、《中华人民共和国货物进出口管理条例》、《货物自动进口许可管理办法》及《机电产品进口管理办法》，制定本办法。    Article 1 With a view to undertake monitoring and collection of statistics of free import of some mechanical and electronic products, these Measures are formulated in accordance with the Foreign Trade Law of The People’s Republic of China, the Regulation of the People’s Republic of China on the Administration of the Import and Export of Goods, the Measures for Administration of Automatic Import License of Goods and the Measures for Administration of Import of Mechanical and Electronic Products.

第十条　进口旧船舶的申请进口单位，须提供第八条第一至第三款所列材料以及中华人民共和国海事局出具的《旧船舶进口技术评定书》或中华人民共和国渔业船舶检验局出具的《旧渔业船舶进口技术评定书》。    Article 10 Importers applying for import of used vessels shall provide materials listed in Item 1 to Item 3 of Article 8 as well as the Technical Assessment on the Imported Used Vessel by the Maritime Safety Administration PRC and the Technical Assessment on the Import Used Fishing Vessel by the Register of Fishing Vessel PRC.

第十条 电力线路保护区：    Article 10 Power line protection zones:

第十条（建筑物内共用部位安装空调设备的限制）禁止在建筑物内的走道、楼梯、出口等共用部位安装空调设备。    Article 10 Restriction on the Installation of Air-conditioners in Shared Space of Buildings Installation of air-conditioners in shared space of buildings such as passages, stairways and exits shall be prohibited.

第十条申请进口单位所提交的材料不实的，商务部及地方、部门机电办可不予签发机电产品《进口自动许可证》。    Article 10 The MOFCOM and local and departmental mechanical and electronic offices can refuse issuance of the Automatic Import License if the materials submitted by entities applying for import are inaccurate.

第十条商务部会同海关总署、质检总局制定、调整并公布《限制进口机电产品目录》。限制进口的机电产品，实行配额、许可证管理。    Article 10 The MOFCOM together with the GAC and the GAQSIQ shall formulate, adjust and promulgate the Catalogue of Mechanical and Electronic Products under Restrictive Import Category. The mechanical and electronic products under restrictive import category are subject to quota and license administration.

第十条 电力发展规划应当根据国民经济和社会发展的需要制定，并纳入国民经济和社会发展计划。    Article 10 The planning for electric power development shall be drawn up on the basis of the requirements of national economy and social development and shall be put into the plan of national economy and social development.

第一百零九条 破坏电力、煤气或者其他易燃易爆设备，危害公共安全，尚未造成严重后果的，处三年以上十年以下有期徒刑。    Article 109 Those who destroy electric power, gas,or other inflammable or explosive equipment and thereby endanger public safety, if serious consequences have not yet resulted in, shall be sentenced to imprisonment between three to ten years.

第十一条进口单位凭加盖进口自动许可证专用章的《进口自动许可证》向银行办理售付汇手续，向海关办理通关手续。    Article 11 Entities applying for import shall handle payment of foreign exchanges in banks and clearance procedures in customs against the Automatic Import License with the seal of the automatic import license stamp.

第十一条　进口单位可以通过网上申请或书面申请向商务部提出重点旧机电产品的进口申请。    Article 11 Import entities can make online or written applications on the import of specified used mechanical and electronic products to the MOFCOM.

第十一条 县以上地方各级电力主管部门应采取以下措施，保护电力设施：    Article 11 Power administrative departments at and above the county level shall take following measures to protect power facilities:

第十一条（优秀近代建筑安装空调设备的要求）在属于本市优秀近代建筑的建筑物上安装空调设备的，必须符合本市优秀近代建筑保护管理的有关规定。    Article 11 Requirements on the Installation of Air-conditioners in Superior Modern Buildings Installation of air-conditioners in superior modern buildings of this Municipality must conform to the relevant regulations concerning the administration of superior modern buildings protection in this Municipality.

第十一条 城市电网的建设与改造规划，应当纳入城市总体规划。    Article 11 The construction and retrofit planning of urban power networks shall be put into the overall urban planning.

第十一条国家限制进口的旧机电产品称为重点旧机电产品。    Article 11 The used mechanical and electronic products under state restrictive import category are called as specified used mechanical and electronic products.

第一百一十条 破坏交通工具、交通设备、电力煤气设备、易燃易爆设备造成严重后果的，处十年以上有期徒刑、无期徒刑或者死刑。    Article 110 Those who destroy vehicles, traffic equipment, electric power or gas equipment, or inflammable or explosive equipment, thus causing serious consequences, shall be sentenced to more than 10 years' imprisonment, life imprisonment, or death.

第一百一十四条 工厂、矿山、林场、建筑企业或者其他企业、事业单位的职工，由于不服管理、违反规章制度，或者强令工人违章冒险作业，因而发生重大伤亡事故，造成严重后果的，处三年以下有期徒刑或者拘役；    Article 114 If any staff member or employee of a factory, mine, forestry farm, construction enterprise or other enterprise or institution disobeys management, violates rules and regulations, or forces workers to disobey instructions and work in an operational risks, and thereby causes serious injury or death, the person shall be sentenced to imprisonment of up to three years or criminal detention;

第十二条 任何单位或个人在电力设施周围进行爆破作业，必须按照国家有关规定，确保电力设施的安全。    Article 12 Any unit or individual should ensure the safety of power facilities according to related regulations by the State when conducting explosion operations around power facilities.

第十二条（道路两侧安装空调设备的市容要求）沿城市道路两侧建筑物安装的空调设备，应当统一安装位置，符合市容要求。    Article 12 Requirements on the Installation of Air-conditioners Along the Streets With Respect to City Appearance Air-conditioners in buildings along the streets of the city shall be installed in the uniformly planned positions so as to meet the requirements of city appearance.

第十二条《限制进口机电产品目录》及《重点旧机电产品进口目录》至迟应当在实施前21天公布。在紧急情况下，应当不迟于实施之日公布。    Article 12 The Catalogue of Mechanical and Electronic Products under Restrictive Import Category and the Catalogue of Import of Specified Used Mechanical and Electronic Products shall be promulgated 21 days before implementation. In urgent circumstances, the date of promulgation shall not be later than that of implementation.

第十二条　申请进口单位申请材料齐全后，商务部应正式受理，并向申请进口单位出具受理通知单。    Article 12 The MOFCOM shall accept an application officially and issue a notice of acceptance to the entity applying for import if its application materials are complete.

第十二条 国家通过制定有关政策，支持、促进电力建设。    Article 12 The State formulates relevant policies to support and promote electric power construction.

第十二条机电产品《进口自动许可证》实行“一批一证”或“非一批一证”管理。    Article 12 The “one-batch-one-license” and “non-one-batch-one–license” is applicable to the administration of Automatic Import License of mechanical and electronic products.

第十三条 电力投资者对其投资形成的电力，享有法定权益。    Article 13 Investors in electric power shall enjoy legal rights and interests over the electricity generated from their investment.

第十三条 任何单位或个人不得从事下列危害发电厂、变电所设施的行为：    Article 13 No unit or individual is allowed to commit the following acts that would endanger power facilities and power transformation facilities:

第十三条（安全要求）空调设备的使用者应当采取相应的安全保障措施，并定期检查，防止意外事故发生。    Article 13 Safety Requirements Users of air-conditioning equipment shall take appropriate safety measures and conduct periodic checks so as to avoid accidents.

第十三条实行配额管理的限制进口机电产品，依据国务院颁布的有关进口货物配额管理办法的规定实施管理。    Article 13 The mechanical and electronic products under restrictive import category of quotation administration shall be administrated according to the provisions of relevant measures for import quotation administration of goods issued by the State Council.

第十三条　正式受理申请后，商务部如认为有必要，可征求相关部门或行业协会的意见。    Article 13 The MOFCOM can collect opinions of relevant departments or trade associations, if necessary, after formal acceptance of application.

第十三条商务部根据海关留存的《进口自动许可证》使用纪录，对《进口自动许可证》项下机电产品的进口情况进行统计。    Article 13 The MOFCOM shall take statistics of import of the mechanical and electronic products subject to the Automatic Import License according to the used records of Automatic Import License kept by customs.

第十四条实行进口许可证管理的机电产品，地方、部门机电办核实进口单位的申请材料后，向商务部提交。    Article 14 For the mechanical and electronic products subject to import license administration, local and departmental mechanical and electronic offices shall submit application materials of import entities to the MOFCOM after verification.

第十四条 任何单位或个人，不得从事下列危害电力线路设施的行为：    Article 14 No unit or individual is allowed to engage in the following acts that would endanger power transmission lines and facilities:

第十四条 电力建设项目应当符合电力发展规划，符合国家电力产业政策。    Article 14 Power construction projects shall conform to the electric power development planning as well as the State's industrial policies on the power industry.第十四条（空调设备冷凝水排放的限制）空调设备冷凝水的排放，不得妨碍他人的正常工作、生活。    Article 14 Restrictions on the Discharge of Condensed Water from Air-conditioning Equipment The discharge of condensed water from air-conditioning equipment shall not interfere with the normal work and life of others.

第十四条《进口自动许可证》在公历年内有效，有效期为6个月。实际用汇额低于或不超过原定用汇额10%的，不需变更《进口自动许可证》。    Article 14 The Automatic Import License is valid within the calendar year and the valid term is 6 months. No alteration of the Automatic Import License is needed if the actual foreign exchange used is less than 10% of the foreign exchange quota.

第十四条　商务部应当遵循下列要求审核申请：    Article 14 The MOFCOM shall verify applications in accordance with following requirements:

第十五条 任何单位或个人在架空电力线路保护区内，必须遵守下列规定：    Article 15 Any unit or individual should observe the following rules in the overhead power line protection zones:

第十五条（噪声污染的治理）使用空调设备，应当避免噪声妨碍他人的正常工作、生活。    Article 15 Control of Noise Pollution In using air-conditioning equipment, care shall be taken not to allow noise to disturb the normal work and life of others.

第十五条《进口自动许可证》如有遗失，进口单位应当立即向原发证机构书面报告挂失。原发证机构收到挂失报告后，经核实后决定是否补发。    Article 15 If the Automatic Import License is lost, the import entity shall report the loss to the original issuance agency immediately. The original issuance agency shall decide whether to reissue a license after verification upon receipt of loss report.

第十五条 输变电工程、调度通信自动化工程等电网配套工程和环境保护工程，应当与发电工程项目同时设计、同时建设、同时验收、同时投入使用。    Article 15 Projects for power networks such as transmission, substation, power dispatching telecommunication and automation projects, and environmental protection projects, shall be designed,constructed, inspected for acceptance and put into operation simultaneouslywithelectricity generation projects.

第十五条商务部会同海关总署制定并公布《机电产品进口许可管理实施办法》，商务部会同海关总署、质检总局制定并公布《重点旧机电产品进口管理办法》。    Article 15 The MOFCOM and the GAC shall formulate and promulgate the Measures for Implementation and Administration of Import License of Mechanical and Electronic Products. The MOFCOM, together with the GAC and GAQSIQ shall formulate and promulgate the Measures for Administration of Specified Used Mechanical and Electronic Products.

第十五条　商务部应在正式受理后20日内决定是否批准进口申请。    Article 15 The MOFCOM shall determine whether approve the import application or not within 20 days after official acceptance.

第一百五十一条 盗窃、诈骗、抢夺公私财物数额较大的，处五年以下有期徒刑、拘役或者管制。    Article 151 Those who steal, cheat, or rob a large amount of public or private property shall be sentenced to imprisonment of up to five years, criminal detention, or criminal surveillance.

第一百五十二条 惯窃、惯骗或者盗窃、诈骗、抢夺公私财物数额巨大的，处五年以上十年以下有期徒刑；    Article 152 Habitual thieves, cheats, or those who steal, cheat, or rob a huge amount of public or private property shall be sentenced to imprisonment between five to ten years;

第十六条 任何单位或个人在电力电缆线路保护区内，必须遵守下列规定：    Article 16 Any unit or individual should observe the following rules within the power cable line protection zones:

第十六条进口单位已申领的《进口自动许可证》，如未使用或确定不需要使用时，应当及时交回原发证机构。    Article 16 If import entities that applied and obtained the Automatic Import License have not used or determine not to use the licenses, they shall return the license to the original issuance agency in a timely manner.

第十六条 电力建设项目使用土地，应当依照有关法律、行政法规的规定办理；依法征用土地的，应当依法支付土地补偿费和安置补偿费，做好迁移居民的安置工作。    Article 16 Land used for power construction projects shall be handled in accordance with relevant laws and administrative regulations; and in the case where the land is legally requisitioned, the land compensation fee and relocation compensation fee shall be paid therefor according to law, and the relocation of residents shall be handled properly.

第十六条（对危害环境行为的处罚）对违反本规定，有下列行为之一的单位和个体经营者，环境保护部门可给予警告、责令限期改正的处罚，并可处以５００元以上５０００元以下的罚款：    Article 16 Penalties for Acts Endangering the Environment Units or self-employed workers who commit one of the following acts in violation of these Provisions shall be enjoined by the environmental protection departments to make rectification within the prescribed period of time and given a disciplinary warning or a fine of RMB 500 to 5,000:

第十六条　商务部配额许可证事务局凭商务部的批准文件发放《进口许可证》。    Article 16 The Bureau of Quota License Affairs of the MOFCOM shall issue Import License against approval documents by the MOFCOM.

第十六条为了监测机电产品进口情况，国家对部分自由进口的机电产品实行进口自动许可。    Article 16 To monitor the import of mechanical and electronic products, the state implements automatic import license to some mechanical and electronic products under free import category.

第十七条 任何单位或个人必须经县级以上地方电力主管部门批准，并采取安全措施后，方可进行下列作业或活动：    Article 17 Any unit or individual should get the approval of power administrative departments at and above the county level and take safety measures before carrying out the following operations or activities:

第十七条　申请进口单位凭进口旧机电产品备案相关证明及其他相关单证向检验检疫机构办理检验手续，检验检疫机构对符合条件的产品出具《入境货物通关单》（备注栏内标注“旧机电产品进口备案”字样）。    Article 17 Entities applying for import shall go through inspecting procedures in inspection and quarantine agencies with relevant certificates of import of used mechanical and electronic products and other relevant documents, and inspection and quarantine agencies shall issue an Inbound Goods Notice for the products met requirements (write “for file of import of used mechanical and electronic products” in the remark column).

第十七条（对违反安装申请审批规定行为的处罚）    Article 17 Penalties for Violation of the Provisions Regarding the Examination and Approval of Application for Installation of Air-conditioning Equipment

第十七条 地方人民政府应当支持电力企业为发电工程建设勘探水源和依法取水、用水。电力企业应当节约用水。    Article 17 The local people's governments shall support power enterprises in exploring water resources, tapping and using water according to law for the construction of electricity generation projects. The power enterprises shall economize on water.

第十七条商务部会同海关总署制定、调整并公布《进口自动许可机电产品目录》。    Article 17 The MOFCOM, together with the GAC and the GAQSIQ, formulate, adjust and promulgate the Catalogue of Automatic Import License of Mechanical and Electronic Products.

第十七条有下列进口属于进口自动许可的机电产品情形之一的，适用本办法：    Article 17 These Measures shall be applicable to the import of mechanical and electronic products subject to automatic import license in any of following circumstances:

第十八条 电力生产与电网运行应当遵循安全、优质、经济的原则。    Article 18 Electric power production and power network operation shall be in line with the principles of safety, high quality and economy.

第十八条 任何单位或个人不得从事下列危害电力设施建设的行为：    Article 18 No unit or individual is allowed to conduct the following acts that would endanger the construction of power facilities:
